EXECUTIVE SUMMARY
Recommendation to approve Commercial Excavation Permit (Commercial Excavation Permit
Application PL20160000760) Immokalee Sand Mine. The Applicant, Cemex Construction
Materials Florida,LLC, requests a commercial excavation permit to remove 70 million cubic yards
and haul it offsite for a period of up to 35 years on an 890 acre site located on the north side of State
Road 82, approximately 1.5 miles west of State Road 29 in Immokalee, in Sections 6 and 7,
Township 46 South,Range 29 East,in Collier County,Florida.
OBJECTIVE: To approve a Commercial Excavation permit for the Immokalee Sand Mine pursuant to
Resolution No. 2010-224.
CONSIDERATIONS: Cemex Construction Materials Florida, LLC., as Agent and Applicant for the
property owner,Barron Collier Partnership LLP,has applied for a Commercial Excavation Permit located
in Sections 6 and 7,Township 46 South,Range 49 East, Collier County.
The Code of Laws Chapter 22, Article IV, Section 22-110 (b) (2) requires petitioners to file for a
Commercial Excavation Permit for removal of fill from a site. Commercial excavation permits require
approval by the Board of County Commissioners (Board). The Immokalee Sand Mine was issued a
Conditional Use Permit - Resolution 2010-224 for an earth mining operation on November 9, 2010. An
extension of the Conditional Use was approved pursuant to House Bill No. 7207 on June 8, 2012 which
extended the Conditional Use to November 9, 2015. Subsequently, the applicant obtained a Temporary
Use Permit (PL20150001778) and Site Improvement Plan on August 8, 2015 to commence some
preliminary site improvements including placement of a construction trailer and commencement of soil
borings. Therefore, the Conditional Use remains vested. The mining will be conducted in 10 Phases and
it is anticipated that the operation will have a lifespan of 30 - 35 years. Excavation depths will be to the
confining layer,which varies in depth.
COLLIER COUNTY PLANNING COMMISSION(CCPC)RECOMMENDATION: On September
15, 2016, the Collier County Planning Commission (CCPC) sitting as the Environmental Advisory
Council (EAC) recommended approval of PL20160000760, Immokalee Sand Mine, Commercial
Excavation Permit; Ordinance 2010-224/CU-2008 AR-14078 by a vote of 5 to 0 with a recommendation
to forward this petition to the Board for approval.
FISCAL IMPACT: Pursuant to Resolution No. 10-224, the applicant shall reimburse the County
annually the expense incurred by the County for maintaining roadway pavement for those segments of
State Roads 82 and 29 within a two-mile radius of the project entrance.
GROWTH MANAGEMENT PLAN (GMP) IMPACT: There is no growth management impact
associated with this Executive Summary. A comprehensive analysis of this project was conducted by
staff during the Conditional Use application.
ENVIRONMENTAL ISSUES: Offsite hauling of excess fill, if done properly, will have no
Environmental impact. Pursuant to the conditions of Resolution No. 10-224, an updated listed species
survey has been provided.
LEGAL CONSIDERATIONS: Petitioner is requesting a Commercial Excavation Permit under
Section 22-110 of the Collier County Code of Laws and Ordinances. The attached staff report
and recommendations of the Planning Commission sitting as the Environmental Advisory
Council are advisory only and are not binding on you. All testimony given must be under oath.

The Petitioner has the burden to prove that the proposed Commercial Excavation is consistent
with all the criteria set forth below, and you may question Petitioner, or staff, to satisfy yourself
that the necessary criteria have been satisfied under Section 22-110(d) of the Collier County
Code of Laws and Ordinances. Should you consider denying the Petition, to assure that your
decision is not later found to be arbitrary, discriminatory or unreasonable; the denial must be
based upon competent, substantial evidence that the proposal does not meet one or more of the
listed criteria below.
Criteria for Commercial Excavations
(1) The excavation will not interfere with the natural function of any sanitary, storm or
drainage system, or natural flow way, whether public or private, so as to create flooding or public health
hazards or jeopardize the functions of the natural resources and environment of Collier County.
(2) Dust or noise generated by the excavation will not cause a violation of any applicable
provisions of this article. Rock crushing operations or material stockpiles that will be adjacent to any
existing residential area may require separate county approval.
(3) The excavation will not adversely affect groundwater levels, water quality, hydroperiod
or surface water flow ways. The county manager or his designee may require the applicant to monitor the
quality of the water in the excavation and adjacent ground and surface waters. Under no circumstances
shall the excavation be conducted in such a manner as to violate Collier County or applicable State of
Florida water quality standards.
(4) The excavation will be constructed so as to not cause an apparent safety hazard to
persons or property.
(5) The excavation does not conflict with the growth management plan or land development
regulations adopted pursuant thereto,nor does it conflict with existing zoning regulations. Special criteria
and approval procedures may be necessary for projects within the Big Cypress Area of critical state
concern.
(6) In cases where a wetland is no longer capable of performing environmental functions or
providing environmental values or in cases where it is determined that no reasonable alternative exists
other than disrupting a wetland, certain alterations may be allowed, except as otherwise authorized
through previous county review processes.
(7) Flow of water within and through preserved wetlands shall not be impeded.
(8) Appropriate sediment control devices (hay bales, silt screens, etc.) shall be employed to
prevent sedimentation within the wetland pursuant to the design requirements of Section 10.02.02 of the
Land Development Code. Any building site adjacent to a wetland and elevated by filling must employ the
same erosion control devices.Fill must be stabilized using sod, seed,or mulch.
This item is approved as to form and legality, and it requires a majority vote for Board approval.-

WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as are necessary for the protection of the public; and
a.WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance No. 2004-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County, among which is the granting of Conditional Uses; and
WHEREAS, the Board of Zoning Appeals (Board), being the duly elected constituted
Board of the area hereby affected, has held a public hearing after notice as in said regulations
made and provided, and has considered the advisability of a Conditional Use of a sand mine
within a Rural Agricultural Zoning District with a Mobile Home Overlay and Rural Land o
Stewardship Area Overlay (A-MHO-RLSAO), pursuant to Subsections 2.03.01.A.1.c.1 and 0
4.08.06.B.4.b. of the Collier County Land Development Code on property hereinafter described, o
and the Collier County Planning Commission has found that the granting of the Conditional Use
will not adversely affect the public interest and the specific requirements governing the
Conditional Use have been met and that satisfactory provision and arrangement have been made
concerning all applicable matters required by said regulations and in accordance with Subsection o
10.08.00.D. of the Land Development Code; and -6

in a public meeting assembled and the Board having considered all matters presented.

Consulting, Inc. and John M. Passidomo, Esquire of Cheffy Passidomo, P.A. representing
Cemex Construction Materials Florida, LLC, with respect to property hereinafter described in
Exhibit "A", be and the same is hereby approved for a Conditional Use for an earth mine within a

CONDITIONS OF APPROVAL
Immokalee Sand Mine
CU-2008-AR-14078
1. Excavation uses within the Immokalee Sand Mine facility shall be limited to that which is
depicted on the six-page site plan set, identified as the "Conceptual Conditional Use Plans
for Immokalee Sand Mine" dated May 2008, with revisions on May 14, 2009, prepared by
RWA, Inc. The site plan noted is conceptual in nature for Conditional Use approval. The
final design must be in compliance with all applicable federal, state and county laws and
co
regulations; and73
2. Land Development Services Director may approve minor changes in the location, siting, or
height of buildings, structures, and improvements authorized by this conditional use as well
as all applicable development standards; and

3. Expansion of uses identified and approved within this Conditional Use approval, or major a
changes to the approved plan, shall require the submittal of a new conditional use
application in compliance with all applicable County ordinances in effect at the time of ft 1
submittal, including Chapter 10.02.03, of the Collier County Land Development Code,
Ordinance 04-41,as amended; and w

4. Prior to any vehicular use of the site, the owner shall post two (2) signs along the entry
drive, clearly visible to vehicles entering and leaving the site, providing information E
regarding potential panther presence and notifying drivers of the need to use caution. Sign
wording, placement and size will be subject to review and approval by Collier County
Environmental staff. The owner shall submit, and receive approval of, the proposed signage
plan in conjunction with the first to occur of either the Site Development Plan process or
other local development order as may be required which may allow vehicular use of the site; N
and
5. Upon completion of the mining activities, the littoral zone and plantings described on Sheet 6 p
of 6 of the Conditional Use Plans, entitled "Turn Lane Details and Cross Sections," shall be
constructed; and
6. Development of the site shall be subject to compliance with the project phasing plan,
"Immokalee Sand Mine Conceptual Phasing Plan," sheet 1 of 1, prepared by RWA, Inc.,
dated April 2010; and
7. Hours of operation shall be limited to 6:30 am to 7:00 pm Monday thru Saturday for
trucking, and 24 hours Monday through Sunday for excavation and processing; and

