EXECUTIVE SUMMARY
THE THIRD OF THREE FALL WORKSHOPS TO INCLUDE A
DEMONSTRATION OF THE WIRELESS INSPECTIONS PROGRAM;
DISCUSSION OF THE LAND DEVELOPMENT CODE SPECIFICALLY TIlE
PUD SUNSETTING PROVISIONS AND A STATUS OF PUDS WHICH HAVE
SUNSETTED; AN OVERVIEW OF THE SECTIONS OF THE LAND
DEVELOPMENT CODE DISCUSSED IN THE 5 PREVIOUS WORKSHOPS;
DISCUSSION ON ABANDONED BUILDINGS; UPDATE REGARDING THE
GOLDEN GATE AREA MASTER PLAN COMMITTEE.
OBJECTIVE: To respond to the Board's direction with respect to conduct a
comprehensive review and re-write of the County's Land Development Code.
Specifically to present to the Board an overview and demonstration of the Wireless
Inspections program; the PUD sunsetting provisions related to the PUDs which have
currently "sunsetted"; an overview of the sections of the Land Development Code
discussed in the 5 previous workshops; discussion on abandoned buildings; and an update
regarding the Golden Gate Area Master Plan Committee.
CONSIDERATIONS:
Wireless Program: Staff will present an overview and demonstration of the wireless
inspections program currently operational in the Building Review and Permitting
Section 2.7. and 2.2.20., Planned Unit Developments: Stuff will present an overview of
the most recent amendments to the current regulations and a status report on the PUDs
which have "sunsetted."
Workshop Update: Staffwill present a summary of the sections of the Code, which have
been discussed in the previous 5 workshops and will present a summary of the sections of
the Land Development Code which have yet to be discussed. The staff seeks Board
direction in terms of which remaining sections of the Land Development Code they may
or may not wish to discuss in future workshops.
Discussion on Abandoned Buildings: Per Board direction, Code Enforcement staff will
initiate a discussion on the subject of abandoned buildings and discuss the possibility of
future Land Development Code amendments related to abandoned buildings.
Golden Gate Area Master Plan Committee: Comprehensive Planning Staff will give an
overview of the roles and responsibilities of the Golden Gate Area Master Plan
Committee and what they have accomplished to date.
GROWTH MANAGEMENT PLAN: This proposal has no immediate impact on the
Growth Management Plan. Staff will ensure that future amendments to the LDC are
consistent with the Growth Management Plan and any future changes thereto.
FISCAL IMPACT: The estimated cost to conduct a comprehensive re-write of the
Land Development Code is the equivalent of 2.5 FTE's for a period of 2 years, al

of approximately $260,733. This excludes time and cost associated with amending the
Land Development Code as a result of the adoption of the Rural Fringe and Rural Land
amendments to the Growth Management Plan, or any amendments associated with the
Community Character Plan or any other zoning overlay amendments. It is anticipated that
funding for this project will come from Community Development fund (113).
RECOMMENDATION: That the Board of County Commissioners consider the
information presented by staff and give direction to staff to take action in the form of
amendments to the Land Development Code and/or Growth Management Plan which
best serve the interests of the public.

SUMMARY OF THE LAND DEVELOPMENT CODE ISSUES DISCUSSED IN
PREVIOUS WORKSHOPS
APRIL 24~ 2002 WORKSHOP
I. The workshop dated April 24, 2002, focused on prioritizing sections of the Land
Development Code in need of updating. Items were prioritized as follows:

The agenda for the next meeting was set to address the following items: PUD
amendments, the PUD process and affordable housing.
MAY 3~ 2002 WORKSHOP
II.
The May 3, 2002 LDC Workshop focused on changes to the LDC pursuant to
section 2.7.3.4 regarding PUD time limits (sun setting). The discussion included
an overview of the 8 PUDs to be sunsetted. Following the presentation, the BCC
directed staff to develop 3-year sunset criteria with extension provisions. Staff
was also directed to research an option that would allow applicants to amend the
PUD document. Kay Deselem, Principal Planner, Current Planning Section,
provided a brief overview of the proposed changes to the LDC that would require
more specific details in PUD applications. Commissioner Fiala noted that
developers wanted a firm set of standard rules. Consensus was that staff was on
the right track and they should work out the details.
CURRENT STATUS: The details are currently being finalized. Staff
will review the current status of the PUD sunsetting initiative at this workshop.
Cormac Giblin presented an overview on affordable housing. Tom Oliff, County
Manager, summed up the Commissioners direction as follows: 1) More
information on actual "need" must be addressed. 2) Adjustments to percentages
are needed. 3) Look outside the urban boundary for housing opportunities. 4)
Increase SHIP Program maximum purchase prices.
CURRENT STATUS: There has been significant movement with this
initiative by the Workforee Housing Committee and a BCC Workshop is
scheduled for January 22, 2003 to discuss the Inclusionary Zoning amendment to
the LDC currently being finalized by the committee. AC.,~nI~A

I. The meeting opened with a presentation from Mike Bosi on the variance process
and the conditional use process.

Susan Murray, Current Planning Manager, and Patrick White, Assistant County
Attorney presented an overview of the Hearing Examiner concept. Susan Murray
explained the various petitions that the examiner would be involved in during the
final decision making process. Staff reaffirmed that the HEX would initially
make the final decision with respect to the variance process, most of the lesser
land use petitions, and several administrative matters. In matters involving
conditional uses, non-conforming uses and rezonings, the hearing examiner's role
would be one of a recommending body in lieu of the Planning Commission, with
the BCC having the final decision. The role of the CCPC and the EAC will
expand to a role ofproactively reviewing and advising the BCC on legislative and
policy matters related to natural resource protection policies and growth
management goals, policies, and objectives, and land development regulations.
CURRENT STATUS: The Board will be reviewing the role of the HEX
and the selection of the final candidates at the December 3, 2000 BCC.

