EXECUTIVE SUMMARY
Recommendation to approve the release of two code enforcement liens with an accrued value of
$368,123.01 for payment of$40,910.47 in the code enforcement actions entitled the Board of County
Commissioners v. NLJ Realestate Holding Inc., Code Enforcement Board Case Nos.
CEAU20130001915 and CEPM20130001358 relating to property located at 207 N 15th Street,
Collier County,Florida.
OBJECTIVE: That the Board of County Commissioners (Board) accepts an offer to release two code
enforcement liens with an accrued value of$368,123.01 for payment of$40,910.47 in relation to Code
Enforcement Board Case Nos. CEAU20130001915 and CEPM20130001358.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against NLJ
Realestate Holding Inc., in Case No. CEAU20130001915 for code violations at 207 N 15th Street,
consisting of a dilapidated wooden fence with missing sections. The lien was recorded in the Official
Records on March 21,2014, at O.R. Book 5018,Page 3870. The lien amount of$102,625.92 is based on
1,024 days of accrued fines ($100 per day from October 7, 2013 through July 26, 2016) $102,400 plus
operational costs in the amount of$225.92. The property was brought into compliance on July 26,2016.
The Code Enforcement Board ordered the imposition of a lien against NLJ Realestate Holding Inc., in
Case No. CEPM20130001358 for code violations at 207 N 15th Street, consisting of a structure in
dangerous condition. The lien was recorded in the Official Records on March 21, 2014, at O.R. Book
5018, Page 3861. The lien amount of$265,497.09 is based on 1,044 days of accrued fines ($250 per day
from September 17, 2013 through July 26, 2016), $261,000,plus demolition costs of$3,996,bee removal
costs of$275 and operational costs in the amount of$226.09. The property was brought into compliance
on July 26,2016.
The property was acquired by Collier Trust Management, via Tax Deed Sale recorded on August 31,
2016.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code
enforcement lien encumbers property that is under new ownership and compliance has been achieved
within thirty days. There are currently no known violations.
FISCAL IMPACT: Payment of $40,910.47 in settlement of fines has been made, representing
$36,187.46 in fines, demolition costs of$3,996, bee removal costs of$275 and operational costs in the
amount of $452.01. If approved by the Board, accrued fines in the amount of $327,212.54 would be
waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board's
policy contained in Resolution 2012-46. -KN
RECOMMENDATION: To waive the fines in the amount of$327,212.54, accept payment amount of
$40,910.47, release the lien, and authorize the Chairman to sign the attached release and satisfaction of
lien for recording in the Official Public Records.

ORDER
Based upon the foregoing Findings of Fact and Conclusions of Law, and pursuant to the
authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 2010-04, it is
hereby ORDERED:

A. Respondent is found guilty of violation of Collier County Ordinance 2004-58,Section 12.
B. Respondent must abate the violation by obtaining all required Collier County Building or
Demolition permits, inspections,and certificate of completion/occupancy to restore the structure
to a permitted condition consistent with the Collier County Property Maintenance code,or remove
the structure and all related debris on or before September 21,2013,or a fine of$250.00 per day
will be imposed for each day the violation remains thereafter.
C. Alternatively,Respondent must abate the violation by obtaining a Collier County Boarding =
Certificate and board the structure on or before September 16,2013. and obtain all required Collier 0
County Building or Demolition permits,inspections,and certificate of completion/occupancy 'i
