Agenda 11/15/2016 Item #16E 7 16.E.7 11/15/2016 EXECUTIVE SUMMARY Recommendation to authorize the County Attorney to advertise an ordinance repealing and replacing the Public Safety Authority Ordinance No. 2012-23, as amended, for the purpose of reestablishing the Public Safety Authority as the Emergency Medical Authority and bring back such ordinance for future Board consideration. OBJECTIVE: To repeal and replace Ordinance No. 2012-23, as amended, and reestablish the Public Safety Authority("PSA") as the Emergency Medical Authority("EMA")to broaden its purposes,powers and duties. CONSIDERATIONS: On June 26, 2012, the Board of County Commissioners adopted Ordinance No. 2012-23 establishing the Collier County Public Safety Authority, which was subsequently amended on September 23, 2014 to focus on issues pertaining to prehospital emergency medical treatment and transport system(s)in Collier County. The members of the Public Safety Authority recommend that the Board rename the advisory board to the Emergency Medical Authority to more accurately reflect its current purposes and duties. In order for the Advisory Board to assist the Board of County Commissioners with issues associated with pre-hospital emergency medical services, they must be able to request, review and analyze information from other government and private entities providing pre-hospital emergency medical services to properly evaluate current and future needs. Notable changes to the ordinance include authorizing the Emergency Medical Authority to review requests for Certificates of Public Convenience and Necessity("COPCN"). Additional changes are listed below(words underlined are added;ctrikethroughs are deleted): 1. To assist the Board of County Commissioners, municipalities, fire departments, fire commission boards, and law enforcement agencies, including the Collier County Sheriffs Office and hospitals,with issues affecting pre-hospital emergency medical services within all of Collier County. 2. To hear analyze issues associated with pre-hospital emergency medical services when requested by a participating agency and make written recommendations to the Board of County Commissioners and involved agencies. 3. To work to improve and enhance pre-hospital emergency medical care within Collier County,including Advanced Life Support(ALS),Basic Life Support(BLS), first responder programs and other future EMS delivery programs, with thorough study, education, and system-wide participation by the response agencies and the local medical community as noted above. 4. To make its special knowledge and expertise available to any and all agencies upon request of the governmental board or agency when so charged during regular board meetings. evaluate current and future Collier County EMS needs, as required, monitor ALS and BLS response times in meeting Collier County goals and evaluate system performance measures. 5. To serve as a catalyst to effect cooperative arrangements for improving and best utilizing the improvement and better effective utilization of emergency medical resources in Collier County;, Study and focus on utilizing the resources of all municipal, dependent and independent fire organizations, 911 call centers, law enforcement agencies and the public. To make recommendations, as warranted, regarding first responder programs, pre- hospital emergency training programs, communication systems, and other appropriate facilities and services that positively impact on the delivery of emergency medical services. 7. The Authority may convene technical working groups from the community periodically to address the following: a. Community education and awareness. b. Emergency medical dispatch. c. Trauma triage and care. d. Pre hospital emergency medical training. c. Clinical coordination and quality outcomes. f. Field coordination and operational concerns. 9. The Authority will develop general guidelines and scope(s) of study for the technical working groups identified above. Membership of the technical working groups noted above may not exceed 50% participation by a member(s) of the Authority and membership on a technical working committee shall be formally recognized by the Authority before receiving a request for work or input. Such guidance shall not be in conflict with the Health Insurance Portability and Accountability Act or other laws of the State of Florida, local or state regulations, and local ordinances. There is hereby created the Collier County Emergency Medical Authority(hereinafter the "Authority"). The Authority shall meet quarterly and at other times as necessary. 2. Special Meetings. Special Meetings of the Authority may be called by the Chair, or the Chairperson of the Medical Directors Subcommittee in cases of emergent protocol or pharmacological issues, at the request of a majority of the appointed members. I c rn L SECTION FOUR: Removal from office; failure to attend meetings. Removal from office and attendance requirements shall be governed by Ordinance No. 01- 55,as amended,or by its successor ordinance. :c SECTION FIVE: Officers; quorum; rules of procedure. w At its earliest opportunity, the membership of the Authority shall elect a chairman and vice chairman from among the members. Officers shall serve for a one year term with eligibility for reelection. At the end of each term, the Chair shall prepare and submit to the Board and the Q.. County Manager an annual report describing the activities of the Authority. Q The presence of a majority of the members shall constitute a quorum of the Authority necessary to take action and transact business. The Emergency Medical Authority shall, by majority vote of the entire membership, adopt by-laws for doing its work and conducting its business as provided by county ordinances. Ta The by-laws shall include,but not be limited to,its general procedure, funding,and expenditures. The Authority shall operate in the Sunshine, and shall keep a written record of meetings, resolutions, findings, and determinations. W a) V c ea SECTION SIX: Repeal of Ordinance No. 2012-23, as amended. L Ordinance No. 2012-23, as amended by Ordinance No. 2014-37, is hereby repealed in its a) entirety. 2 L a. SECTION SEVEN: Conflict and Severability. E In the event this Ordinance conflicts with any other ordinance of Collier County or other f applicable law,the more restrictive shall apply. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION NINE: EFFECTIVE DATE. This Ordinance shall be effective upon filing with the Department of State.
