Greene,Assistant County Attorne)y�(_A�(_&) DATE: March 18, 2010 ��__/ RE: Sunshine Law and Agenda question - The issue presented is whether the Sunshine Law requires that an agenda be made available prior to board meetings. In summary,the answer is no. The Sunshine Law Manual (2009 Ed. Vol. 31)provides the following: The Attorney General's Office recommends publication of an agenda, if available, in the notice of the meeting;. if an agenda is not available, subject matter summations might be used. However, the courts have held that the Sunshine Law does not mandate that an agency provide notice of each item to be discussed via a published agenda. Such a specific requirement has been rejected because it could effectively preclude access to meetings by members of the general public who wish to bring specific issues before a governmental body. See Hough v. Stembridge, 278 So. 2d 288 (Fla. 3d DCA 1973). And see Yarbrough v. Young, 462 So. 2d 515 (Fla. 1st DCA 1985) (posted agenda unnecessary; public body not required to postpone meeting due to inaccurate press report which was not part of the public body's official notice efforts). Thus, the Sunshine Law has been interpreted to require notice of meetings, not of the individual items which may be considered at that meeting. However, other statutes, codes or ordinances may impose such a requirement and agencies subject to those provisions must follow them. Accordingly, the Sunshine Law does not require boards to consider only those matters on a published agenda. "[W]hether to impose a requirement that restricts every relevant commission or board from considering matters not on an agenda is a policy decision to be made by the legislature." Law and Information Services, Inc. v. City of Riviera Beach, 670 So. 2d 1014, 1016 (Fla. 4th DCA 1996). Today's Coastal Advisory Committee Clam Bay Subcommittee was properly noticed in compliance with the Sunshine Law on or about February 1, 2010. Further, the agenda for today's meeting was also publically noticed on the County's website on Monday, March 15, 2010. The related back-up materials for the agenda were supplemented and available on the County's website on Wednesday, March 17, 2010. In addition, a number of these materials also appeared on the agenda for the Coastal Advisory Committee meeting on Thursday, March 11, 2010. I. Call to Order Mr. Sorey called the meeting to order at 1:00PM II. Pledge of Allegiance The Pledge of Allegiance was recited. III. Roll Call Roll call was taken and a quorum was established. IV. Changes and Approval of Agenda Mr. McCann moved to approve the Agenda. Second by Ms. Penniman. Carried unanimously 7—0. V. Public Comments None VI. Approval of CAC Minutes 1. October 12,2016 Ms. Roddy moved to approve the minutes of the October 12, 2016 as submitted. Second by Mr. Koziar. Carried unanimously 7—0. VII. Staff Reports 1. Expanded Revenue Report The Committee reviewed the"Collier County Tourist Tax Revenue FY 17 TDC Revenue Report" dated through November 30, 2016. VIII. New Business 1. Annual Monitoring of Beaches & Inlet Proposal Work Order Mr. McAlpin presented the Executive Summary "Recommendation to approve a proposal from Humiston &Moore Engineers for Collier County Beaches and Inlets Annual Monitoring for 2017 under Contract No. 15-6382, authorize the County Manager or his designee to execute the work order for a not to exceed amount of$182,840.00 and makes a finding that this expenditure promotes tourism"dated December 8, 2016 for consideration. He noted: • The scope of work includes the annually survey of the beaches and inlets. • The results will be utilized to determine the 2017 beach renourishment and dredging projects for the County. • The item will be heard by the Board of County Commissioners at their January 3'2017 meeting with after the fact approval sought from Tourist Development Council in late January of 2017. • The work is anticipated to be completed by February of 2017. Beach Renourishment Truck Haul-Update/Report Mr. McAlpin provided an update on the Beach Renourishment Truck Haul project highlighting: • The renourishment was initiated on November 1 and anticipated to be completed December 9'2016. • Sand was placed on 4 area beaches (Vanderbilt, Pelican Bay, Park Shore, Marco Island and Sugden Park)and Pelican Bay will be reimbursing the County for the sand placed on their portions of the beach per an agreement with the County. • The County worked diligently on establishing protocols for the truck routes established by all parties involved. • Unfortunately, some truck haulers violated the routes intentionally,while others left the stickers issued for the project on their trucks while they performed work under other contracts. This led to individuals from the public lodging complaints the County was not adhering to the agreed traffic standards. • To address the issue for future projects, the County is investigating the feasibility of utilizing transponders on the trucks. The technology would allow an interested party to determine via the internet where the trucks are at a particular time. Also, a notification may be provided to qualified individuals if the truck is off the approved route. • The County also utilized a different survey process with the Engineer of Record verifying the quantity of sand placed and the County was satisfied with the new activity. • The County was satisfied with the project with no complaints were lodged by the City of Naples or the City of Marco Island. 