The Landscape & Safety Committee of the Pelican Bay Services Division met on Wednesday,
August 24 at 3:00 p.m. at the Community Center at Pelican Bay, located at 8960 Hammock Oak

AGENDA APPROVAL
Mr. Cravens motioned, Mr. Dawson seconded to approve the agenda as amended
with the addition of items #8c, #8d, and #8e. The motion carried unanimously.
APPROVAL OF 06/29/16 MEETING MINUTES rMr. Cravens motioned, Mr. Ventress seconded to approve the 06/29/16 meeting
minutes as presented. The motion carried unanimously.
AUDIENCE COMMENTS
Dr. Trecker commented on his intent to provide an update on the Zika virus as part of the
discussion of this agenda item.
APPROVAL OF CUL-DE-SAC LANDSCAPE PROJECT
Dr. Chicurel reviewed the pictorials, diagrams, and examples of"total re-makes" and
"partial re-makes" of Pelican Bay cul-de-sacs as provided in the agenda packet. Mr. Shepherd
suggested that plantings and/or grass be planted in cul-de-sac periphery areas adjacent to the
pavement instead of mulch. Mr. Dawson suggested reducing the level of the mounds in the cul-
de-sacs and medians, wherever possible.
Mr. Cravens motioned, Mr. Dawson seconded to recommend to the full board to
augment what was previously authorized for the re-landscaping of the cul-de-sacs
by an additional $60,550. The motion carried unanimously.
PELICAN BAY BLVD. NORTH AND AVALON/L'AMBIANCE CORNERS
Dr. Chicurel provided before and after photos of the re-landscaping of the Pelican Bay
Blvd. North and Avalon/L'Ambiance corners and complimented staff.
ZIKA SPRAYING OF BROMELIADS
Dr. Chicurel provided a general update on the Zika virus and bromeliads, which may act
as a source of water for mosquitoes to hatch larvae. Mr. Bolick commented on the chemical
agents that the PBSD is using to augment the spraying being done by the County.
Dr. Trecker updated the committee on information provided by the Collier Mosquito
Control District including (1) characteristics of Zika mosquitoes, (2) effective chemical agents,
and (3) information on methods being used by the Mosquito Control District to monitor and kill
mosquitoes.
Mr. Cravens motioned, Mr. Dawson seconded to recommend to the full board that
we no longer utilize bromeliads in new landscaping in Pelican Bay. The motion
carried unanimously.
DISCUSSION OF ANNUAL PLANTINGS

Pelican Bay Services Division Landscape & Safety Committee Meeting
August 24,2016
By consensus, the committee was in favor of planting (1) red begonias and white
alyssums at the three U.S. 41 Pelican Bay entrances, and (2) geraniums in the median bull noses
on the corner of Gulf Park Drive and Pelican Bay Blvd.
Ms. Molly Moffatt commented on her preference for selecting bright red begonias with
green leaves instead of begonias with bronze leaves.
SAFETY ISSUE ON PATHWAY ON PELICAN BAY BLVD. (ADD ON)
Mr. Cravens provided photos of a yellow metal cover with protruding upward rivets,
placed on the pathway on Pelican Bay Blvd., which he cited as a safety hazard. Mr. Bolick
reported that this metal cover has been removed.
STREET LIGHTING (ADD-ON)
Mr. Dawson commented on the need for tree trimming around street lights throughout the
community for improved safety. Mr. Cravens commented on past objections raised by residents
who place a high value on the tree canopy, and therefore, additional community input should be
obtained prior to any wholesale community-wide tree trimming.
Mr. Dorrill commented on the current survey work being performed by Agnoli, Barber &
Brundage to identify those areas where (1) tree pruning is recommended to enhance the
effectiveness of existing street lights, and (2) additional poles are recommended. Mr. Dorrill
expects to provide a report by AB&B on this work at the next L&S committee meeting.
Mr. Gerald Moffatt commented on the possibility of lowering the arms of Pelican Bay
street lights and extending the arms out further into the streets, as discussed in the past.
CAR CARRIER DISCUSSION (ADD-ON)
After discussion, the committee agreed, by consensus, that it is in favor of pursuing the
car carrier alternative site at the Covenant Presbyterian Church. Mr. Dorrill commented that he
will pursue obtaining the indemnification documents requested by the church in order to provide
access to their property for car carrier unloading for the benefit of Pelican Bay residents.

