EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20150002689, to disclaim, renounce and vacate the County and the public interest
in a portion of the 10-foot sidewalk easements and vacate a portion of the 10-foot utility easements
located along the border of Lots 16, 37 & 38, of Collier County Production Park, Phase 1B, as
recorded in Plat Book 15, Pages 7-8 of the public records of Collier County, Florida, for property
located on the northeast corner of the intersection of Exchange Avenue and Production Boulevard,
approximately 200 feet west of Livingston Road, in Section 36, Township 49 South, Range 25 East,
Collier County, Florida; and to accept Petitioner's grant of 10-foot sidewalk easements to replace
the vacated sidewalk easements.
OBJECTIVE: To adopt a Resolution to vacate the County's and the public's interest in a portion of the
10-foot sidewalk easements and vacate a portion of the 10-foot utility easements located along the border
of Lots 16, 37 &38, of Collier County Production Park, Phase 1B,as recorded in Plat Book 15,Pages 7-8
of the public records of Collier County, Florida, for property located on the northeast corner of the
intersection of Exchange Avenue and Production Boulevard, approximately 200 feet west of Livingston
Road, in Section 36,Township 49 South, Range 25 East,Collier County, Florida,being more specifically
shown in Exhibit A; and to accept Petitioner's grant of 10-foot sidewalk easements to replace the vacated
sidewalk easements.
CONSIDERATIONS: Petition VAC-PL20150002689 has been received by the Development Review
Division, from Andrew Rath, P.E., of Davidson Engineering, Inc., as agent for the Petitioners, Radio
Road Joint Venture and Radio Road, LLC, to vacate a portion of the 10-foot sidewalk easements and 10-
foot utility easements located along the border of Lots 16, 37 & 38, of Collier County Production Park,
Phase 1B, as recorded in Plat Book 15,Pages 7-8 of the public records of Collier County, Florida, located
in Section 36,Township 49 South,Range 25 East, Collier County, Florida.
The owner proposes to vacate the existing 10-foot sidewalk easements and 10-foot utility easements that
are located on the inside border of Lots 16, 37 & 38 along the previously vacated rights-of-way of
Exchange Avenue and Production Boulevard (see O.R. Book 4826, Page 261 of the public records of
Collier County, Florida), and proposes to provide a 10-foot replacement sidewalk easement and 10-foot
utility easement along the southern borders of Lots 16&38 and the western border of Lot 37 as shown on
the attached Easement Vacation Exhibit. According to the Property Appraiser's website, Radio Road,
LLC, is owner of Lot 16, and Radio Road Joint Venture is owner of Lots 37 and 38.
The sidewalk easements were dedicated to the County on the plat. There is no public detriment to the
vacation because the roads originally depicted on the plat were vacated and never constructed, therefore,
sidewalks are not necessary in those locations. However,the applicant is providing replacement sidewalk
easements over the portion of their property along existing roadways, which will be recorded following
approval of this item.
The utility easements were dedicated to Florida Power & Light, United Telephone Company and any
Cable Television Franchise Company on the plat. There is no public detriment to the vacation because the
County has no interest in the utility easements, and the relevant utility companies have provided letters of
no objection to the vacation. According to the applicant, none of these companies have facilities within
the existing easements. Moreover,the applicant will provide replacement utility easements,which will be
recorded following approval of this item.

FISCAL IMPACT: Staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which
covers the County's cost of recording and processing the Petition.
LEGAL CONSIDERATIONS: Pursuant to Resolution 2013-166 and Florida Statutes Section 177.101,
the Board of County Commissioners (Board) may adopt resolutions vacating plat's in whole or in part of
subdivisions in Collier County, returning the property covered by such plat's either in whole or in part
into acreage,when the following criteria are met:
1. The request is in the interest of the general public welfare,or no public detriment is established.
2. The request does not invade or violate individual property rights.
3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be
vacated.
4. The vacation will not affect the ownership or right of convenient access of persons owning other
parts of the subdivision.
Approval of this item will act to vacate and terminate all County and public interest in the subject
sidewalk easements. However, there is no public interest in the subject utility easements because the
utility easements were dedicated only to private entities. Therefore, the vacation of the utility easements
will only act to remove the physical depiction of the utility easements on the Collier County Production
Park Phase 1B plat, and any additional private rights created or affected by third parties over these utility
easement areas must be separately terminated.
This item has been approved as to form and legality, and requires a majority vote for Board approval ---

GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this Executive Summary.
RECOMMENDATION: To approve the attached Resolution, relating to Petition VAC-PL20150002689,
which will vacate the County's and the public's interest in a portion of the 10-foot sidewalk easements and
vacate a portion of the 10-foot utility easements located along the border of Lots 16, 37 & 38, of Collier
County Production Park,Phase 1B,as recorded in Plat Book 15,Pages 7-8 of the public records of Collier
County,Florida, for property located on the northeast corner of the intersection of Exchange Avenue and
Production Boulevard, approximately 200 feet west of Livingston Road, in Section 36, Township 49
South, Range 25 East, Collier County, Florida,being more specifically shown in Exhibit A; to accept the
Petitioner's grant of 10-foot sidewalk easements to replace the vacated sidewalk easements; and to direct
the Clerk to the Board to record a certified copy of the Resolution in the public records and to make
proper notation of this Resolution on the plat of Collier County Production Park,Phase 1B, as recorded in
Plat Book 15,Pages 7-8, of the public records of Collier County,Florida.

