EXECUTIVE SUMMARY
Recommendation to approve the conveyance of an Easement to Florida Power & Light Co., to
provide a 3 ph transformer and provide additional power systems to existing 1 ph transformer at
EMS 10 at the site of the future Collier County Sheriff Orange Tree Substation.
OBJECTIVE: To provide the appropriate amount of power needed at the Collier County Sheriff
Substation and EMS 10 at Orange Tree.
CONSIDERATIONS: In order for Florida Power & Light Co. (hereafter "FP&L") to provide the
necessary power to these buildings, it will be necessary to execute and record the attached Easement
(Business)to FP&L.
The Easement comprises a total of 3,389 square feet, more or less, as shown and described on Exhibit
"A"of the Easement.
The Easement has been reviewed and approved by Collier County Facilities Management and the County
Attorney's Office.
FISCAL IMPACT: Recording costs shall not exceed twenty ($20.00) dollars and will be paid from
Fund 385.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires majority vote
for approval. -JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management
Plan.
RECOMMENDATION: That the Board of County Commissioners approves the attached Easement
(Business), authorizes the Chairman to execute the Easement, and directs the County Manager or his
designee to proceed to follow all appropriate closing procedures and to record the Easement in the Public
Records of Collier County,Florida.

adequacy and receipt of which is hereby acknowledged, grant and give to Florida Power & Light
Company, its affiliates, licensees, agents, successors, and assigns ("FPL"), a perpetual, non-exclusive
easement for the construction, operation and maintenance of overhead and underground electric utility
facilities (including wires, poles, guys, cables, conduits, and appurtenant equipment) to be installed from
time to time; with the right to reconstruct, improve, add to, enlarge, change the voltage, as well as the size
of, and remove such facilities or any of them within an easement described as follows: 0

Together with the right to permit any other person, firm or corporation to attach wires to any facilities
hereunder and lay cable and conduit within the easement and to operate the same for communications c•
purposes; the right of ingress and egress to the easement area at all times; the right to clear the land and N
keep it cleared of all trees, undergrowth and other obstructions within the Easement Area; to trim and cut
and keep trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the easement
area which might interfere with or fall upon the lines or systems of communications or power transmission or -E
distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at all, the rights LL