LICENSE AGREEMENT
THIS LICENSE AGREEMENT entered into this day of , 2016, by
and between the Covenant Presbyterian Church of Naples, located at 6926 Trail Blvd, Naples,
FL 34108, hereinafter referred to as "LICENSOR," and Collier County, a political subdivision of
the State of Florida, whose mailing address is 3299 East Tamiami Trail, Naples, Florida 34112,
hereinafter referred to as "LICENSEE."
WITNESSETH
In consideration of the mutual covenants contained herein, and other valuable
consideration, the parties agree as follows:
ARTICLE 1. Licensed Premises
LICENSOR hereby Licenses to LICENSEE and LICENSEE hereby accepts the License
from LICENSOR a parking area designated by LICENSOR for the sole use by car carriers. The
parking area is generally described in Exhibit A to this Agreement. The LICENSEE'S use of the
parking area, however, shall not coincide with the scheduled hours of worship at the church.
ARTICLE 2. Term of License
This is a continuous month-to-month License Agreement, with either party having the
right to terminate with or without cause by providing the other party with thirty (30) days written
notice. Said notice shall be effective upon placement of the notice in an official depository of the
United States Post Office, Registered or Certified Mail, Postage Pre- Paid.
ARTICLE 3. Rent
LICENSOR is providing this parking area as a public service to the residents of Pelican
Bay, and no rent shall be due.
ARTICLE 4. Modifications to Licensed Premises
LICENSEE shall not make any changes, alterations, additions or improvements to the
designated parking area.
ARTICLE 5. Assignment and Sublicensing
LICENSEE will not assign or sublicense this License without the written consent of
LICENSOR.
ARTICLE 6. Indemnity
To the extent authorized by law, LICENSEE, in consideration of Ten Dollars ($10.00),
the receipt and sufficiency of which is hereby acknowledged, shall indemnify, defend and hold

harmless LICENSOR, its agents and employees from and against any and all liability (statutory
or otherwise), damages, claims, suits, demands, judgments, costs, interest and expenses
(including, but not limited to, attorney's fees and disbursements both at trial and appellate levels)
arising, directly or indirectly, from any injury to, or death of, any person or persons or damage to
property (including loss of use thereof) related to the use of the designated parking area by car
carriers.
Car carriers utilizing the designated parking area do so at their sole risk. The LICENSOR
shall not be liable for any damages to any car carrier utilizing the designated parking area, or to
the cars utilizing the car carriers, including loss due to theft.
ARTICLE 8. Administration
This License shall be administered on behalf of the LICENSEE by the Pelican Bay
Services Division.
ARTICLE 11. Notices
Any notice which LICENSOR or LICENSEE may be required to give to the other party
shall be in writing to the other party at the following addresses:

Thank you for responding. I attended a couple of PBSD meetings when they were debating the
dredging of clam pass a couple of years ago. I found them absolutely stultifying.
I was briefly on the board of the Avalon Condo Assoc. The few times I attempted to make a
comment or express an opinion I encountered hostility and resentment and I was made to look
the fool. Even on matters one would have thought non-controversial. So I resigned. My
experience taught me that those in power vigorously defend the status quo.
I can try going to a PBSD meeting but am not optimistic that it would be beneficial. Do I have to
notify them that I'd like to say something? Do they have to put it on the "agenda"?
(at Avalon I once made some suggestion that was immediately dismissed because it was "not on
the agenda").

Thank you for your note and we are, of course, sorry for your accident.
As you may know,the roadways in Pelican Bay are county roads and as
such are maintained by them.
The crosswalks were installed by the PBSD as a safety upgrade for the community.
Personally, I do quite a bit of riding and have not found the
crosswalk pavers to be a problem for me.
But,that's just me and so I am not disagreeing with your feelings
about their bumpiness.