3. Truck Haul vs. Hopper Dredging Recent Discussions Mr. McAlpin provided the report "Beach Renourishment Options with Hopper Dredging"dated 11/10/16 highlighting: • The County is assessing the feasibility of hopper dredging for future beach renourishment projects. • In recent years, the County has been utilizing truck haul projects for the activity for several reasons which included: • The County project is small in nature compared to other jurisdictions projects and the dredgers prefer focusing on larger projects (Collier County requires l Ocy/foot of sand to be placed while areas like Captiva requires 80— 1 OOcy/foot of sand). • The County beaches are narrow in width and in close proximity to the nearshore hardbottom and require placement of a larger grain of sand which is only available further off shore. • The coastal area is relatively shallow and with the available freeboard of the dredges they are required to be moored far offshore which requires larger equipment(50,000hp pumps)to transfer the sand to the beaches. • The work may only be completed outside of turtle nesting season(May 1 — November 1) and the dredgers require a more flexible construction schedule to mobilize and undertake the projects. CAC January 12,2017 VI-1 Approval of Minutes 4 of 5 • There are only 3 —5 contractors available for the work creating a high demand for their services. • Factors are emerging which may alleviate some of the issues include dredges requiring less freeboard, the potential of leaving the pipeline in place for long periods of time and the ability to screen the sand on the beach as opposed to the dredge site. • Truck hauls have proven more cost effective however the activity is restricted placement of approximately 250,000cy of sand. • The Board of County Commissioners is reviewing the item at their next meeting and he will provide updates as they become available. Mr. Brown arrived at 1:48pm. IX. Old Business Mr. McAlpin provided the following updates: Doctors Pass • The beach in the area is one of the most eroded in the County and there are two projects underway to address the issues: Rebuilding of the South Jetty and construction of erosion control structures. • The County continues to pursue the approvals from the applicable Agencies for the work including addressing shore bird habitat(Red Knot and Piping Clover). • They are moving up the queue in the review process and hope to have the work underway by the end of 2017. Coastal Planning—Beach/Coastal Resiliency Ms. Penniman expressed concern the County is focused on project oriented solutions to issues and not long term solutions to protect the beaches and coastal structures. She recommended consideration be given to developing a long range plan for"beach/coastal resiliency"to aid the County in addressing the issues. The Committee discussed the recommendation noting: • The study could include the feasibility of widening and increasing the masses of the beaches, expanding the dune system, installation of soft or hard breakwater"structures"including mangrove islands. • It would be beneficial to develop initial concepts and present them to the various jurisdictional Agencies to determine if they are"permittable." • The study would require a directive from the Board of County Commissioners. The Committee reached consensus and directed Staff to contact the County Manager on the concept of developing a 20—50 year "beach/coastal resiliency plan." Rocks on the Beach Mr. McAlpin reported the County is investigating the status of rocks on the beaches, many of which have been removed in the past. Any work may be completed at the time of the Doctors Pass project and he will provide an update at a future meeting. Sea Level Rise Study CAC January 12,2017 VI-1 Approval of Minutes 5of5 Chairman Sorey reported,under direction from the Committee, he contacted the Board of County Commissioners in writing on the CAC wishes to provide input on any studies the County undertakes regarding sea level rise. He has not heard back from Chairman Fiala on the correspondence at this point in time. X. Announcements None XI. Committee Member Discussion Ms. Roddy requested an update on the Marco Island Regrade project—Mr. McAlpin reported, at this point in time, the project is anticipated to be undertaken in November of 2017. Mr. Moreland reported Members of the Estuary Conservation Association,Pelican Bay Yacht Club, etc. assess the Wiggins Pass area and develop updated navigational information and requested Staff to identify any avenues which may be available for dissemination of the information to the public. This forces Collier to use either hopper dredges for farther offshore sand sources or truck hauling from an inland mine to renourish our beaches. ➢ Two existing off shore sand sources exist. Both are located in federal waters and require BOEM leases. BOEM does not charge local governments for sand. However, environmental studies and permitting are very significant and costly. > Tom's Hill is located off Captiva and 40 miles from Collier County. Collier County spent$2M to develop this source in 2005. It has several million CY's remaining, contains high quality(.33mm) sand,the quality is consistent and was used in 2005. Collier has an existing 500,000 CY lease with BOEM that will need to be renewed in XXX. > The second source is located approximately 15 miles off the Cape Romano shoals and has been investigated but not developed. The sand is of a lesser quality(.25mm)and quantity(1-2 million CY's). It will most likely cost the County$1M to develop and permit. > Because of the equipment involved and the high mobilization costs ($3M-$5M)a hopper dredging project tries to maximize the amount of sand placed on the beach to reduce the unit costs. A typical project would employ a 6 year design life with advanced renourishment. Fill density could be as much a 100 CY's per foot at some locations (not Collier)to bring down the unit prices. > Truck Haul sand cost the County$13.5/CY. Three inland sand sources have been approved by FDEP. However to date, all sand has been provided by Stewart Mine in Immokalee, FL. Stewart current has a 5 year sand supply contract with Collier County. > Truck haul renourishment with an inland sand source is disruptive to communities and neighborhoods and needs to be accomplished every year or two to maintain Collier County