EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve the
excavation of 25,000 cubic yards and off-site removal of up to 40,000 cubic yards of fill material
from Lely Resort Tract 54 Commercial Excavation Permit Application PL20160001004.
OBJECTIVE: To approve the excavation of 25,000 cubic yards and off-site removal of up to 40,000
cubic yards(cy) of fill material from Lely Resort to Quail West Golf and Country Club.
CONSIDERATIONS: The applicant would like to excavate 25,000 cubic yards and haul off-site up to
40,000 cubic yards of excavated fill material prior to development of the proposed multi-family
development under Project PL20160000244. According to the applicant, off-site removal of the 40,000
cubic yards material will also be necessary. The subject site is within the Lely, A Resort Community
PUD, Ordinance No. 92-15, as amended. According to Section 2.12 of the PUD, Lake Siting, "Fill
material from lakes is planned to be utilized off-site, subject to the provisions of the Excavation
Ordinance in effect at the time permits are sought." The current request includes excavating and
removing 25,000 cy of material as well as removing an additional 15,000 cy of stockpiled material.
Under the Excavation Ordinance, Chapter 22, Article IV, Section 22-110 (a)(2) of the Code of Laws and
Ordinances, "Commercial excavations are considered to be any excavation wherein the excavated
material is removed from the subject property...All approved developments with off-site hauling
activities will be considered commercial excavations." Commercial Excavation Permits require approval
by the Board of County Commissioners(Board).
There are approximately 26 separate development excavation permits, many with modifications, for
projects within the 2,892.5 acres of Lely Resort and many of them are for multiple lakes. Several million
cubic yards of fill have been excavated within the PUD and spread for roads and building pads. These
completed excavations are in substantial conformance with the approved Lely Resort PUD Master Plan.
The Board has previously approved three (3)separate commercial excavation permits to allow the off-site
removal of approximately 75,000, 100,000 and 700,000 cubic yards, respectively, of stockpiled fill. Lely
Resort is running out of places to stockpile fill in the middle of residential neighborhoods.
The petitioner anticipates that it will take 2 months at 60 trucks per day to complete the removal of excess
fill from the subject site. The haul route from the Lely Resort PUD to Quail West Golf and Country Club
PUD is approximately 18 miles as depicted on the attached map.
The completed excavations are in substantial conformance with the approved Lely Resort PUD Master
Plan.The attached construction plans are provided for reference.
FISCAL IMPACT: The petitioner has paid $4,930.77 in fees to the Growth Management Department.
The petitioner has also paid the road impact fee of$8.00 per 1,000 cubic yards for the proposed removal
of 40,000 cubic yards of material($320.00).
GROWTH MANAGEMENT PLAN (GMP) IMPACT: There is no growth management impact
associated with this Executive Summary. The proposed haul route will be from Lely Resort, along
Rattlesnake Hammock Road, to Collier Blvd., then north on I-75 approximately 18 miles to the Quail
West development.
ENVIRONMENTAL ISSUES: Off-site hauling of excess fill, if done properly, will have no

Environmental impact.
LEGAL CONSIDERATIONS: Petitioner is requesting a Commercial Excavation Permit under
Section 22-110 of the Collier County Code of Laws and Ordinances. All testimony given must be
under oath. The Petitioner has the burden to prove that the proposed Commercial Excavation is
consistent with all the criteria set forth below, and you may question Petitioner, or staff, to satisfy
yourself that the necessary criteria have been satisfied under Section 22-110(d) of the Collier County
Code of Laws and Ordinances. Should you consider denying the Commercial Excavation Permit, to
assure that your decision is not later found to be arbitrary, discriminatory or unreasonable; the denial
must be based upon competent, substantial evidence that the proposal does not meet one or more of
the listed criteria below.
Criteria for Commercial Excavations
(1) The excavation will not interfere with the natural function of any sanitary, storm or
drainage system, or natural flow way, whether public or private, so as to create flooding or public
health hazards or jeopardize the functions of the natural resources and environment of Collier County.
(2) Dust or noise generated by the excavation will not cause a violation of any applicable
provisions of this article. Rock crushing operations or material stockpiles that will be adjacent to any
existing residential area may require separate county approval.
(3) The excavation will not adversely affect groundwater levels, water quality,hydroperiod
or surface water flow ways. The county manager or his designee may require the applicant to monitor
the quality of the water in the excavation and adjacent ground and surface waters. Under no
circumstances shall the excavation be conducted in such a manner as to violate Collier County or
applicable State of Florida water quality standards.
(4) The excavation will be constructed so as to not cause an apparent safety hazard to
persons or property.
(5) The excavation does not conflict with the growth management plan or land
development regulations adopted pursuant thereto, nor does it conflict with existing zoning
regulations. Special criteria and approval procedures may be necessary for projects within the Big
Cypress Area of critical state concern.
(6) In cases where a wetland is no longer capable of performing environmental functions or
providing environmental values or in cases where it is determined that no reasonable alternative exists
other than disrupting a wetland, certain alterations may be allowed, except as otherwise authorized
through previous county review processes.
(7) Flow of water within and through preserved wetlands shall not be impeded.
(8) Appropriate sediment control devices (hay bales, silt screens, etc.) shall be employed to
prevent sedimentation within the wetland pursuant to the design requirements of Section 10.02.02 of
the Land Development Code. Any building site adjacent to a wetland and elevated by filling must
employ the same erosion control devices. Fill must be stabilized using sod, seed,or mulch.
This item is approved as to form and legality,and it requires a majority vote for Board approval.-SAS