Collier County, Florida,being more specifically shown in Exhibit A, attached hereto; and

WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law; and
WHEREAS, the granting of the Petitioner's request will not affect the ownership
or right of convenient access of persons owning other parts of the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA,that the County and public
interest in a portion of the 10-foot sidewalk easements and the private interests in a
portion of the 10-foot utility easements located along the border of Lots 16, 37 & 38, of
Collier County Production Park, Phase 1B, as recorded in Plat Book 15, Pages 7-8 of the

hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be

1. The exercise of such rights shall be subject to,and not inconsistent with,the use of the Easement Area as
by the Grantor; 2. Each utility facility installed within the Easement Area shall, if applicable, comply ¢
with the National Electric Safety Code, as adopted by the Public Service Commission; 3. In the event a
Grantee damages the facilities of Grantor or another Grantee, then such Grantee shall be solely
responsible for the resulting damages; and 4. In the event a Grantee exercises its right of entry onto the
i' Easement Area, such Grantee shall: i. Promptly repair any damage to the Easement Area; ii. Indemnify
and hold harmless Grantor from any resulting liens and/or encumbrances; and iii. Restore the surface of
the Easement Area to substantially the same condition as it existed immediately prior to the Grantee's

Road Joint Venture, a Florida general partnership,whose mailing address is Attn: Andrew Saluan,
2950 Immokalee Road—Suite 2,Naples, FL 34110, (hereinafter referred to as "Grantor"), in favor of all
public and private franchised utilities(hereinafter referred to as"Grantee"). `.

their respective heirs, legal representatives, successors and assigns. Grantor and Grantee are used for
singular or plural,as the context requires.)

WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00)and other valuable consideration
paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged, hereby conveys,
grants, bargains and sells unto the Grantee a perpetual, non-exclusive utility easement for the purpose of
constructing, installing,maintaining, and operating utility facilities, including cable television,electrical,
telephone, gas, potable and wastewater, under the real property more particularly described in attached
Exhibit"A,"which is incorporated herein by reference(the"Easement Area").
Subject to easements,restrictions,and reservations of record.
TO HAVE AND TO HOLD the same unto the Grantee,together with the right to enter upon said L
Easement Area and to place and/or excavate materials for the purpose of installing utility facilities
thereon. The easement granted herein shall constitute an easement running with the land; provided 5
however, by acceptance of this grant of easement and its recording in the public records of Collier .s.;
County, Florida, or by exercising any of the rights conferred by this Easement, each Grantee agrees that:
1. The exercise of such rights shall be subject to, and not inconsistent with,the use of the Easement Area
by the Grantor; 2. Each utility facility installed within the Easement Area shall, if applicable, comply w
with the National Electric Safety Code, as adopted by the Public Service Commission; 3. In the event a
Grantee damages the facilities of Grantor or another Grantee, then such Grantee shall be solely
responsible for the resulting damages; and 4. In the event a Grantee exercises its right of entry onto the
Easement Area, such Grantee shall: i. Promptly repair any damage to the Easement Area; ii. Indemnify
and hold harmless Grantor from any resulting liens and/or encumbrances; and iii. Restore the surface of
the Easement Area to substantially the same condition as it existed immediately prior to the Grantee's
exercise of such rights.

Our client, Radio Road Joint Venture, is requesting an easement vacation through Collier County to vacate portions of an exisl
10' sidewalk and public utility easement shown below. The portions to be vacated are within client-owned Lots 16, 37, and 3!
Collier County Production Park Phase 1-B. These easements were originally recorded with the Collier County Production P
Phase 1-B plat and shadowed rights-of-way for Exchange Avenue and Production Boulevard. However, the two roach
extensions were never developed and the rights-of-way have since been vacated (OR 4826, Page 261-267); thus, the sideN
and utility easements are no longer appropriate. Instead, a new 10' sidewalk and public utility easement is proposed in orde
connect the existing portions of roadside easement which still exist on adjacent Lots.
In summary, we are proposing to eliminate any unnecessary easements and close the loop on the existing cap easements.
doing so,we are requesting a letter of no objection from you for this proposed easement vacation.