Mr. Dawson,
Thank you for writing. We've lived in Pelican Bay for 5 years now, so I knew the boulevard before there ware
cobblestones, and as it is now. As you point out,the cobblestones are an impediment and, as my experience has
shown, dangerous. Biking has been my primary sport for decades, and now at age 69, I was continuing to do
Sunday morning bike rides down to Gordon Pass and back. Passing over those cobblestones on a road bike is
so jarring(one's handlebars vibrate like the handles of a jackhammer)that it was my practice to go around them
by riding into the V shaped cement gutters on either side of the road. This worked quite well until I hit one that
was full of water. I have ridden through thousands of puddles in my time,but I did not anticipate algae growing
in the standing water, and that this algae was as slick as black ice. Being from New England I know what it is
like to skid on ice and that was my experience. The bike went out from under me and I hit the ground hard,
sustaining the injuries I've described already. I was going at a good clip for a 69 year old,maybe 12-13 mph. (I
observe many younger cyclists on PB boulevard who ride much faster than I do. If one of them had hit that
algae going 17-20 mph, I shudder to think what their injuries might have been).
It is a miracle(as the NCH Emergency Room medics pointed out) that I do not have a broken hip or other more
serious injuries. I was astonished that Mr. Cook described the cobblestones as "safety features". There should
be signs, CAUTION, ROUGH PAVEMENT AHEAD! to warn traffic and to avoid personal injury lawsuits.
I'm no expert,but I'd guess that an attorney would have an easy time proving negligence in a personal injury
lawsuit when there are no signs warning of the cobblestones. If you want to make the crosswalks safer for
pedestrians, I'd suggest installing flashing lights that go on automatically when someone is in the crosswalk. Or
actual walk signs that would come on when a pedestrian pushes a button and the traffic is halted by a red light.
In any case,the cobblestones MUST be removed before someone gets killed, or ends up in a coma or as a
paraplegic.
I have put the Oct 5th PBSD meeting on my calendar. Please feel free to contact me for additional information.
Be thankful that I am not a litigious person.

I bike and jog everyday in Pelican Bay. I personally slow down over those stones.
I was not on the PBSD board when the design was approved. I do however
understand that we have an issue with cars speeding at several pedestrian walkways.
I did in fact copy all of our board members upon receipt of your email and correspondence with Mr. Dave
Cook. I have requested this issue to be added
on our October 5,2016 PBSD meeting agenda. You are welcome to attend
this meeting and speak on the issue during the "Audience Comments".
The meeting will be held at 1:00 at the Community Center at Pelican Bay.

Attached is the ROW application and Permit 11-0293-E. There is no mention of cobbles in the permit. We checked the
County review comments and permit correspondence as well,and saw nothing specifically mentioned regarding cobble
surface. I recall that during construction the cobbles were delivered and were noticeably irregular(slanted)at the tops.
The contractor had started installation at the first mid-block location and many of the cobbles did not align well adjacent
to the others. Kyle and I met with the installer and they agreed to remove what had been installed to date and take
extra care in selecting cobble placements individually to minimize the height differences. We asked the contractor to
provide%" max.differential. After installation we reviewed the conditions and found more than%" in many locations as
it was not possible to achieve. The contractor agreed to bring a chipper to cut down the tops that exceeded%". He also
came back later with a grinder to shave down additional cobbles. Attached is a punch list memo we provided after
installation indicating the 1/4" height criteria.

Below are responses to your questions:
1. Are cobblestones"allowed"at mid-block crosswalks?
-We find no specific language in the County ROW Ordinance and MUTCD that allows or prohibits
cobblestones.
-From Section 3.8.6(2)of the Traffic Engineering Manual (TEM): For many situations,a marked
crosswalk alone may not be sufficient.
Signs and pavement markings alone will not make crossings safer, nor will they necessarily result in
more vehicles
stopping for pedestrians. Other facility enhancements should be considered in conjunction with a
marked crosswalk
such as curb extensions, raised crosswalks, speed regulation treatments, additional

signing and marking, flashing beacons, or signalized control.
2. Is there any special warning signage required by MUTCD/Collier County to indicate that cobblestones
are in the roadway?
- No. Signs only warn the approaching traffic of the mid-block crossing for safety of pedestrians,not
for the type of material used.
3. If not cobblestones,what other material is"allowed" that could produce a similar tactile feel and sound?
- Brick pavers would be the most similar replacement. The mid-block crosswalk at Beachwalk near San
Marino originally had the 3' wide cobble borders but were later removed and replaced with standard
pavers. These were changed due to noise complaints from adjacent residents. The transition from
asphalt to the concrete bands and pavers creates a slight tactile feel and sound(although less effect than
cobbles).
Pavers with concrete bands provide a visual change from the asphalt, but less tactile feel and sound
than cobblestone.
4. If the PBSD Board decides to remove cobblestones at mid-block crosswalks,what improvements to
include signage, signal beacon lights, and roadway tactile material would be required by
MUTCD/Collier County?
-A tactile surface is not required. The cobbles were recommended in the Community Improvement
Plan and I understand were desired and/or paid for by the Foundation.
-If cobbles are removed, standard brick pavers could be used without changing the existing street
signage. This was already done in 2013 at the Beachwalk crosswalk.
-Attached is the 2012 contractor cost to remove cobbles at all mid-block crossings at that time. The
board decided to remove them only at Beachwalk.

