LDR Subcommittee Minutes 09/12/2016 September 12, 2016 MINUTES OF THE COLLIER COUNTY DEVELOPMENT SERVICES ADVISORY COMMITTEE LAND DEVELOPMENT REVIEW SUBCOMMITTEE Naples, Florida, September 12, 2016 LET IT BE REMEMBERED, the Collier County Development Services Advisory Committee — Land Development Review Subcommittee in and for the County of Collier, having conducted business herein, met on this date at 9:00AM in a REGULAR SESSION at the Growth Management Department Building, Room 609/610 2800 N. Call to order The meeting was called to order at 9:00am and it was noted the Subcommittee has been expanded from its composition of Mr. Foley, Mr. Brooker and Mr. Mulhere to 7 Development Services Advisory Committee Members for this item only. (Mr. Chrzanowski, Mr. Disney, Mr. Mitchell and Mr. Dunnavant are the additional members). 2. Election of Chairperson Mr. Mulhere moved to appoint Blair Foley Chairman of the Committee. Second by Mr. Chrzanowski. Carried unanimously 7— 0. 3. Approve agenda Mr. Mulhere moved to approve the Agenda. Second by Mr. Disney. Carried unanimously 7—0. 4. Old Business a. Approve minutes — (minutes from previous DSAC-LDR Subcommittee meetings) i. February 29, 2016 Mr. Mulhere moved to approve the minutes of the February 29, 2016 meeting. Second by Mr. Brooker. Motion passed with Mr. Brooker, Mr. Mulhere and Mr. Foley voting "yes." ii. April 13, 2016 Mr. Mulhere moved to approve the minutes of the April 13, 2016 meeting. Second by Mr. Brooker. Motion passed with Mr. Brooker, Mr. Mulhere voting "yes."Mr. Foley abstained. 5. New Business a. Staff presentation Staff presented the PowerPoint"Lot Coverage Amendment Research" for information purposes. The following was noted during the presentation: i. Review of Current Standards • The current standards apply to single-family units and two-family units and duplexes, except in areas with a South Florida Water Management District permit. • LDC Section 6.05.01 identifies maximum lot coverage and maximum impervious area based on the lot size. • Maximum coverage may be exceeded if retention for runoff from 5-year 1-day storm is provided for the area in excess of the standards. • A DSAC Subcommittee previously reviewed the standards and found that they are disproportionately limiting on Estates lots and suggested increasing the lot coverage and impervious area percentages. ii. Evaluation of 1-Year of Lot Coverage Reviews Staff analyzed the lot coverage review process and conducted a review of permits issued over the course of one year(June 2015-June 2016) and found: 2 September 12, 2016 • The requirement for stormwater plan is not necessarily based on actual stormwater impacts. • There is no requirement to physically connect roof runoff to the retention area. • Permits are not required for some impervious surfaces (e.g. concrete pads) and therefore not reviewed, but still may have stormwater impacts. • Lots are allowed additional 3% coverage for first time additions, but it is not applied to future additions. • Additions under 400 sq. ft. are not reviewed, even if we know lot coverage is exceeded. • Understanding how the requirements might apply to a single project with multiple permits can be difficult for property owners. • The current process involves little communication with property owners regarding lot coverage requirements or the status of their property. • The location of lot coverage reviews over the 1-year period have been mapped and these maps were shared with the Subcommittee. • Statistics related to the location and percentage of lot coverage reviews were presented by staff iii. Stormwater/Lot Coverage in Other Communities Staff conducted a review of the standards in other communities and found: • Lot coverage, impervious area, or other standards in 15 comparable communities in Florida: 0 Lot Coverage= 13 communities 0 Impervious Area= 6 communities 0 Floor Area Ratio = 6 communities 0 Open Space = 5 communities 0 Stormwater/Drainage Plan= 8 communities • All other communities reviewed create different lot coverage/impervious area standards for each zoning district. • Stormwater/drainage plans are typically required on all lots regardless of lot coverage or impervious area. • When the communities that were reviewed include lot coverage or impervious area standards, no exemptions are provided. The following was noted during Committee discussions: • Preparers varied depending on the requirements of each community(such as engineers, landscape architects, etc.). • Staff may want to review any standards required by the City of Marco Island. • The reason for the standards include: 1. Ensuring there are no negative impacts on adjacent property owners when development occurs. 2. Ensuring there are no overall impacts on the stormwater drainage systems in the area. 3. Ensuring there are no negative environmental impacts. iv. Potential Alternatives 3 September 12, 2016 Staff identified the following ideas to be considered to address the issue. 1. Make no changes to the program. 2. Modify the current program based on analysis. 3. Comprehensive changes to the program modeled on findings from other communities. Committee discussion • A fourth option could be to eliminate the requirements. • It may be advantageous to develop sets of standards based on the different characteristics of the individual zoning districts given the potential impacts are different based on the location of properties (urban area lot sizes vs. Estates area, canal discharge, tidal influence discharges, etc.). • The review of the current standards was driven by inequities in the requirements between different areas of the county. • The current standards were developed in the mid 2000's in response to high impervious coverage on residential lots. This change occurred prior to the recession so not many reviews occurred after the standards were developed. This meant that the impact of the change was unknown until more recently when the economy turned around and the construction of homes increased in the County. • Any regulations should be based on the best available science and consideration should be given to instituting comprehensive changes. • Committee members requested staff to provide a draft LDC amendment. Staff reported they have developed the following preliminary recommendations: • A comprehensive overhaul of program can address numerous problems with the program. • The City of Naples' stormwater plan requirements may be a good model for Collier County. • Additional details would need to be finalized, such as: • Exemptions for areas like the Estates. • Submittal requirements. • Water quality and/or water quantity standards. b. Committee Questions and Initial Feedback The Subcommittee noted it would be beneficial for staff to develop some preliminary detailed recommendations for their review and comment. The Subcommittee: 1. Requested staff to draft conceptual changes to the standards for their review and comment at the next meeting. 2. Requested Jerry Kurtz, Storm water Planning be present at the next meeting to answer any questions that may arise. 4. Next Meeting Date: September 19, 2016 The next meeting will be held on 9/19/16 at 3:00pm. 4 September 12, 2016 5.
