EXECUTIVE SUMMARY
Recommendation to approve an extension for completion of subdivision improvements associated
with Ave Maria Unit 13,Middlebrooke Townhomes (AR10581),pursuant to Section 10.02.05 C.2 of
the Collier County Land Development Code(LDC).
OBJECTIVE: To approve an extension for the completion of subdivision improvements associated with
the Ave Maria Unit 13,Middlebrooke Townhomes.
CONSIDERATIONS: On January 23,2007,the Board of County Commissioners(Board) approved the
final plat of Ave Maria Unit 13, Middlebrooke Townhomes for recording. Section 10.02.05 C.2 of the
Land Development Code requires that required subdivision improvements must receive final acceptance
by the Board within 36 months from the date of the original Board approval, unless extended by the
County Manager or designee, the Board, or general law. The LDC provides that the developer may
request 2 two-year extensions for completion and acceptance of the required improvements, which the
developer has applied for and received. Moreover, the developer received an additional 1 year extension
through an extension via legislation. However, the most recent extension expired January 23, 2015, and
therefore the Board must approve any further extensions because the developer has exhausted its
administrative extension options. The required subdivision improvements have been found to be
substantially complete, and received preliminary acceptance on October 1, 2007. The developer has
requested an extension through January 23, 2017 (two years from the previous expiration date) in
anticipation of completing the remaining improvements within the allotted time.
A Performance Bond is already in place to ensure completion of the remaining improvements such as
the final lift of asphalt and uncompleted sidewalks.
FISCAL IMPACT: The County will realize revenues as follows:

Cost Center: 138327--Land Development Services
Revenue generated by this project: Total: $300.00 Extension Fees
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a
majority vote for approval. -SAS
RECOMMENDATION: To approve the extension application for Ave Maria Unit 13,
Middlebrooke Townhomes, AR-10581, subject to the conditions of the Executive Summary for the
original plat approval on January 23,2007. The new expiration date would be January 23,2017.

Middlebrooke Townhomes", approval of the standard form Construction and
Maintenance Agreement and approval of the amount of the performance security
OBJECTIVE:
To approve for recording the final plat of "Ave Maria Unit 13, Middlebrooke Townhomes", a
subdivision of lands located in Section 8, Township 48 South, Range 29 East, Collier County, 03
Florida, following the alternative procedure for approval of subdivision plats pursuant to i
Resolution 99-199. a�
CONSIDERATIONS:
Engineering Review Section has completed the review of the construction drawings, c2
specifications, and final plat of "Ave Maria Unit 13, Middlebrooke Townhomes". These o
documents are in compliance with the County Land Development Code and Florida State .�
Statute No. 177. All fees have been paid. Security in the amount of 10% of the total cost of the x
required improvements, and 100% of the cost of any remaining improvements, together with a
Construction and Maintenance Agreement for Subdivision Improvements, shall be provided and ti
accepted by the Engineering Services Director and the County Attorney's office prior to the
recording of the final plat. This would be in conformance with the County Land Development o
Code -- Section 10.02.04.
Engineering Services Department recommends that the final plat of "Ave Maria Unit 13, i
Middlebrooke Townhomes" be approved for recording.
FISCAL IMPACT: o
The project cost is $2,446,378.67 (estimated) to be borne by the
developer.

There are no historical or archaeological impacts. If during the course of site clearing,
excavation or other construction activity, a historic or archaeological artifact is found, all
development within the minimum area necessary to protect the discovery shall be
immediately stopped and the Collier County Code Enforcement Department contacted.
LEGAL CONSIDERATIONS:

The County Attorney's Office has reviewed and approved the plat and associated legal
documents.
RECOMMENDATION:
That the Board of County Commissioners approve the Final Plat of "Ave Maria Unit 13,
Middlebrooke Townhomes" for recording with the following stipulations: u,
1. Approve the amount of $2,691,016.54 as performance security for the required
improvements; or such lesser amount based on work completed, and as is approved by the
Engineering Services Department. ,
2. Approve the standard form Construction and Maintenance Agreement, and
a. That no Certificates of Occupancy be granted until the required improvements have
received preliminary acceptance.
b. That the plat not be recorded until suitable security and an appropriate Construction
and Maintenance Agreement is approved and accepted by the Engineering Services
Department Director and the County Attorney's office.
