THIS CAUSE came on for public hearing before the Code Enforcement Board on July 28,2016 on the
Respondents' Motion for Continuance,and being duly advised in the premises,hereupon issues its Findings of Fact,
Conclusions of Law, and Order of the Code Enforcement Board, as follows:
FINDINGS OF FACT
1. Respondents,RAFFAELE FABRIZIO and JANICE FABRIZIO are in violation of Collier County Land
Development Code 04-41, as amended, Section 10.02.06(B)(1)(a)in the following particulars:
Pool permit PRBD20140514906 expired leaving the pool with no permanent safety barrier creating a health
and safety hazard
ORDER
Based upon the foregoing, and pursuant to the authority granted in Chapter 162,Florida Statutes,and Collier County
Ordinance No.07-44, as amended,it is hereby ORDERED:
A. The Respondents' Motion for Continuance of this case is GRANTED until September 26,2016.

AMENDED ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came on for public hearing before the Code Enforcement Board on June 23, 2016, and the
Code Enforcement Board,having heard testimony under oath,received evidence and heard argument respective to all
appropriate matters,hereupon issues its Findings of Fact and Order of the Code Enforcement Board,as follows:
FINDINGS OF FACT
1. Respondent,PEE-WEE'S DUMPSTERS,INC.,is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at 721 Logan Blvd. S,Naples,FL,Folio#38280090006(Legal: GOLDEN GATE
EST. UNIT 32 N 164 02 FT OF TR. 2 AND S 3 FT OF TR. 3) is in violation of Collier County Land
Development Code 04-41, as amended, Section 5.02.03(A), 5.02.03(D), 5.02.03, 5.02.03(F), 5.02.03 (1)and
5.02.03(G). Prohibited Use. Collier County Land Development Code 04-41, as amended, Section 2.02.03
Zoning Districts. Collier County Land Development Code 04-41, as Amended, Section 2.03.01(B) in the
following particulars:
Prohibited business activity taking place on property which includes,but is not limited to: delivering and
removing dumpsters and excessive noise.
5. The violation has not been abated as of the date of the public hearing.
6. This violation is a repeat violation with a prior violation of a similar nature occurring in 2011 and resulting
in fines and penalties against the owner. The Board specifically finds that the action taken against the
owner in 2011 has been ineffective in that the owner continues to operate his business, delivering and
removing dumpsters and create excessive noise.
7. At the hearing, several owners of the neighboring properties, including the owner of the Vineyards
development testified that the owner of Pee-Wee's Dumpsters is loading and unloading dumpsters from its'
business and from other businesses causing excessive noise,debris and noxious fumes to enter into their
properties. Despite contacting the Sheriff's Department,the Fire Department and Code Enforcement,the
landowner continues to violate the code provisions without being deterred.
8. That a copy of this Order,together with a written request to both the County Attorney's Office and the
licensing bureau for the operation of the business, Pee-Wee's Dumpsters, Inc.,will be provided to bring to
their attention the ongoing violations from this business,the effect it is having on the surrounding
community and to request further action, including foreclosure of the existing lien and revocation of any
operating licenses.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of of Collier County Land Development Code 04-41, as amended, Section
5.02.03(A), 5.02.03(D), 5.02.03, 5.02.03(F), 5.02.03 (1) and 5.02.03(G). Prohibited Use. Collier County
Land Development Code 04-41, as amended, Section 2.02.03 Zoning Districts. Collier County Land
Development Code 04-41, as Amended,Section 2.03.01(B).
B. Respondent must cease all prohibited home occupation business activities and follow the guidelines of the
Collier County Land Development Code 04-41,as amended,Section 5.02.03 on or before June 25,2016
or a fine of $1,000.00 per day will be imposed for each day the violation remains thereafter.
C. Respondent must cease any and all uses other than what this Estates Zoned property is intended for by
removing all unauthorized dumpsters to an area designated for such use,or by keeping them loaded on
approved commercial vehicles or storing them in a completely enclosed permitted structure on or before
June 25,2016 or a fine of 1,000.00 per day will be imposed for each day the violation remains thereafter.
Note that this is an enhanced penalty under the law for a repeat violation.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may
abate the violation using any method to bring the violation into compliance.If necessary,the County may
request the services of the Collier County Sheriff's Office for the purpose of accessing the property for
abatement. All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$65.43 on
or before July 22,2016.
F. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

