Agenda 10/25/2016 Item #16D14 16.D.14 10/25/2016 ,., EXECUTIVE SUMMARY Recommendation to adopt a Resolution related to Gift or Purchase of bus stop easements that exempts a purchase in the amount up to$100,000 from the requirement for an external appraisal. OBJECTIVE: To obtain bus stop easements in order to provide a safe and Americans with Disabilities Act(ADA) accessible waiting area for the transit users within Collier County. CONSIDERATIONS: The State of Florida Department of Transportation (FDOT) has taken on several initiatives to improve the provision of public transportation specifically as it relates to the ADA for accessibility and compliance improvements at bus stops. On December 11, 2012, the Board of County Commissioners approved an agreement in the amount of $237,919,with a local match of$59,479.75 for design and construction of improvements to bring existing bus stops up to ADA compliance on the State Highway System (SHS). Collier County's existing fixed term Contract No.13-6164, Professional Services for Engineers and Architects, was utilized for design services. The final design has been completed and the limited right-of-way in areas needing improvements will require the acquisition of easements. Fifteen easements from property owners are required for this project. Public Transit and Neighborhood Enhancement is working with Real Property Management secure the needed easements. The easements will be utilized to accommodate bus stop improvements such as boarding and alighting pads and may include benches, shelters, and trash receptacles that will meet ADA Accessibility Guidelines and FDOT requirements. With respect to property and easement acquisition, Section 125.355,Florida Statutes requires: 1) At least one appraisal by an appraiser approved for each purchase in an amount of not more than $500,000; and 2) Two appraisals for each purchase in an amount in excess of$500,000. Section 125.355 F.S. also allows the governing body to exempt a purchase in an amount of$100,000 or less from the requirement for an appraisal. The proposed resolution provides for that exemption. All of the parcels received are expected to be valued at less than$100,000. Performing the appraisals in house is more efficient and will result in an overall cost savings to the project. FISCAL IMPACT: The fiscal impact is in an amount not to exceed $600 and includes recording fees that will be charged to the CAT Operating Fund,426,Project No. 610111. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. NOW, THEREFORE. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF 0 COLLIER COUNTY, FLORIDA, that: 1. The bus stop boarding and alighting pads and related facilities Easement acquisitions identified on Exhibit "A" are necessary and consistent with the Project requirements, in order to permit the construction and maintenance of the bus stop boarding and alighting pads and related facilities. -Page 1- Packet Pg. 1595 16.D.14.a 2. The Board has determined that the construction and maintenance of the bus stop boarding and alighting pads and related facilities are necessary for a public purpose and in the best interest of Collier County. 3. County Staff is hereby authorized and directed to acquire the perpetual, non-exclusive, bus is stop boarding and alighting pads and related facilities Easements on the property identified in Exhibit "A" by gift or purchase. 4. The Chairman of the Board is hereby authorized to execute Appraisal Agreements with the o appraisal firm(s) selected from the list of firms pre-qualified by the Board of County Commissioners. The Board further directs staff to use appraisal reports or internal compensation estimates as staff determines is necessary to best serve the needs of the Project in a timely and cost-effective manner. 5. The Board, in accordance with the provisions of Chapter 125.355, Florida Statutes, hereby LA formally waives the requirement for a formal, independent appraisal report for the purchase of a property where the purchase price of the parcel (the compensation due to the property owner) is lessTjt than One Hundred Thousand and 00/100 Dollars ($100,000.00). In lieu of the independent appraisal report, staff is hereby authorized to make purchase offers for the property, the dollar amounts of which w shall be predicated on "staff compensation estimates" based upon independent appraisals (and the co data therefrom) obtained on similar properties and upon consideration and application of appropriate market value and cost data pertinent to the subject parcels. o 6. Upon the approval by the County Attorney's Office of all documents necessary for the subject c? 0 property acquisition, Real Property Management staff is hereby directed to offer immediate delivery to 0 the respective property owners of the full compensation (as established by the appraisal or staff compensation estimates in accordance with the provisions of Chapter 125.355, Florida Statutes), in E r return for the immediate and proper execution of the respective Easements and such other legal documents and/or affidavits as the County Attorney's Office deems appropriate in order to protect the interests of the County; and the Board hereby authorizes its present Chairman and any subsequent Chairman, for the life of the Project, to execute any instruments which have been approved by the -Page 2- Packet Pg. 1596 16.D.14.a Office of the County Attorney, to remove the lien of any encumbrance and for any such other purpose as may be required for the acquired bus stop boarding and alighting pad and related facilities Easement . 7. In those instances where negotiated settlements may be obtained via the "Purchase i9 Agreement" or "Easement Agreement" mechanism, the Director of the Public Transit and E Neighborhood Enhancement Division, or her designee, is hereby delegated the authority to approve n Lu the purchase of land interests above the staff compensation estimate or appraised value and pay o normally related costs when it is in the best interest of the Project, only when the difference between m the purchase price and compensation estimate or appraised value is less than Fifteen Thousand and N 00/100 Dollars ($15,000.00) or the current purchasing limits established by the Collier County Purchasing Department; provided, Project funding is available. 8. That the settlement approval authority is delegated by the Board to the extent that such N approvals do not conflict with the provisions of Section 125.355, Florida Statutes. 9. The Chairman of the Board is hereby authorized to execute Easement Agreements and/or Purchase Agreements where the land owner has agreed to sell the required land rights to the County Ui at its appraised value or at that amount considered the "Administrative Settlement Amount" as such term is internally used by the administrative agencies of Collier County. Where the property owner agrees, by sworn affidavit or agreement ("Purchase Agreement" or o "Easement Agreement"), to convey a necessary interest in real property to the County, and upon the i5 0 proper execution by the property owner of those Easements, and such other legal documents as the 5 Office of the County Attorney may require, the Board hereby authorizes the Finance Department to issue warrants, payable to the property owner(s) of record, in those amounts as shall be specified on e E a closing statement and which shall be based upon the appraisal or staff compensation estimate in accordance with this Resolution and the provisions of Section 125.355, Florida Statutes. 11.