CU-2008-AR-14078
a. LDC Section 6.06.02 addresses the construction of sidewalks adjacent to property
frontage on county or state roads. Also, applicant (or owner) may be required to
reserve, dedicate, or convey portions of the property adjoining the SR-82 right-of-
way to FDOT in connection with the widening of SR-82. The following stipulations
shall apply to address these related issues: .17
(1) The owner(s), his successors in title, or assign agree to reserve thirty-five feet
(35') of right-of-way along the Northerly side of SR-82 for approximately 1,190 vi
feet along the property's frontage. The boundaries of this reservation shall
coincide with the preferred alignment shown in Florida Department of
Transportation's (FDOT) current Project Development and Environmental E
(PD&E) Study. The owner(s), its successors or assigns, agree to cooperate with
FDOT during the design process for SR-82, endeavoring to eliminate the need
for the additional 35 feet by allowing conveyance of off-site stormwater run-off, a
which may be accomplished via dedication of an easement within this project, at
no cost to the County or State, if needed. If the need for additional right-of-way
cannot be reasonably eliminated(as determined by FDOT),then the owner(s), its
successors or assigns, agree to dedicate up to 35 feet of right-of-way along the
North side of SR-82 to the State of Florida at no cost. The applicant shall provide
compensating right-of-way at no cost of up to twelve feet (12') width and up to
460 feet in length (including taper), for a westbound right-turn lane at the Project
Entrance; and

(2) The applicant's responsibility for construction of sidewalks (or providing o
payment in lieu) LDC Section 6.06.02 is limited to those portions of the property
that are directly adjacent the SR 82 right-of-way when the project SDP/SIP is

is issued, whichever occurs first. In the event portions of the property that are
presently adjacent to SR 82 are hereafter reserved, dedicated, or conveyed to
Collier County or the State of Florida in connection with the widening of SR-82
(including dedications, conveyances, or reservations for water management) —as
described in Paragraph l.a., above, such reserved, dedicated, or conveyed
portions of the property shall not be subject to the sidewalk construction
obligation under LDC Section 6.06.02, and shall not be considered part of the SR
82 road right-of-way for purposes of calculating applicant's sidewalk obligations
for the remaining portions of the property (i.e., the dedicated, conveyed, and
reserved portions of the property shall not be deemed as "adjacent" right-of-way
with respect to the balance of the property for purposes of calculating applicant's
sidewalk obligations). Given that the actual right-of-way reservation and/or
dedication needs for the widening of SR-82 are not known at this point,
calculation of the payment in lieu option for sidewalks shall be deferred until SIP

permit, whichever comes first. The applicant shall also have the option of
constructing a sidewalk or sidewalks at another location in Collier County as
may be agreed to by Collier County Transportation staff, provided the cost of
construction of said sidewalk or sidewalks is at least equal to the amount of the
payment in lieu option for the Immokalee Sand Mine Conditional Use (as c
adjusted to account for any dedications, conveyances, or reservations of the
property in connection with the SR-82 expansion); and

b. During the life of the mine, the applicant shall reimburse the County annually the
expense actually incurred by the County for maintaining roadway pavement for
those segments of State Roads 82 and 29 within a two-mile radius of the project E
entrance. The purpose of this stipulation is to ensure that the County does not incur —_
out-of-pocket pavement maintenance expenses associated with the use of said
segments of State Roads 82 and 29 by applicant's haul trucks. Alternatively and in a
lieu of the foregoing, should the County adopt a maintenance fee that is uniformly
applied to previously approved and pending mining projects to compensate for 7
impacts to roadway pavement caused by mine truck traffic, applicant agrees that this
project will be subject to such fee. In the event of a dispute regarding the amount of

maintenance reimbursement expense claimed by or paid to the County, the parties
shall first use the County's then-current Alternative Dispute Resolution Procedure 5
before filing any action in any court. E
c. Applicant shall be fully responsible for designing, permitting, and constructing a
westbound acceleration lane at the project entrance on SR 82 for vehicles leaving the 0
project. The west-bound acceleration lane will be up to twelve feet (12') in width
and up to one thousand, six hundred and seventy feet (1,670') in length (including
taper) and otherwise comply with FDOT standards; and

The applicant requests approval of a Commercial Excavation Permit.The proposed Commercial Excavation
is not part of an approved subdivision within the meaning of the Collier County Land Development Code

GEOGRAPHIC LOCATION:
The subject site is located in Sections 6&7,Township 46 South,Range 29 East,and is located on the north
side of State Road 82, approximately 1.5 miles west of State Road 29 in Immokalee. The project site is
approximately 890 acres in size.
PURPOSE AND DESCRIPTION OF PROJECT: cn
The applicant wishes to commence operation of a commercial excavation which will process 70 million
cubic yards of material on site and haul processed materials off site.The excavation activities will be phased

over what is anticipated to be a 30-35 year period of time.