beaches. This approach is limited to truck availability and exposes the county to greater safety concerns from truck accidents on and off the beaches. In 2016, approximately 5,800 one way truck trips were required to renourish our beaches (87,000 CY's). ➢ With truck haul beach renourishment the size of the project that can be accomplished at once will be limited. However,that was not the County's experience in 2016 with a total price of$43/CY for the recent truck haul renourishment. > Collier County beach are difficult to renourish with a hopper dredge. The contractors have significant barriers that inhibit their willingness to bid and ultimately their cost competitiveness. These are: 1. Availability of equipment and timing o All renourishment is done in the winter which is a policy decision by the County and not a requirement of our existing permits. Summer is less expensive,has calmer weather and if off season for the dredging community. o Market timing—longer renourishment window to take advantage of dredgers downtime when it's less expensive for dredgers to mobilize equipment and dredge. o Turtle nesting season—everybody is renourishing outside of turtle nesting season 2. Limited number of contractors o 3 to 5 contractors only o Imperative to work risks/fears out of the project in a partnership relationship o Maybe different contracting method or approaches 3. Specifics of our project o Size of the project—build as large a project as possible; 6 year design with advanced renourishment or maybe an 8 year design with the ability to move sand from accreting areas to erosional areas as needed during the life of the project o Long haul distance to sand source(40 miles+one way): new hopper dredges with 5,000 to 6,000 CY hopper capacity and shallow draft are more efficient and economical but in short supply. o Deep draft requirements—Draft of vessels require 2 miles of shore anchorage which require 5,000HP booster pumps and more pipeline. New hopper dredge vessels with shallow draft requirements help solve this problem. o Density of beach fill— 10 CY's/foot VS. 100CY's/foot—FDEP to allow wider beach based on sand performance. Major permit modification: expensive engineering and extended time. o Moving Pipelines—3 moves expected and very risky. Longer execution times may allow for submerged setup of pipelines in calmer more controlled environment. o Screening—inline screening on the beach without modifying hopper dredge 4. Pricing o Current truck haul is $43/CY; maximum capacity in 2 months is 250K CY's o 2005 hopper dredge renourishment cost$28/CY for 670K CY's o 2013 price was $90/CY for 320K CY's o Dredger doubles pricing every 8 to 10 years. We can expect to pay$40/CY to $60/CY in today's market. o Expect for a 300K CY to 400K CY project to cost$25M to $30M including engineering. CAC January 12,2017 VIII-2 New Business 3 of 3 Beach Renourishment Tasker 3 JG McAlpin 1/3/2017 Explain our evaluation of sharing a dredge > Dredge Ownership for Beach Renourishment 1. Most of the beach renourishment in the US is performed by the USACE and they contract out beach renourishment and will not work with or piggyback their contracts with local communities. 2. Our renourishment would require a trailing head suction hopper dredge; several tug boats; a tender/work boat; a survey boat; a 5,000HP booster pump; 10,000 feet of 30 inch welded steel pipe and splitters; a screening system; 2 D-6 dozers; misc. equipment like pickup trucks,backhoes, and survey equipment; and lastly and probably most important, trained personnel. 3. The hopper dredge itself could easily cost$300M-$400M and the entire package without the personnel could easily cost over$500M. 4. The only two communities on the west coast of Florida that are not renourished by the USACE are Collier and Longboat Key. Each community typically would renourish their beaches every 6 years. 5. The cost of the investment, the maintenance of the equipment, the skilled personnel requirements and the lack of communities that would be available to participate would make this a very questionable venture. > Dredging for Navigation and Pass Maintenance 1. Collier County has 5 passes but one size dredge doesn't fit all the needs. 2. Dredging in the Gulf requires enough freeboard to resist 3 foot seas. This requires a 14 inch inside diameter outlet pipe dredge and associated equipment to withstand these weather conditions. This dredge can be used for Wiggins Pass, Doctors Pass, Caxambas Pass, and Collier Creek dredging. Clam Pass would require a smaller piece of equipment. This equipment is not portable and requires mobilizations that can cost $250K-$500K. 3. This type of equipment would require a$10M-$20M investment with work vessels, tugs,barges, survey equipment and plastic pipe. 4. Only two cities in Florida have ever used their own dredging equipment to bypass sand at inlets. The city of Boca Raton has owned and operated a small 10 inch fixed dredge to maintain the interior channel. Bypassing of sand occurs continuously, typically 50,000 to 80,000 CY's per year from the interior channel. It is important to note that Boca only bypasses sand from the interior of the channel and hires contractors to dredge at the mouth and outside of the pass in the ocean. The city of Clearwater dredged sand in the 1980's but discontinued this operation after a few years. 5. In 1991 the West Coast Inland Navigation District which maintains 17 inlets within its jurisdiction evaluated the option of purchasing a dredge. For a number of reasons including buying, storing, operating,maintaining and keeping a dredge busy enough to justify ownership, it was concluded that ownership was not a viable option. 6. The USACE is responsible for maintaining many inlets through the US. Although the Corps does own and operate several small dredges in some Districts,those dredges are primary used in specific small inlets with high maintenance needs.