approved site development plan for the storage of vehicles for sale. Also,several unlicensed vehicles are being
stored in the parking lot spaces in front of the business.
5. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent's Motion for Continuance of this case is DENIED.
B. Respondent is found guilty of violating Collier County Land Development Code 04-41, as amended,Section
1.04.01(A)and 2.02.03.
C. Respondent must abate the violation by complying with the approved Site Development Plan by only
utilizing the three approved parking spaces and removing all unlicensed vehicles from the property not
associated with the approved allowable parking spaces and each vehicle that remains in the approved parking
spaces must have a valid license plate affixed on or before August 11,2016 or a fine of$500.00 per day will
be imposed for each day the violation remains thereafter.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may abate
the violation using any method to bring the violation into compliance.If necessary,the County may request
the services of the Collier County Sheriff's Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$64.59 on or
before August 27,2016.
F. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

permit, inspections, and Certificate of Completion/Occupancy for the repairs of the roadway surface and sides
of the roadway on or before October 26,2016,or a fine of$150.00 per day will be imposed for each day
the violation remains thereafter;
C. The Respondent must notify the Code Enforcement Investigator when the violation has been abated in order
to conduct a final inspection to confirm abatement. If Respondent fails to comply with this Order,the Collier
County Code Enforcement Department may abate the violation using any method to bring the violation into

B. Respondent must abate the violation by applying for and obtaining all required Collier County Right Of
Way Permit(s)and inspections through to issuance of a final approval to bring the Right of Way to a

FINDINGS OF FACT
1. Respondent is charged with violation of Collier County Land Development Code 04-41, as amended,
Section 10.02.06(B)(1)(A),in the following particulars:
Unpermitted structures and exterior lighting in the rear yard
ORDER
Based upon the foregoing,and pursuant to the authority granted in Chapter 162,Florida Statutes, and
Collier County Ordinance No. 07-44, as amended, it is hereby ORDERED:
A. The Respondent's Motion for Continuance of this case is GRANTED until September 26,2016.
B. All parties shall be re-noticed for the subsequent hearing date.
C. Fines shall accrue during the Continuance period.

3. Respondent,having been duly notified,did appear at the public hearing through its representative, Shawn
Cassell.
4. The real property located at 81 Burnt Pine Drive,Naples,FL Folio#66262021764(Legal:PEBBLEBROOK
LAKES PHASE 3 LOT 7) is in violation of Collier County Land Development Code 04-41, as amended,
Section 10.02.06(B)(1)(a)in the following particulars:
Air conditioning change out without required Collier County permits,inspections,and Certificate of
Completion/Occupancy.
5. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44, as amended, it is hereby ORDERED:
A. Respondent's Motion for Continuance of this case is DENIED.
B. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended,Section
10.02.06(B)(1)(a).
C. Respondent must abate the violation by obtaining all required Collier County Building Permit(s)or
Demolition Permit, inspections and Certificate of Completion/Occupancy on or before September 26,2016,
or a fine of$100.00 per day will be imposed for each day the violation remains thereafter.
D. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may abate
the violation using any method to bring the violation into compliance. If necessary,the County may request
the services of the Collier County Sheriffs Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
E. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$66.69 on
or before August 27,2016.
F. Respondents shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

and added a roof with screened in area)without Collier County Building Permits,which violation(s)occurred

2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before June 22, 2016 or a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5257,PG 891).
3. Operational costs of$64.59 incurred by the County in the prosecution of this case have been paid.
4. The violation has been abated as of July 5,2016.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to
correct the violation;(c)whether there were previous violations committed by the violator;(d)the cost
upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)
the value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would
cause on the Respondent;(h)the time and cost incurred by the Code Enforcement to have the violation
corrected and(i)any other equitable factors which would make the requested mitigation appropriate.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:

COMES NOW, the undersigned, Julien F. Inois, on behalf of himself or Jesula Francois as representative for
Respondent and enters into this Stipulation and Agreement with Collier County as to the resolution of Notices

