EXECUTIVE SUMMARY
Recommendation to approve a donation of$41,874.12 as offsite preservation for Chatham
Woods (PL-20150002912) to satisfy the native vegetation retention requirement, and
authorize budget amendments.
OBJECTIVE: To accept an offsite preservation donation in the amount of$41,874.12 for the
Conservation Collier Program.
CONSIDERATIONS: The Land Development Code (LDC), Section 3.05.07, H.1.f. iii. a.
allows for offsite native vegetation retention requirements to be met by monetary payment to the
Conservation Collier Program. Applicants may make monetary donation to Collier County with
funds to be used by the County for the purchase and management of off-site conservation lands
within the county. The monetary payment is based on the location of the land to be impacted and
shall be equal to 125 percent (125%) of the average cost of lands in that Designation, as defined
by the Future Land Use Map (FLUM), purchased by Collier County, through the Conservation
Collier Program.
The proposed donor is requesting early work authorization for Chatham Woods, which is located
within the Urban area as defined by the FLUM. The vegetation preservation requirement for this
subdivision is 0.18 acres, and the applicant has elected to fulfill their preserve requirement
through offsite monetary donation to Collier County for the Conservation Collier Program. One
hundred and twenty five percent (125%) of average cost to Conservation Collier for lands within
the urban area is $232,634 per acre. Therefore, $232,634 X .18 = $41,874.12.
The Chatham Woods Plat has not yet come before the Board for approval, however the Land
Development Code, Section 3.05.07, H.1.f.i (d) allows all of the required onsite native vegetation
preservation requirement to be satisfied for preserves less than one acre in size, which is the case
for Chatham Woods with a .18 acre requirement. The developer is seeking an early work
authorization for the project which, if approved, then becomes effectively the preconstruction
meeting. Under the LDC, Section 3.05.07, H.1.f. iii. a., the applicant is required to have made
the monetary donation prior to the preconstruction meeting for final plat construction plans.
Therefore, the applicant is seeking approval of the donation of funds in advance of final plat
construction plans in order to be able to obtain the early work authorization.
FISCAL IMPACT: The donation is intended to provide funds for land acquisition and
management of lands for the Conservation Collier Program. Of the total received, 80%, or
$33,499.30 will be placed into Fund 172, the Land Acquisition Trust Fund, and $8,347.82 will
be placed into Fund 174, the Land Management Trust Fund, to be used for management of any
newly acquired property. Budgets amendments will be processing to reflect the contribution
receipt in Conservation Collier Funds (174) and (172).
LEGAL CONSIDERATIONS: This item is approved for legality and requires a majority vote
for Board approval. -JAB
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item.
