16.1(.10 12/13/2016 EXECUTIVE SUMMARY Recommendation to approve a Stipulated Final Judgment and authorize the Chairman to execute a Settlement Agreement and Landscape Maintenance Agreement for Parcel Nos. 101FEE and 101TCE in the amount of$385,581 in the lawsuit styled Collier County v. Florida Power and Light Company, et al., Case No. 13-CA-1329 for the Collier Boulevard road improvement project. (Project No. 68056) (Fiscal Impact$139,581). OBJECTIVE: That the Board approve the attached Stipulated Final Judgment for payment of full compensation, for the taking of Parcel Nos. 101FEE and 101TCE in Collier County v. Florida Power and Light Company, et al., Case No. 13-CA-1329, Collier Boulevard Project No. 68056. CONSIDERATIONS: Collier County condemned a fee simple interest in a proposed right-of-way parcel containing 18,285 square feet (Parcel 101FEE) and a 6,915 square foot Temporary Construction Easement with a duration of three (3) years from the property owner, Florida Power and Light Company, for the purpose of expanding Collier Boulevard from four lanes to six lanes between Green Boulevard and Golden Gate Boulevard. The County's original offer was $246,000 for both parcels. An Order of Taking hearing was held on July 16, 2013, and the County deposited the sum of $246,000 into the Court Registry. The parties have since negotiated a settlement of$385,581 in full payment for the interests in the Parcels taken (as described in Exhibit "A"), including damages of any and all kind whatsoever, attorney fees and costs of any kind, and for any claims that were or could have been raised in an eminent domain action. In addition to the full compensation, if this Stipulated Final Judgment is approved, the County agrees to enter into a Landscape Maintenance Agreement with Florida Power and Light Company which would allow it to install replacement landscaping and irrigation equipment on the back-slope of the berm being constructed within the right-of-way taken from the Company on the west side of the proposed linear stormwater retention and treatment swale west of the divided highway. Staff finds this settlement to be reasonable and recommends approval. With approval of the Stipulated Final Judgment, the County will be responsible for the following costs: Additional deposit: $139,581 Clerk's Deposit Fee: $ 170 TOTAL $139,751 FISCAL IMPACT: Funds in the amount of$139,751 are available in Impact Fees. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. -CMG GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. RECOMMENDATION: To approve the Stipulated Final Judgment and authorize the Chairman to execute the Settlement Agreement and Landscape Maintenance Agreement as to Parcels 101 FEE and 101TCE and authorize payment of the funds as stated. Exhibit "I" to Joint Motion for Stipulated Final Judgment Packet Pg.2526 1 16.K.10.a SETTLEMENT AGREEMENT w w U_ THIS SETTLEMENT AGREEMENT ("Agreement") is made as of the day of December, 2016 between FLORIDA POWER & LIGHT COMPANY, a Florida Corporation 2 a. ("FPL"), and COLLIER COUNTY, a political subdivision of the State of Florida("COUNTY"). E FPL and the COUNTY are sometimes collectively referred to hereinafter as the"Parties". RECITALS ;Z The COUNTY is expanding Collier Boulevard generally from Green Boulevard to a Golden Gate Boulevard. The COUNTY acquired two parcels (Parcels 101 FEE and 101 TCE, hereinafter, the "Parcels") from. FPL through the exercise of its eminent domain power by filing •N an action styled Collier County v. Florida Power & Light Company, et al., Case no. 13-CA- J 1329, in the Circuit Court of the 20th Judicial Circuit in and for Collier County (the "eminent domain action"). Title to the Parcels vested in the COUNTY pursuant to an Order of Taking entered July 16, 2013 and the COUNTY'S subsequent deposit of funds in this action. A copy of a) a) the Order of Taking containing the legal descriptions for the Parcels is attached hereto as Exhibit c ns "A." Pursuant to a court order in this action entered November 6, 2014, the clerk of the court disbursed to FPL, without prejudice to contest further the amount of full compensation owed, the ns sum of $246,000.00 as follows: $236,000.00 for parcel 101FEE and $10,000.00 for Parcel 101 TCE. See attached Exhibit "B." As part of the Collier Boulevard road expansion for which the FPL parcels were acquired, COUNTY is constructing a berm within the perimeter right-of-way of Collier Boulevard adjacent to FPL's Golden Gate Service Center located at 4105 15`" Avenue, Naples, FL (the 'Berm"). The construction of the Berm is to be done in accordance with COUNTY'S a) plans (prepared by CH2MHILL for road no. CR 951 (Collier Boulevard and attached as an a, exhibit to the Landscape Maintenance Agreement referenced below.)). Should the temperature be forecast to be below thirty-four (34) degrees, the Association shall be ?s responsible for turning the irrigation system off in order to protect plants from possible freeze damage, 2. It shall be the Association's responsibility to notify the County's representative of any irrigation a) problems or additional irrigation maintenance needs. 3. The irrigation service personnel must trouble shoot time clocks, i.e. power-in 110 volt and 24-volt fuses,24 volts output when necessary. 4. The irrigation services personnel must trouble shoot any pump start relay, main fuses and capacitors when necessary. c L.