1.0 GENERAL PROJECT INFORMATION
1.1 LOCATION, EXISTING CONDITIONS AND ZONING/PROPERTY SUMMARY
Tract 54 is part of Lakoya. Lakoya was originally permitted as Cobblestone Cove at Lely Resort
under AR-12021. The project was originally permitted by Waldrop Engineering, P.A. A commercial
excavation permit was obtained for Lakoya (#60.024) that allowed for the removal of excess fill
associated with the excavation of the development lakes within Lakoya. The permit was certified
and closed in 2014. As part of the Lakoya PPL Permit (AR-12021) Tract 54 was cleared and filled
in anticipation of development. The site was flat filled after approval of the PPL to an average
approximate elevation of 8.20 FT-NAVD.
Excavation and removal of a portion of the flat fill and the stock piles on-site is required for the
development of the proposed multi-family development being permitted under PL20160000244.
2.0 TRIP CALCULATIONS

3.0 SIGNIFICANCE ON IMPACTED LINKS
3.1 AFFECTED LINKS
The haul route includes Rattlesnake Hammock Road from Grand Lely Drive to Collier Boulevard,
Collier Boulevard from Rattlesnake Hammock Road to the I-75 interchange, and I-75 into Lee
County. The fill will be transported to Quail West Golf and Country Club.
The estimated 2 months of hauling will contribute approximately 60 trips per day, with a peak-hour
number of trips of no more than 6 in any one direction.

3.2 TEMPORARY IMPACT TO AFFECTED LINKS
Information provided in Attachment “F” of the Collier County 2015 Annual Update and Inventory
Report was used to analyze the impact of the additional loading on the affected links.
Peak-Hour Peak-Direction Volume per 2015 AUIR:
Rattlesnake Hammock Road, from Santa Barbara Boulevard to Collier Boulevard: 500
Collier Boulevard, from Rattlesnake Hammock Road to Davis Boulevard: 1,600
Collier Boulevard, from Davis to I-75: 2,480
The estimated additional 6 peak-hour peak-direction trips attributed to the hauling operation will
contribute less than 1% of the total peak-hour peak-direction volume for each affected link. The
proposed excavation removal will not have a significant or negative impact on the surrounding road
network. Rattlesnake Hammock Road, from the proposed project to Collier Boulevard, and Collier
Boulevard are six lane arterial roadways and are designed for high capacity of vehicles per hour.
4.0 EXISTING ROAD CONDITIONS
4.1 OVERVIEW
An examination of the Collier County portion of the haul route was performed on June 6th, 2016.
The general condition of the roadways is good. There are no significant defects in asphalt, curbs,
striping, or drainage structures to report. The roadway system was observed to have normal wear
and tear including chipped curb, weathered thermos-plastic striping and minor asphalt defects.
The Developer would like to conduct a pre-haul review of existing roadway infrastructure with Road
Maintenance to determine the baseline conditions prior to the hauling of excavated material. This
review will establish any areas of concern. Criteria to be considered includes:
1. Current pavement rating;
2. Field review/survey;
3. Current scheduled repairs;
4. Repairs to reduce the likelihood of accelerated damage under the proposed haul trips.
