LDR Subcommittee Minutes 02/29/2016 February 29, 2016 MINUTES OF THE COLLIER COUNTY DEVELOPMENT SERVICES ADVISORY COMMITTEE LAND DEVELOPMENT REVIEW SUBCOMMITTEE Naples, Florida, February 29, 2016 LET IT BE REMEMBERED, the Collier County Development Services Advisory Committee Land Development Review Subcommittee in and for the County of Collier, having conducted business herein, met on this date at 3:00 PM in a REGULAR SESSION at the Growth Management Division Building, Room 609/610 2800 N. Horseshoe Drive, Naples, FL with the following persons present: Chairman: Clay Brooker Robert Mulhere Blair Foley ALSO PRESENT: Caroline Cilek, LDC Manager Stephen Lenberger, Sr. Environmental Specialist Jeremy Frantz, Sr. Planner Richard Henderlong, Principal Planner 1 February 29, 2016 Any person in need of a verbatim record of the meeting may request a copy of the audio recording from the Collier County Growth Management Division, Department of Planning and Zoning. 1. Call to Order Mr. Brooker called the meeting to order at 3:05pm and a quorum was established. 2. Approve Agenda Mr. Foley moved to approve the Agenda. Second by Mr. Mulhere. Carried unanimously 3—0. 3. February 1,2016 Meeting Minutes Approval Mr. Mulhere moved to approve the minutes of the February 1, 2016 meeting as presented. Second by Mr. Foley. Carried unanimously 3—0. 4. Review Amendments e. LDC sections 5.04.05 & 5.04.06—Temporary Markets on Private Property (this item was heard first) Staff reported the proposed amendment is intended to streamline and consolidate Land Development Code requirements for temporary events on private property. The changes include adding use standards; adding provisions for farmers markets, craft fairs, etc.; clarifying and reorganizing signage requirements and the allowed time frames for events, etc. They noted temporary events on Collier County owned property are approved through an agreement with the Board of County Commissioners. There are no changes proposed for the fee schedule. Public Speakers Chairman Brooker reported an email was submitted by Joey and Neomi Rakow dated February 26, 2016,who requested the ability to display 2 signs for markets in order to place a sign at each entrance to an event. They indicated they supported the 52 days allowed for markets. They also requested the ability to display one feather banner on the day of the event only. Laura Sloat, Shoppes at Vanderbilt Farmers Market addressed the Committee noting 52 event days is favorable. She recommended the County clarify whether event days used for one type of event impacts the number of days allowed for other events. For instance, would a car show or music festival, etc. reduce the number of days that a temporary market may operate at the same location? She indicated she was in favor of licensing for vendors but recommended the licensing requirements be clarified (including the requirement for business tax licenses from out of County vendors). She indicated she is also in favor of feather flags. Finally, she asked how the parking requirements are measured. Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment subject to the following revisions: 1. Section5.04.05 A.2 line 3 from "...available in certain non residential..."to "available in non residential..." 2. Section 5.04.05 F.1 —Clarifying the categorization of the certain events (i.e. car shows, music festivals, etc.). 2 February 29, 2016 3. Section 5.04.06 B.9a—allowing 2 signs during the duration of events for Temporary Market Events. 4. Any clarification necessary under Sections 5.04.05 c and d for the licensing requirements. Second by Mr. Foley. Carried unanimously 3—0. a. LDC sections 1.08.02 & 2.03.01 —Agri-tourism Staff reported the proposed amendment was directed by the Board of County Commissioners to establish agri-tourism as a permitted use in Agricultural zoning districts. However, those agricultural activities utilizing airboats, all-terrain vehicles, horses, off-road vehicles, swamp buggies, and other off-road excursions or tours which create new trails will be subject to the Conditional Use process. The States definition for agri-tourism will be utilized for the activity. Committee discussion occurred on the intended consequences for agricultural parcels in the urban area and whether a minimum acreage for these parcels should be established. Staff reported State Statutes prohibit the County from adopting regulations which restrict agri- tourism on lands zoned for agricultural use. Additionally, currently proposed legislation may be adopted which would also prohibit the County from enforcing existing regulations on agri- tourism. The County Attorney's Office notified Staff they should only propose requirements that are less restrictive than current regulations. The Committee noted consideration could be given to alter the language in Section 2.03.01 A.l.c.23.vii "The Board of Zoning Appeals shall establish a timeframe for review..." from "shall"to "may." Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment. Second by Mr. Foley. Carried unanimously 3—0. b. LDC sections LDC sections 3.05.04 & 3.05.07—Preserve Signage Requirements Staff outlined the changes include clarifications on the types, locations, number, size of signs, etc. and are proposed due to issues raised by Stakeholders. Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment. Second by Mr. Mulhere. Carried unanimously 3—0. c. LDC section 3.05.07—Identification of Preserves Staff reported the item was reviewed at the 2/1/16 Subcommittee meeting and amended the language as requested by the Subcommittee. Mr. Foley moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment. Second by Mr. Mulhere. Carried unanimously 3—0. 3 February 29, 2016 d. LDC section 4.05.10—Required Parking for Residential Central Mail Delivery Locations (A new LDC section) Staff reported the amendments are proposed as a result of a USPS request to promote consistent placement of central delivery facilities in residential developments. The standards include parking, lighting, safety and other requirements to assist residential developers in designing and locating the facilities. Committee discussion occurred on the parking requirements of 2 spaces noting in certain instances they could be too few, or in others too many where people walk to the location. It may be beneficial to promote flexibility in the requirements based on the proposed location and anticipated use of the facility. Staff reported the requirement is a new concept and will consider the recommendation as the amendment, or future amendments move forward. Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment. Second by Mr. Foley. Carried unanimously 3—0. f. LDC sections 5.05.12 and other sections—Amendments to Site Design Standards for Public Utilities Tim Hancock and Kelly Blake of Stantec,and Craig Pager of Collier County Public Utilities presented the proposed amendment noting: • The issue has come to light as many of the facilities are "aging"and in need of some type of upgrades. Upgrades to existing facilities are especially problematic and they need some form of site plan approval and at times cannot meet the current requirements of the LDC creating a time consuming and create an unnecessary cost burden to the tax payers. • The purpose is to streamline, simplify and consolidate Land Development Code requirements for public utility ancillary systems. • The proposed changes include removing landscape requirements and relying on the private property owner to screen and maintain the vegetation if they so desire. • • Upgrades to existing facilities are especially problematic ad they need some form of site plan approval and at times cannot meet the current requirements of the LDC creating a time consuming process and burden to the tax payers. • The Site Plan with Deviations process would be available for items not covered in the proposed amendment. • The issue has come to light as many of the facilities are "aging"and in need of some type of upgrades. Mr. Mulhere moved for the Development Services Advisory Committee to recommend the Board of County Commissioners approve the proposed amendment. Second by Mr. Foley.
