COMES NOW, the undersigned, Jesus Castellan, on behalf of himself or as
representative for Respondent and enters into this Stipulation and Agreement with Collier County as to the
resolution of Notices of Violation in reference (case) number CEV20160006356 dated the 11th day of May,
2016.
In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which
a hearing is currently scheduled for October 7, 2016; to promote efficiency in the administration of the code
enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the
parties hereto agree as follows:
1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence.
Designated parking area that exceeds over 40% of the front yard.
THEREFORE, it is agreed between the parties that the Respondent shall;
1) Pay operational costs in the amount of $115.10 incurred in the prosecution of this case within 30
days of this hearing.
2) Abate all violations by:
Reduce the designated parking area so that it does not comprise an area greater than 40% of the
required front yard which nonetheless may not serve to limit the driveway to a width of less than 20 feet
or any other county approved method to abate the violation, within 120 days of this hearing of a fine of
$50.00 per day will be imposed until the violation has been abated.
3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request
the Investigator perform a site inspection to confirm compliance.
(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property
owner.

FROM THE OFFICE OF THE BUILDING OFFICIAL OF COLLIER COUNTY,FLORIDA. THE BUILDING OFFCIAL IS GRANTED AUTHORTIY
UNDER FLORIDA STATUTES 468 AND 553 TO ENFORCE THE FLORIDA BUILDING CODE
The property located at the above noted address was inspected in response to a request from the
Collier County Code Enforcement Department for the purposes of determining if the subject building
meets the definition of"dangerous building".
Please be advised that on May 25th 2016 an Inspector, licensed under 468 Florida Statute, and
employed with the Collier County Building Department performed a field inspection of the building
located at 216 South 4th Street, Immokalee, Fl. In accordance with the 2014 Florida Building Code any
building or structure or any individual member with any of the structural conditions or defects
described below shall be deemed dangerous. A check mark next to any paragraph below is an
indication one or more of the dangerous structural conditions has been found.
1. The stress in a member or portion thereof due to all factored dead and live loads
is more than one and one third the nominal strength allowed in the Florida Building Code,
Building for new buildings of similar structure, purpose, or location.
✓ 2. Any portion, member, or appurtenance thereof is likely to fail, or to become
detached or dislodged, or to collapse and thereby injure persons.
✓ 3. Any portion of a building, or any member, appurtenance, or ornamentation on the
exterior thereof is not of sufficient strength or stability, or is not anchored, attached, or
fastened in place so as to be capable of resisting a wind pressure of two thirds of that
specified in the Florida Building Code, Building for new buildings of similar structure,
purpose, or location without exceeding the nominal strength permitted in the Florida
Building Code, Building for such buildings.
✓ 4. The building, or any portion thereof, is likely to collapse partially or completely
because of dilapidation, deterioration or decay; construction in violation of the Florida
Building Code, Building; the removal, movement or instability of any portion of the ground
necessary for the purpose of supporting such building; the deterioration, decay or
inadequacy of its foundation; damage due to fire, wind or flood; or any other similar
cause.

✓ 5. The exterior walls or other vertical structural members list, lean, or buckle to such
an extent that a plumb line passing through the center of gravity does not fall inside the
middle one third of the base.
The field inspection revealed that the three buildings satisfied one or more of the conditions noted
above. Based on the inspection findings the main structure and two accessory buildings noted above
was found to be dangerous and unsuitable for the safe occupancy of its intended purpose. Immediate
repairs up to and including demolition of the structure are required.
You are hereby notified that unless the above dangerous conditions are remedied within thirty (30)
days from the date hereof, the County will remedy the dangerous condition and the cost thereof will
be levied as an assessment against such property. You are further notified that should you desire to
contest this determination of the existence of a dangerous building you may apply for a hearing
before the Code Enforcement Board (CEB) or Special Master. Such request for hearing shall be made
in writing to the Secretary of the CEB /Special Master within fifteen (15) days from the date of this
notice. You may call 239-403-2440 for further information regarding a request for hearing.

(24 hours notice shall be by phone or fax and made during the workweek. If the violation is abated 24 hours prior to a Saturday,Sunday or legal holiday,then the
notification must be made on the next day that is not a Saturday,Sunday or legal holiday.)
4) That if the Respondent fails to abate the violation the County may abate the violation using any method
to bring the violation into compliance and may use the assistance of the Collier County Sheriff's Office
to enforce the provisions of this agreement and all costs of abatement shall be assessed to the property