the Growth Management Division for good cause shown;
11. All overhead installations must meet a'minimum four foot separation to communication lines{both vertically and horizontally),minimum seven foot
separation to guys(both vertically and horizontally)and minimum ten foot separation to neutrals(both vertically and horizontally),and meet and/or
exceed all other OSHA requirements as may be determined by OSHA clearance requirements and/or formulas relevant to overhead lines clearances

Crosswalk#1
Some red pavers are slightly raised above others:one location at north crosswalk northbound lane,one in the south
crosswalk southbound lane,and one in the south crosswalk, northbound lane.
Crosswalk#4
Cobbles should be chipped in the southbound lane,outside edge near the valley gutter to provide no more than 1/4"
vertical rise above adjacent cobbles, in the direction of travel.
"Stop here for Ped"signs are on smaller posts, and most signs are installed too low(distance from grade to the
bottom of sign).

Two red pavers are high in the north crosswalk,southbound left turn lane.
The divided median sign that was in the Gulf Park Drive median facing west is missing.
Remove the old 6"white stripes between the stop bars and new crosswalk reflective striping at northbound and
southbound approaches.

Red pavers are slightly raised in the southbound direction, between the two lanes. It looks like the match line was
not aligned well when the inside lane was completed, then the outside lane was installed after.
Red pavers and cobbles were recently replaced to correct a dip in the northbound lanes, however there still
appears to be a noticeable dip.

CONDITIONS OF PERMIT
1. This permit must be kept on the work site and be available upon request of prominently displayed.

2. Permits are required for all work performed In any rights-of-way or easements provided for public use in the unincorporated area of Cotter County and in those public
rightsof-way or easements,which are maintained by C9llier County,but lie within municipal boundaries.
3. When permitted facilities are placed within a public right-of-way or easement,the Installation is for permissive use only end placing of facfities shall riot operate to
create or vest any property right In the associated right-of-way or easement to the permittee. Furthermore,the permittee shall be responsible for maintenance of
• such facilities until they are removed,unless otherwise specified.
4. All materials and equipment, including Maintenance of Traffic (MOT) and equipment placement, shall be subject to inspection by the Engineering Services
Department or Transportation Services Division:

6. No lane closures will be permitted between the hours of 7.00—9:03 A.M.and 3:30—6:30 P.M.
7. Prior to construction,the Contractor/Permittee shall submit a Maintenance of Traffic plan(MOT)for any construction project involving work or activity that may effect
traffic on any County street, roadway or bikepathh/sldewalk. The MOT must bo signed by either a Professional Engineer or person certified by the international
Municipal Signal Association(MSA)if affecting Arterial or Collector Roadways,unless waived by the Transportation Road Maintenance Department. The driveway
fill and driveway culvert Including soil erosion/sedimentation control measures must be instated prior to the start of any earth moving construction activity with
drainage plans,culvert size,soil erosion/sedimentation controls,elevation offset,and ditch slope designed and certified by a licensed engineer for all commercial
projects.
8. During construction the Cortractodpennlltee shall comply with the'State of Florida Manual of Traffic Control and Safe Practices for Street and Highway Construction,
Maintenance,and Utility Operations"and with the`Manual On Uniform Traffic Control Devices"and with at other governing safety regulations and shall maintain the
approved ste drainage plan and soft erosionrsedimentatlon control plan.
9. The Permittee shall hold the County harmless and the County shall be feleved of all responslbllly for any damage er liability of any nature arising from work
authorized and performed under this permit.
10. All crossings of existing pavement shall be made by jacking and boring at a minimum depth of thirtys x inches(361 unless otherwise authorized by the Engineering
Services Department'or the Transportation Services Division for good cause shown.
11. AU overhead installations must meet a minimum four foot separation to communication lines(both vertically and horizontally),minimum seven foot separation to guys
(both vertically and horizontally)and minimum ten foot separation to neutrals(both vertically and horizontally),and meet and/or exceed ail other OSHA requirements
as may be determined by OSHA clearance requirements and/or formulas relevant to overhead lines clearances and/or separations requirements(both vertically and
horizontally),and ell underground crossings shall be placed at a minimum depth of thirty-skit Inches(36')bebwthe pavement and/or a minimum depth of twenty-four
Inches(24')below the designed roadside ditch or scale invert. Primary cable(voltage exceeding 503 volts)shaft have minimum thirty-six(36')cover. Secondary
cable(voltages fess than 500 volts)shalt have a minimum thirty-inch(30')cover. Exception may be made by authority of the Engineering Services Department or the
Transportation Services Drvislon for good cause shown.