Cormac Giblin, Low-Income Housing Manager, presented four recommendations
from the Workforce Housing Advisory Committee. Those items are as followed:
· Amend the LDC to allow a fast track provision for affordable housing
· Allow the rental of guesthouses and accessory units within the urban area
· Amend the LDC to encourage mixed use zoning incentives for affordable
housing.
· Reevaluate the qualifying criteria for all allowable density bonuses.
CURRENT STATUS: There has been significant movement with this
initiative by the Workforce Housing Committee and a Bce Workshop is
scheduled for January 22, 2003 to discuss the Inclusionary Zoning amendment to
the LDC currently being finalized by the committee.
Mr. Mudd summarized the board's direction to staff: 1.) Schedule another
workshop in the fall with recommendations and specifics on tightening up the
conditional use process, 2) develop recommendations on how to ensure that a
granting of a conditional use will not result in a rezoning if the hearing examiner
handles conditional use petitions, 3.) Specify the role of the hearing examiner, 4)
schedule the July 15th workshop, 5) eliminate the "catch 22" phrases in the code,
and 6.) Determine the affordable housing needs within the County.
SEPTEMBER 27~ 2002 WORKSHOP
Checkbook Concurrency was the topic of this workshop including the proposed
changes to the Capital Improvement Element and the Transportation Element that
were recently transmitted to DCA. These two elements were being modified and
updated based on the Objections, Recommendations and Comments (12
report. The proposed changes require the County to base the transporta on
determination on a checkbook "real time" system instead of on an anm al

"Concurrency" determination. The Land Development Code will require
amending within one year of adoption of a checkbook concurrency system. The
key element of a real time system is a more stringent, under construction,
schedule rather than a schedule that relies on the first three years of the
construction and the Capital Improvement Element (Current AUIR vs. Checkbook
Concurrency)
Due to the comments raised in the ORC Report, the BCC favored the Current
AUIR system over the Checkbook Concurrency system to allow the staff the time
to compile all the necessary supporting traffic counts and analysis for the actual
checkbook concurrency system. The direction given to staffby the BCC was to go
forward with amendments to the Capital Improvement Element and the
Transportation Element of the GMP and prepare the necessary LDC amendments
for implementation of this system. Staff was also directed to collect additional
data and research the checkbook concurrency system. Changes to the LDC and
Growth Management Plan were sent to DCA on June 25th 2002.
CURRENT STATUS: Since this workshop the Board adopted the
changes to the Transportation Elements of the Growth Management Plan and the
Board is scheduled to review the "interim" amendments to Section 3.15,
Adequate Public Facilities, of the Collier County Land Development Code during
the Fall Cycle 2002 LDC Amendment Cycle on December 11, 2002 and January
8, 2003.
OCTOBER 4~ 2002 WORKSHOP
I. An informative workshop on Architectural Standards, held on October 4th and
continued on October 15th, was presented and prepared by: Irene Szmorlinski,
Urban Design Planner, Carolina Valera, Urban Design Planner, and Aaron Blair,
Urban Design Planner. A synopsis of the Architectural Standards was presented to
the BCC including the Activity Center #9 Overlay District and the different
Overlay Districts for Immokalee. The Board to staff gave no specific direction
since the Architectural Standards were in the process of being revised with the
help of the Architectural Review Committee that was formed to assist County
Staff in this process.

Barbara Cacchione presented a schedule of LDC amendments and GMP
amendments for the Community Character process. The Board agreed to include
both the GMP and LDC amendments together in one cycle.
Don Schneider, Principal Planner, provided an overview of the Public
Participation Ordinance. Commissioners agreed to change the Public Meeting
timing requirement to require the public informational meeting to be held after
staff releases the first round of comments.
CURRENT STATUS: The amendment to the LDC to modify the requirements
of the Public Information Meeting is incorporated into the.ongoing Fall LDC
Amendment Cycle.
CURRENT STATUS: The following LDC sections are to be amended in
response to the October 4, 2002 BCC Workshop regarding landscape regulations:

A junkyard on Radio Road with "no principal structure" must be
discontinued within one year. Ms. Murray indicated that she
would look into this issue.

Height Limitations - Staff was directed to investigate maximum
heights for architectural embellishments and other items that are
currently excluded from height limitations. It was suggested by
Commissioner Coletta that special consideration be given to rural
areas, especially Immokalee, so as to not bind them to coastal
standards.

habitable areas as they relate to setbacks established to the lowest

requirement be added to address unenclosed balconies abutting
each other. Ms. Murray stated she would look into the issue and
fix any conflicts in the code.
· Fences - Staff was to ensure that bushes were required to hide
chain-link fences.

fences that impede the natural habitat of animals. It was
suggested that staff develop restrictions on fence distance.
