Agenda 09/13/2016 R Item #16K 2 16.K.2 09/13/2016 EXECUTIVE SUMMARY Recommendation to accept a Second Offer of Judgment in the amount of $99,950 and statutory attorney's fees in the amount of$7,804.50 for a total cost of$107,754.50 as full compensation for the taking of Parcel 141RDUE needed for the widening of Golden Gate Boulevard from Wilson Boulevard to 20th Street East,Project No. 60040. (Fiscal Impact: $32,224.50). OBJECTIVE: To accept a Second Offer of Judgment providing for full compensation owed for the taking of Parcel 141RDUE which was acquired as part of the widening of Golden Gate Boulevard from Wilson Boulevard to 20`h Street East,Project No. 60040 (hereinafter referred to as the Project). CONSIDERATIONS: On July 9, 2015, the County condemned Parcel 141RDUE in the case styled Collier County v. Benjamin Sanchez, et al., Case No. 15-CA-249, and subsequently deposited $75,700.00 into the Court Registry as a good faith estimate of value based on a valid appraisal. Parcel 141RDUE is a 3,325 square foot right-of-way, drainage, and utility easement along Golden Gate Boulevard over and across property owned by Benjamin and Iris Sanchez, hereinafter the "property owners." Included in the good faith estimate was compensation for the property rights taken and severance damages as a result of a reduced setback of 30 feet to the existing residence. The taking also significantly impacted the onsite septic system and driveway configuration. Prior to condemning the property, the County successfully entered into an agreement to purchase Parcel 141RDUE for a total of$96,300.00, subject to closing and subordination of the mortgage interest. As part of the agreement, the County agreed to fund a cure to construct a retaining wall, relocate the septic system and reconfigure the driveway on the Sanchez's property as was approved by the Board on July 7, 2015, Item 16E9., in Change Order#1 to Contract No. 14-6289. The County agreed to construct the cure as part of the construction of the roadway project in order to ensure no delays in the progress of the project and also to avoid conditions on the site that would render the residence uninhabitable if the cure was not implemented in time. A more in depth explanation of the cure is attached hereto as supporting back-up to Change Order#1 to Contract No. 14-6289. Prior to closing, the lender would not subordinate its interest, therefore, forcing the County to proceed with the condemnation of the Parcel and requiring the property owners to hire counsel to handle the eminent domain proceedings and subsequent apportionment of funds with the lender. The County is statutorily obligated to pay reasonable attorney's fees and expert fees incurred by a property owner in defense of an eminent domain suit. Despite the setback in closing, the County agreed to move forward with the cure since it was in the best interest of both parties and the cost incurred by the County in implementing this cure was taken into consideration in negotiating a final compensation figure. On May 19, 2016, the County received an Offer of Judgment for total compensation in the amount of $121,000. On June 14, 2016, the Board formally rejected this first Offer of Judgment since it attempted to compensate the property owners beyond the addition of reasonable attorney's fees and expert costs. After rejection of the original Offer of Judgment, counsel for the property owners submitted a Second Offer of Judgment in the amount of$99,950.00, exclusive of attorney's fees and expert costs. The County Attorney's Office and staff are recommending acceptance of the Second Offer of Judgment, since a better result is not anticipated at trial and since the parties have yet to expend additional costs on experts to defend the compensation award. If accepted, the Board will be obligated to pay the following Packet Pg. 3341 16.K.2 09/13/2016 additional costs over the amount currently on deposit in the Court Registry: Additional Compensation Due: $24,250.00 Statutory Attorney's Fees: $ 7,804.50 Clerk's Deposit Fee: $ 170.00 Total Additional Compensation: $32,224.50 Upon approval by the Board, the County Attorney's Office will file a Stipulated Final Judgment incorporating the terms of the Offer of Judgment and payment of funds as authorized by this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this item. FISCAL IMPACT: Funds in the amount of$32,224.50 will be paid from gas taxes and/or impact fees from Golden Gate Blvd. Project No. 60040. The primary funding source for the acquisition of right-of- way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. The parent tract of this parcel is improved with a single-family home with an existing front yard set-back from Golden Gate Boulevard of o only 75 feet. The necessary right-of-way (ROW) acquisition for this project reduces the set-back to 30 feet, significantly impacting the functionality of this parcel's driveway, septic system and G drainfield. In most instances, the property owner is compensated for these impacts with funds sufficient for them to implement a cure to fix the issue. Many times the property owners elect to co keep the monies awarded and not implement the proscribed cures, since in most circumstances c these impacts and cures do not materially impact the habitability of the.property by the owner. In this case, however, the impacts are so severe that the home would be rendered uninhabitable if z6 not implemented. Collier County ROW Section has had recent experience in which agreed/settled cures were not implemented by property owners causing delays/confusion upon w the commencement of road construction and hardship to the property owners who had otherwise o spent the allocated funds or no longer had the time to implement the cures. In an effort to avoid 0 these problems and to save money on possible litigation, County ROW staff pro-actively approached the property owner in an effort to coordinate a cure as part of an overall settlement of C CD the parcel. The owner was receptive and cooperative. Through discussions with engineering and Pa construction experts, it was determined that the only feasible cure would require re-configuration a of the driveway in a way that would allow the property owner to utilize a portion of the proposed c ca roadway easement and a re-alignment of the existing drainfield and septic tank within the o reduced confines of the front-yard setback. This agreed upon cure evolved over several months and involved lengthy negotiations with the property owner. This specific curative proposal evolved over time and the final decision to utilize the roadway Contractor for this work took place after the Request for Proposal (RFP) for the roadway project itself was solicited, and was not included in the roadway -0 Contractor's original contracted scope of work. 0 While the construction costs for the roadway project are increased by directly implementing the cure, it is more economical for the County to perform the work with our roadway Contractor by avoiding litigation related costs (attorney fees, expert fees, engineering reports and studies, settlement premiums) and will be possible to avoid paying the property owner indirect a. construction costs to implement the cure. Moreover, the County will have assurance that the curative work is completed in a timely manner, without interference to the roadway Contractor's work, while avoiding any possible claims. The County also would avoid the risk that no cure is implemented and the home becomes uninhabitable. r U The Change Order #1 proposal from Ajax Paving (roadway Contractor) for this cure a encompasses the surveying, geo-technical, design, permitting, project management, construction, inspection and certification of a new on-site waste disposal system (septic tank and drainfield), removal of the existing on-site waste disposal system and usage/ maintenance of the existing system as a temporary disposal system during this construction, FDOT index retaining wall with residential finishes, concrete hammerhead driveway to allow the property owner to exit their property onto the new highway, and final grading, sodding, and mowing. The total cost for this Change Order #1 is $75,085.78 which has been negotiated with the Contractor from an original o price of approximately $125,000. The pricing has been reviewed by staff, analyzed and approved by a staff Professional Engineer (see attached memo), and vetted with multiple levels of County government, including the County Attorney's Office.