SURROUNDING LAND USE AND ZONING:
The surrounding properties to the east,south and west are Zoned Agricultural with a Mobil Home Overlay
and a Rural Stewardship Area Overlay(A-MHO-RLSAO).The surrounding properties contain active crop
farms.The property to the north is also an active farming operation and is located in Hendry County. Z.1

HISTORY AND PERMITS:
The Conditional Use to allow earth mining on this site was approved on November 9,2010 by Resolution
No. 10-224. On June 18,2012,an extension pursuant to House Bill No.7207 was approved by the Growth
Management Department extending the Conditional Use.On August 6,2015,a Temporary Use Permit was IT;
issued on this project to begin some preliminary site improvements. A Site Development Plan application
(PL20150001727)was filed on November 4,2015, and is currently under review. -o
GROWTH MANAGEMENT PLAN (GMP)CONSISTENCY: co
Ordinance 2010-224 found the Conditional Use for Commercial Excavation at this site to be consistent with
the goals,objectives and policies of the GMP.

FUTURE LAND USE ELEMENT(FLUE):
The subject property is consistent with the FLUE.
TRANSPORTATION ELEMENT: a.
Transportation Planning staff has reviewed the proposed Commercial Excavation and has approved the
project subject to the conditions of Ord. 10-224. co
CONSERVATION AND COASTAL MANAGEMENT ELEMENT(CCME):
Environmental Planning staff has reviewed this petition and has approved the petition subject to the To
conditions of Ord. 10-224. An updated Listed Species Survey has been provided as required by the
Conditional Use approval.
ANALYSIS:
Staff has completed a comprehensive evaluation of this petition including the criteria upon which a
recommendation must be based. Section 22-110 of the Collier County Ordinance of Codes and Laws cTo.
specifies the requirements for a Commercial Excavation permit. The specific criteria is as follows:
(1) The excavation will not interfere with the natural function of any sanitary, storm or drainage system,
or natural flow way, whether public or private, so as to create flooding or public health hazards or
jeopardize the functions of the natural resources and environment of Collier County.
Staff has reviewed the Site Development Plan associated with this Excavation Permit and has verified that

this excavation will not interfere with the natural function of any sanitary, storm or drainage system, or

the functions of the natural resources and environment of Collier County.
(2)Dust or noise generated by the excavation will not cause a violation of any applicable provisions of this a)

article. Rock crushing operations or material stockpiles that will be adjacent to any existing residential
area may require separate county approval.

Currently,there are no residential areas within 1 mile of the site.
(3)The excavation will not adversely affect groundwater levels, water quality,hydroperiod or surface water
flow ways. The county manager or his designee may require the applicant to monitor the quality of the
water in the excavation and adjacent ground and surface waters. Under no circumstances shall the
excavation be conducted in such a manner as to violate Collier County or applicable State of Florida water
quality standards.

Staff has determined that the excavation will not adversely affect groundwater levels. Water held in the
excavation pit will leech through the pit walls and back into the aquifer.
(4) The excavation will be constructed so as to not cause an apparent safety hazard to persons or property.

Staff has determined that the contractor will be required to follow OSHA guidelines with respect to the
mining operation.
(5) The excavation does not conflict with the growth management plan or land development regulations
adopted pursuant thereto, nor does it conflict with existing zoning regulations. Special criteria and
approval procedures may be necessary for projects within the Big Cypress Area of critical state concern.

(6) In cases where a wetland is no longer capable of performing environmental functions or providing
environmental values or in cases where it is determined that no reasonable alternative exists other than

The developer has prepared a Conservation Easement over the only area of the site which is considered a
wetland.

(7)Flow of water within and through preserved wetlands shall not be impeded

The Conservation Easement is located in the northeast portion of the site and will not be impeded by the
mining activities.
(8) Appropriate sediment control devices (hay bales, silt screens. etc.) shall be employed to prevent
sedimentation within the wetland pursuant to the design requirements of Section 10.02.02 of the Land

Development Code. Any building site adjacent to a wetland and elevated by filling, must employ the same
erosion control devices. Fill must be stabilized using sod, seed, or mulch. 0

Staff has reviewed the Site Development Plan which accompanies this Commercial Excavation Permit and

In your application accepted on December 30, 2011, you requested an extension of this project
pursuant to the provisions of Chapter 2011-139 Laws of Florida, House Bill No. 7207, Section
73. That action, passed during the 2011 legislative session, can extend the expiration To
(termination) date of local government-issued development orders or building permits for up to a^
two years.
This project received Conditional Use approval on November 9, 2010. According to the Land
Development Code (LDC) Section 10.08.00.E.1, the Conditional Use approval is valid for three o
years from the approval date, i.e.,the petitioner/owner/developer has three years within which to
establish the use approved by the Conditional Use application. Based upon the LDC therefore,
this Conditional Use approval is valid until November 9, 2013. Utilizing Chapter 2011-139, o
