RESOLUTION NO. 87- 265
A RESOLUTION ORDERING AND CALLING FOR A
COUNTYWIDE REFERENDUM ELECTION TO BE HELD
ON MARCH 8. 1988 AUTHORIZING THE COUNTY-WIDE
WATER POLLUTION CONTROL PROGRAM TO PROTECT
GROUNDWATER. FRESHWATER SURFACE WATER AND
OTHER NON-TIDAL WATER RESOURCES FROM ALL SOURCES
OP POLLUTION WITHOUT RAISING THE EXISTING
MILLAGE CAP OP ONE-TENTH (1/10) MILL.
WHEREAS, on November 6. 1984 the electorate of Collier County
approved the levy of a special County-wide millage not to exceed one-tenth
(1/10) mill to develop a County-wide Water Pollution Control Program to monitor
and study the treatment and disposal of sewage, and to abate the effects that
disposal of the resulting liquid and solid pollutants have on the water resources
of Collier County. Florida: and
WHEREAS. this referendum limited the use of the Water Pollution
Fund to pollution control programs involving sewage and sewage sludi;e. only:
and
WHEREAS. there are many pollutant sources other than sewage and
sludge which could adversely affect the quality of ground and surface water
resources of Collier County: and
WHEREAS, the Water Pollution Fund can not currently be used to
Implement programs addressing pollutants other than sewage and sewage sludge;
and

• WHEREAS. a new referendum is necessary to change this funding
constraint and to allow the Water Pollution Fund to be used for programs that
protect Collier County's water resources from all pollutants: and
WHEREAS, the Water Pollution Fund's existing millage cap of one-
tenth (1/10) mill is adequate to fund additional programs.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OP COLLIER COUNTY. FLORIDA that:
Section One: County-wide Referendum Election Called.
A county—wide referendum election be and is hereby ordered and
called to be held on March 8. 1988 for the purpose of submitting to the
qualified electors of Collier County. Florida. the following question:

Shall the County-Wide Water Pollution Control
Program, which is presently limited to protection
of water resources from pollution caused by sewage
treatment and disposal, be authorized to protect
groundwater, freshwater surface waters and other
non-tidal water resources from all sources of
• pollution without raising the existing millage cap •
of one-tenth (L10) mill?

Section Two: Polling Places. Hours of Election and Election Officials
The election shall be held at the polling places designated in each
• precinct in the County and be conducted by election officials appointed by the
Supervisor of Elections pursuant to applicable general law. The polls will be
open at the voting places from 7:00 A.M. to 7:00 P.M. on the day of the
election.
Section Three: Notice of Election
The Clerk of this Board shall publish a notice of the referendum in
the Naples Daily News, a newspaper of general circulation published In Collier
County, Florida. There shall be at least thirty (30) days notice of said
referendum, with publication to be made at least twice, once In the fifth week •
and once in the third week
prior to the week in which the referendum is to be
held. Said notice shall be in substantially the following form:

NOTICE IS HEREBY GIVEN, that a County-wide referendum
• election will be held on March 8. 1988 in Collier County,
Florida, to determine if the qualified electors residing
within the County favor having the County-wide Water
Pollution Control Program, which is presently limited to
protection of water resources from pollution caused by
sewage treatment and disposal, be authorized to protect
groundwater, freshwater surface water and other non-tidal
rater resources from all sources of pollution without
raising the existing millage.cap of one-tenth (1/10)

The polls till be open at the polling places on the date
of said referendum election from 7:00 A.M. to 7:00 P.M.
on the same day. All qualified electors residing in
Collier County. Florida may vote in said election.
Absentee voting shall be permitted upon compliance with
applicable provision of state law.
