EXECUTIVE SUMMARY
Discuss and make a Recommendation to the Clam Bay Advisory Committee on
Installation of Navigational Markers/Informational Markers for Clam Bay.
OBJECTIVE: Discuss and make a recommendation to the Clam Bay Advisory
Committee on the installation of navigational markers/informational markers for Clam
Bay.
CONSIDERATIONS: Appropriate reports and documentation:
a. Letter from USACE dated March 2, 2009 directed to county to install
navigational markers in Clam Bay.
b. February 27, 2009 email and pictures from Pamela Keyes addressing buoys.
c. Collier County Ordinance 96-16 Establishing Clam Bay for Motorized Vessel
use at idle speed.
d. City of Naples letter dated February 24, 2009 expressing support for
navigational marking of Clam Bay.
e. Quick Clam Deed Ordinance 09-66, Page 1841-1862; Declaration of
Restrictions Ordinance 0966, Page 1830-1831; Department of Army, Permit
Ordinance 0966 Page 1824-1829 outlining county restrictions against
navigational dredging.
f. Proposed channel marker locations and signage.
The Permit Subcommittee met last month and requested the following:
a. I supply additional documentation from the USACE that the navigational
markers were indeed required. I have received that documentation and it is
attached.
b. The Subcommittee also wanted assurance that installation of the navigational
markers would not trigger navigational dredging I the channel at some point in
the future. I provided them a copy of the restriction to the deed which prevents
the County from doing so.
c. They also were concerned about visual aesthetics of the markers and we have
come up with a plan that addresses both the number and the type of markers.
Permitting of navigational markers and information signs will require four (4) months. At
the earliest, markers will be installed by August 1, 2009.
FISCAL IMPACT: Funding for this activity will be resolved by the County Manager's
Office and expected to cost $18,000 if done by Coastal Zone Management.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.
RECOMMENDATION: Staff is requesting approval of the marker and information signs
for Clam Bay as presented above.

Approve submittal of JCP Permit Application for Dredging Clam Pass.
OBJECTIVE: Approve Submittal of JCP Permit Application for Dredging Clam Pass
CONSIDERATIONS: Relevant documentation and information:
1. Clam Pass Permit Drawings dated February 27,2009.
2. Clam Pass Dredging JCP Application dated February 18, 2009.
Additional Information
1. A dredging permit is required to maintain Tidal Flushing that has been occurring
on a 3 year cycle at Clam Pass.
2. A dredging Permit would also be required to open the pass if closed due to storm
activity.
3. This JCP is prepared on the same exact basis as the permit expiring in July
2009. Tidal Flushing with the exact same cross section and length of dredge cut.
Placement of beach quality sand to be placed on Clam Pass Beach Park.
ADVISORY COMMITTEE RECOMMENDATIONS:
FISCAL IMPACT: The Source of funds is from Category "A" Tourist Development Tax
fund 195.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.
RECOMMENDATION: Approval submittal of the JCP permit application for dredging of
Clam Pass.
