EXECUTIVE SUMMARY
Recommendation to approve a refund in the amount of $167,389.80 of sidewalk payment in lieu fees
to multiple developers within the Naples Production Park and Pine Ridge Industrial Park and hold
Land Development Code Section 6.06.02(C) in abeyance pending the update of the Collier
Metropolitan Planning Organization’s update of the Comprehensive Pathways Plan.
OBJECTIVE: To provide refunds to individuals who paid in lieu of construction of sidewalks within the
Naples Production Park and Pine Ridge Industrial Park and hold a section of the Land Development Code
(LDC) in abeyance pending the update of the Comprehensive Pathways Plan.
CONSIDERATIONS: On December 14, 2012, the Collier Metropolitan Planning Organization (MPO)
adopted an update to the Comprehensive Pathway Plan. Differing from the prior adopted plan, the plan
focuses mainly on collector and arterial roadways and does not include an overarching policy statement as
it had in the past. Needs that were previously identified in the Naples Production Park and Pine Ridge
Industrial Park are no longer included in the updated plan. Staff has been collecting payment in lieu of
sidewalk construction fees in the two identified areas since the adoption of the Comprehensive Pathway
Plan. Following is a list of development orders, the amount paid and the roadway:

The MPO has identified a need to update the Comprehensive Pathway Plan in their Unified Planning
Work Program. Once the Comprehensive Pathway Plan is updated, which is anticipated to be completed
in the next 12 months, staff will be able to address if LDC amendments are necessary to address bicycle
and pedestrian needs in these two industrial park areas. Until that time, staff is requesting to hold section
6.06.02(C) in abeyance for the Naples Production Park and the Pine Ridge Industrial Park areas.
FISCAL IMPACT: Funding in the amount of $167,389.80 is available in Projects 69081, 69331, 69333
and 69336 to process the PIL refunds.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this

RECOMMENDATION: To approve the refund of $167,389.80 in sidewalk payment in lieu funds and
hold section 6.06.02(C) of the LDC in abeyance for the Naples Production Park and Pine Ridge Industrial
Park pending the update of the Collier MPO’s Comprehensive Pathway Plan.
