In short, I work for the same entities that Mr. Pritt identified and work at Mr. Pritt's direction. I have more than four decades environmental permit experience in Collier County. To my experience, the arrogance of the proposed amendments under consideration is striking. Several standard and necessary components of the environmental evaluation process are either missing or largely incomplete. The environmental evaluation/decision process may be summarized by the following steps. • Identify the impact/problem • Evaluate/study the problem • Identify potential solutions • Test potential solutions • Rank potential solutions • Select the optimized solution One of my students wrote a paper on the initial Earth Day in the `70 that included another final component of this process in a politicized decision process. I like to call it political pollution. This box has been checked if you consider proposing many things that are "outside existing guidance/rules". • Evaluate/study the problem This item has been given surficial treatment. For example, the highest quality native preserve is proposed for huge impact and the "native" preserve that is almost exclusively exotics is proposed to be expanded. Compounding the issues with this preserve area is the fact the applicant was required to remove exotic vegetation and install native vegetation as a condition of their original Creekside approval. This did not happen and was not followed up on by relevant County entities. County permits and approvals that have conditions are an item where both parties bear commitment and responsibility. With regard to this particular preserve, neither entity held up their end of the bargain. This does not bode well for commitments made when the same applicant approaches the County for the magnitude of zoning deviations and subsequent communal inconvenience proposed in their current request to the County. The applicant did not do standard listed species surveys. The applicant indicates that applications are in to State and Federal agencies that will require these surveys, but we are apparently do not deem we deserve the same baseline material to evaluate this project. Yet they ask for deviations far beyond what is asked of the State and Federal regulators. My staff and I observed a population of an listed Endangered plant species (T. utriculata) that is not referred to in any project document I have seen. Plant species are not even mentioned in the any discussion of listed species. There are other examples of the "big ask, little decision info provided" syndrome this application exhibits. There are other examples, but I am time constrained, so let us move on. • Identify potential solutions • Rank potential solutions The applicants submittal documents and County review comments do not contain any discussion of alternatives. This could be attributed to oversight or arrogance, I do not know. We are being told there are two alternatives. 1. No change the current development parameters, or; 2. There is ONE alternative and it is the most optimal. There is no discussion of alternative scenarios and the relative merits of each. Much less why the proposed modifications are optimal for both the applicant and the community. For example, perhaps a parking garage for the proposed hotel rather than fill and pave over the only high quality preserve on site. Why not fill the detention pond in just west of the proposed hotel location rather than this high quality preserve to the south of it. Can this be addressed from an engineering standpoint? There are many other potential permutations of site development options that are simply not addressed. Preserve areas appear to be treated as "land banks". Preserve areas are identified, but the majority of excotic plant coverage was lot removed and no native species were planted in the areas dominanted by exotics. These areas were dedicated to no third party such as SFWMD or Collier County. In short, these areas were labled as preserves but treated as land banks. • Test potential solutions • Select the optimized solution Since there are no alternatives presented for comparison, these synapses are moot. A logical progression through the decision process for the applicant, County staff and the community is not possible. There is inadequate information provided. • Do what is politically expedient The fact we are here today operating on an actinically compressed schedule presented with inadequate information to make a logical decision speaks to the fact this component is alive and well. We do not know at this point if it dominates the public interest. The public if in front of you today and will be there going forward. Environmental and Compatibility issues: Creekside CPUD Amendment PL20160001865 4 Oct 2016 As stated in the Morris Depew document dated 8 September, 2016, Arthrex, Inc. Has submitted a request to modify the existing Creekside CPUD approval (Collier County Ordinance 06-51, as amended by Collier County Ordinance 13-23). Creekside is a 106=acre commercial development located on the southwest quadrant of Immokalee and Goodlette Roads in northern Collier County Based following issues have been identified as compatibility concerns for surrounding and proximate residents. Specifically, we find the highest quality Existing Native Preserve Areas are being impacted by the activities proposed in this request while areas without native vegetation are proposed for continued preservation (as native areas) and even for expansion. Moreover, there is no acknowledgment of the presence or abundance of listed species in the applicants application or supporting documents or by County staff. A site reconnaissance of the Native Preserve Areas found a plant identified as Endangered by the State. The relevant policies are listed to facilitate our discussion. Conservation and Coastal Management Element (COME) requirements. A deviation from the LDC provision for off-site retention of native vegetation has been requested by the applicant. The LDC requirement is mirrored in the COME Policy 6.1.1 (10) This policy is summarized below. • CCME Policy 6.1.1 (13) The County shall adopt land development regulations that allow for a process whereby a property owner may submit a petition requesting that all or a portion of the native vegetation preservation requirement to be satisfied by a monetary payment, land donation that contains native vegetative communities equal to or of a higher priority as described in Policy 6.1.1 (4) than the land being impacted, or other approximate method of compensation to an acceptable land acquisition program as required by the land development regulations. The monetary payment shall be used to purchase and manage native vegetative communities off-site. The land development regulations shall provide criteria to determine when this alternative will be considered. The criteria will be based upon the following provisions: a. The amount, type, rarity, and quality of the native vegetation on site; b. The presence of conservation lands adjoining the site; c. The presence of listed species and consideration of Federal and State agency technical assistance. d. The type of land use proposed, such as, but not limited to affordable housing; e. The size of the preserve required to remain on site is too small to ensure that the preserve can remain functional; f. Right of Way acquisitions for all purposes necessary for roadway construction, including ancillary drainage facilities, and including utilities within the right of way acquisition area. The land development regulation shall include a methodology to establish the monetary value, land donations, or other appropriate method of compensation to ensure that native vegetative communities not preserved on-site will be preserved and appropriately managed off-site. • CCME Policy 6.1.1 (13) The County may grant a deviation to the native vegetation retention policy requirements of sub-section 2,4,5,10, and 12 of this Policy, and shall adopt land development regulations to set fourth the process for obtaining a deviation. The regulations shall allow for the granting of a deviation by the appropriate review board after a public hearing, and for the granting of a deviation administratively. The county shall consider the amount and type of native vegetation and the presence of listed species in determining whether the granting of a deviation requires a public hearing or may be granted administratively. The County may grant a deviation if: a. County, Federal, or State agencies require that site improvements be located in areas which result in an inability to meet the provisions of this Policy, or b. On or off-site environmental conditions are such that the application of one or more provisions of the Policy is not possible or will result in a preserve area of lesser quality, or c. The strict adherence to these provisions will not allow for the implementation of other Plan policies that encourage beneficial land uses. Exception Comments Policy 6.1.1 (4) a.