12. Two prints of the proposed work covering details of this installation shall be made a part of this permit. If additional plans are required,they shall become a part of
this permit.
13. Following completion of all permitted work,grassing end/or seeding shall be required for any disturbed rights-of-way.
14. All moody disturbed by work authorized by this permit must be restored to better than,or equal to,its original condition,and to the satisfaction of the County.
15. Whenever deemed necessary by the County for the construction,repair,maintenance,improvement,alteration or relocation of applicable rIght•of-way or easement
and when so notified by the County,any or at poles,wires,pipes,cuiverts,cables,sod,landscaping,driveways,sprinklers,or other facilities and appurtenances
authorized shall be removed from said right-of-way or easement,or reset or relocated thereon as required,to be installed by this Permit,and at the expense of the
permittee,his successor,or assign.
16. When the permittee,or his successor,or assign Is notified of a need for construction,repair,maintenance,improvement,alteration of or relocation within the right-of-
way or easement and no action Is taken by the responsible party within the time frame specified by the County,the County shall cause the permitted work to be
altered,relocated,or removed,with the total expense being borne solely by the permittee or the responsible party.
17. Permits shall generally be In a form approved by the Board of County Commissioners and shall Include the time of commencement,the number of days the job Is •
expected to take,and the approximate date of completion. The permit will expire ninety(90)days after the designated completion date,unless authorized in the
specific instance fora longer or shorter period. If the work has not been completed by the expiration date,there will be a renewal fee,set by Resolution,payable
upon extending the expiration date for an additional ninety(90)days.
18. At correspondence regarding construction procedures will be through the permittee,or his authorized agent or consultant, and not through any contractor or
subcontractor. •
19. If there are any lane closures or work that will Impede normal traffic flow. The permit holder is obligated to inform the road alert coordinator at 239-252-8192 and the
ROW Permit Section at 239-252-5767,three working days prior to construction.
20. Collier County Traffic Operations Department Inspection Staff shall be notified in writing either via form letter(To:Collier County Traffic Operations,2885 Horseshoe
Drive South, Naples, FL 34104) or email(r ••) a minimum of 72 hours prior to the commencement of Jobs that Include overhead or
underground work that will be conducted es part of construction or maintenance projects within Collier County or State Road rights-of-way within Collier County and
12 hours prior to any and el€daily work to be performed throughout the entire length of construction or Maintenance projects. Any rescheduling of work shall be
provided In writing. All underground facilities must be located prior to construction,

Yes, this area is Foundation property maintained historically by the PBSD. It also contains a
drainage swale. A couple of years ago some of the well-established vine material was
removed from this area. I agree with Marion that it was not kudzu, but it is thick. As I recall,
the last time an exotic removal was done —at that time by the PBSD we received a number
of complaints from folks on Buttonbush because it really opened up the area between US 41
and their backyards; both from a noise increase and increased visibility of US 41 standpoint.
There is another exotic species in this area, mahoe, which are thick with massive root
systems.
I'm told that all of this is impacting the water management in the area causing some water
back-up and flooding in back yards. Frank is very involved with these issues. I mention this
because this is an area that has become overgrown with more than just vines, and may need a
more comprehensive approach, and definitely needs to be communicated to the property
owners who will be impacted by a clean-up of this area.

North Carolina. Marion told me it was a different vine.
Anyway, the vine has grown up to engulf the pine trees and is very unsightly.
I think this is Foundation land and so I wondered if you and Marion could coordinate to get the
vines cleared from this area.
Knowing vines this will be tough, and we'll have to be persistent- but we should do it.