In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which

ORDER OF THE CODE ENFORCEMENT BOARD
THIS CAUSE came before the Code Enforcement Board upon the Petitioner's Motion for Imposition
Fines/Liens on July 28,2016,and the Code Enforcement Board,having heard argument respective to all appropriate
matters,hereupon issues its Findings of Fact and Order of Code Enforcement Board,as follows:
FINDINGS OF FACT
1. On February 25, 2016, Respondent was found guilty of violating Collier County Land Development Code
04-41, AS AMENDED, Section 10.02.06(B)(1)(A) for having a dock and boat lift installed on improved
occupied waterfront residential property without first obtaining the required permit(s), inspections and
certificate of occupancy/completion,which violation(s)occurred on the property located at 631 Palm Ave.,
Goodland, FL, Folio No. 46420920009 (Legal Description: GOODLAND ISLES 1ST ADD BLK C, LOT
17,.OR 1892,PG 201)
2. An Order was entered by the Code Enforcement Board ordering Respondent to abate the violation on or
before June 24, 2016 or a fine of$200.00 per day would be assessed for each day the violations continue
thereafter until abatement is confirmed. (A copy of the Order is recorded at OR 5247,PG 3188).
3. Operational costs of$64.59 incurred by the County in the prosecution of this case have been paid.
4. The violation has been abated as of July 22,2016.
5. The Board considered the following(a)the gravity of the violation;(b)actions taken by the Respondent to
correct the violation;(c)whether there were previous violations committed by the violator;(d)the cost
upon the violator to correct the violation;(e)the amount of the time necessary to correct the violation;(f)
the value of the real estate compared to the amount of the fine/lien;(g)any hardship the fine/lien would
cause on the Respondent;(h)the time and cost incurred by the Code Enforcement to have the violation
corrected and(i)any other equitable factors which would make the requested mitigation appropriate.
ORDER
Based upon the foregoing Findings of Fact,and pursuant to the authority granted in Chapter 162,Florida
Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
A. Respondent's Motion to Abate Fines is granted and no accrued fines are imposed.

FINDINGS OF FACT
1. Respondent,MARIA TERESA PAZ, is the owner of the subject property.
2. Respondent was notified of the date of hearing by certified mail and posting and the Code Enforcement
Board has jurisdiction of this matter.
3. Respondent,having been duly notified,did not appear at the public hearing.
4. The real property located at 2480 Andrew Drive,Naples,FL Folio#82640280004(Legal: WILMER HGTS
BLK A LOT 11) is in violation of Collier County Land Development Code 04-41, as amended, Section
10.02.06(B)(1)(a)in the following particulars:
Accessory structures built prior to obtaining Collier County building permits.
5. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes, and Collier County Ordinance No.2007-44,as amended, it is hereby ORDERED:
A. Respondent is found guilty of violating Collier County Land Development Code 04-41,as amended, Section
10.02.06(B)(1)(a).
B. Respondent must abate the violation by obtaining all required Collier County Building Permit(s)or
Demolition Permit, inspections and Certificate of Completion/Occupancy on or before October 26,2016,or
a fine of$200.00 per day will be imposed for each day the violation remains thereafter.
C. If Respondent fails to comply with this Order,the Collier County Code Enforcement Department may abate
the violation using any method to bring the violation into compliance. If necessary,the County may request
the services of the Collier County Sheriff's Office for the purpose of accessing the property for abatement.
All costs of abatement shall be assessed against the property.
D. Respondent is ordered to pay operational costs for the prosecution of this case in the amount of$64.59 on
or before August 27,2016.
E. Respondent shall notify the Code Enforcement Investigator of this case within 24 hours of abatement or
compliance so that a final inspection may be performed to confirm compliance.

LAKES LOT 43) is in violation of Collier County Land Development Code 04-41, as amended, Section
10.02.06(B)(1)(a)in the following particulars:
Permit PRBD20120409082 expired without obtaining a Certificate of Completion.
5. The violation has not been abated as of the date of the hearing.
ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law,and pursuant to the authority granted in
Chapter 162,Florida Statutes,and Collier County Ordinance No.2007-44,as amended,it is hereby ORDERED:
