9.B 10/25/2016 EXECUTIVE SUMMARY This item requires that ex parte disclosure be provided by Commission members. Should a hearing be held on this item, all participants are required to be sworn in. Recommendation to approve Petition VAC-PL20160002294 to disclaim, renounce and vacate the County and the public interest in a portion of Tract "R", Creekside Boulevard right-of-way, being a part of Creekside Commerce Park West-Unit Two, Plat Book 35, Page 43 of the Public Records of Collier County, Florida. The subject property is located south of Immokalee Road, between Arthrex Boulevard and Creekside Street in Section 27, Township 48 South, Range 25 East, Collier County, Florida (Companion to Agenda Items 9A and 11C). OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of Tract "R", Creekside Boulevard right-of-way, being a part of Creekside Commerce Park West-Unit Two, Plat Book 35, page 43 of the Public Records of Collier County, Florida, located in Section 27, Township 48 South,Range 25 East, Collier County,Florida,being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20160002294 has been received by the Development Review Division, Growth Management Department, from D. Wayne Arnold, AICP, of Q. Grady Minor and Associates,P.A.,as agent for the petitioner,Creekside Commerce Park Property Owners Association,Inc. To vacate a portion of Tract"R", Creekside Boulevard right-of-way,being a part of Creekside Commerce Park West-Unit Two, Plat Book 35, page 43 of the Public Records of Collier County, Florida, located in Section 27,Township 48 South,Range 25 East, Collier County,Florida, as further described in Exhibit A to the attached Resolution. The applicant is proposing to vacate a segment of Creekside Boulevard between Arthrex Boulevard and Creekside Street, approximately 1/4 mile in length. The right-of-way(Tract R) was dedicated on the plat to Collier County, "to be used as a public right-of-way."According to the Quitclaim Deed dated March 27, 2003, recorded in O.R. Book 3250, Page 1909, the Petitioner Creekside Commerce Park Property Owners Association,Inc., is fee simple owner of Tract R,Creekside Boulevard. The State and Collier County recently awarded Arthrex with financial incentives for the creation of approximately five hundred sixty (560) high wage jobs locally. Once this portion of the Creekside Boulevard roadway is vacated, Arthrex, Inc., intends to expand their corporate research and development operations by creating a medical research campus, which will produce economic benefits to Collier County and Southwest Florida. Moreover, vehicular traffic will be rerouted and accommodated by making intersection improvements at Arthrex Boulevard and Creekside Street and other traffic improvements, which will be addressed through the companion Creekside Commerce Park CPUD Amendment agenda item and a separate developer agreement. The local Postamaster does not object to the vacation, but the U.S. Post Office authority has not yet provided an official letter of no objection. If a letter of no objection is not received by the County prior to this hearing, then the applicant will need to remove the portion of the right-of-way abutting the Post Office from this vacation request or make this portion subject to receiving a no objection letter. Letters of no objection were received from various entities with utility facilities located within the vacated area (FPL, Comcast, Centurylink), all of which were subject to a condition that an easement be granted in favor of the utilities over the subject vacated area. The County reserves unto itself a County Utility Easement (C.U.E.) in favor of the Collier County Water Sewer District, and a public utility easement for fiber optic line and communications infrastructure in, on, over, and under the property described in Exhibit A of the attached Resolution. These easements are reflected and further described in the attached Resolution. The petitioner has agreed to all of the above referenced conditions. A Resolution to set this hearing date (Resolution No. 2016-194) was approved by the Board of County Commissioners(Board)on September 27,2016. Staff has reviewed this petition and found no reason for objection. FISCAL IMPACT: Staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary. LEGAL CONSIDERATIONS: The petitioner is requesting the vacation of a portion of Tract "R", Creekside Boulevard right-of-way,being a part of Creekside Commerce Park West-Unit Two, Plat Book 35,Page 43 of the Public Records of Collier County,Florida. Pursuant to Resolution 2013-166 and Florida Statutes Sections 336.09 and 336.10, the Board, with respect to property under their control, upon petition of any person or persons,may adopt a resolution to vacate, abandon, discontinue and close any existing public or private street, alleyway, road, highway, or other place used for travel, or any portion thereof, other than a state or federal highway, and to renounce and disclaim any right of the County and the public in and to any land in connection therewith,when the following criteria are met: 1. The request is in the interest of the general public welfare,or no public detriment is established. 2. The request does not invade or violate individual property rights. Moreover,pursuant to Florida Statutes Section 177.101,the Board may adopt resolutions vacating plats in whole or in part of subdivisions when the following criteria are met: 1. The request will not affect the ownership or right of convenient access of persons owning other parts of the subdivision. 2. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be vacated. E Arthrex is a global medical device manufacturer that is headquartered in Naples, Florida. Our w headquarters is directly south of the U.S. Post Office located at 1130 Creekside Way. We are experiencing tremendous growth and have begun planning a campus expansion. E Our plans call for the demolition of a manufacturing facility located directly to the east of the U.S.Post Office and the addition of a new office building and parking garage. Our goal is to create a more campus like feel to the area by adding walkways, bicycle paths, lakes and water features. One of our greatest concerns is regarding the flow of personnel across a busy street(Creekside Blvd)that separates our properties. We have seen numerous wrecks and even had an employee seriously injured while crossing the street. Therefore,we are petitioning the County to vacate a portion of Creekside Blvd. Traffic will still flow through the development, however, it would impact the rear service entrance of the U.S. Post Office. Per our discussion last week, I am asking that you or another member of the Postal Service management provide a "letter of consent"for the Vacation of the portion of Creekside Blvd. between Arthrex Blvd. Packet Pg. 308 9.B.h and Creekside Street. To date we have received letters of consent from all other tenants within the park and the local Fire Chief. The vacation of the roadway would require the relocation of your south entrance.
