a portion of the 10-foot sidewalk easements and vacation of a portion of the 10-foot

Production Park, Phase 1 B, as recorded in Plat Book 15, Pages 7-8 of the public records
of Collier County, Florida, located in Section 36, Township 49 South, Range 25 East,
Collier County, Florida, being more specifically shown in Exhibit A, attached hereto; and
WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law; and
WHEREAS, the granting of the Petitioner's request will not affect the ownership
or right of convenient access of persons owning other parts of the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and public
interest in a portion of the 10-foot sidewalk easements and the private interests in a
portion of the 10-foot utility easements located along the border of Lots 16, 37 & 38, of
Collier County Production Park, Phase 1B, as recorded in Plat Book 15, Pages 7-8 of the
public records of Collier County, Florida, located in Section 36, Township 49 South,
Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A, are
hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be
in the public interest and for the public benefit.

(Wherever used herein the terms "Grantor" and "Grantee" include all the parties

Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable

perpetual, non-exclusive sidewalk easement for the purpose of construction and

TO HAVE AND TO HOLD the same unto the Grantee, together with the right to
enter upon said land and to place and/or excavate materials for the purpose of
constructing and maintaining a sidewalk thereon. This easement includes the right to
remove and use any and all excavated material. The parties record that Grantor has
received full compensation for all improvements located within the easement area. The
easement granted herein shall constitute easements running with the land and shall
burden the lands described above.

1. The exercise of such rights shall be subject to, and not inconsistent with,the use of the Easement Area
by the Grantor; 2. Each utility facility installed within the Easement Area shall, if applicable, comply
with the National Electric Safety Code, as adopted by the Public Service Commission; 3. In the event a
Grantee damages the facilities of Grantor or another Grantee, then such Grantee shall be solely
responsible for the resulting damages; and 4. In the event a Grantee exercises its right of entry onto the
Easement Area, such Grantee shall: i. Promptly repair any damage to the Easement Area; ii. Indemnify
and hold harmless Grantor from any resulting liens and/or encumbrances; and iii. Restore the surface of
the Easement Area to substantially the same condition as it existed immediately prior to the Grantee's
exercise of such rights.
