Agenda 09/13/2016 R Item #16A24 16.A.24 09/13/2016 EXECUTIVE SUMMARY Recommendation to approve final acceptance and unconditional conveyance of the water and sewer utility facilities for Seneca at Talis Park,PL20140001965, and to authorize the County Manager, or his designee, to release the Final Obligation Bond in the total amount of $4,000 to the Project Engineer or the Developer's designated agent. OBJECTIVE: To have the Board of County Commissioners, as Ex-Officio Governing Board of the Collier County Water-Sewer District, approve final acceptance and unconditional conveyance of these water and sewer facilities and to release the Final Obligation Bond in the amount of$4,000,in accordance with the Collier County Utility Standards and Procedures, Ordinance No. 2004-31. CONSIDERATIONS: 1) The Developer of Seneca at Talis Park, has constructed the water and sewer facilities within dedicated easements to serve this development. 2) Preliminary acceptance of these utility facilities was approved by the Development Review Division staff on October 23, 2014. At that time, the value of these water and sewer utility facilities (assets) was $70,002.73 and$33,154.48,respectively. 3) Staff recorded all preliminary utility conveyance acceptance documents in the public records of Collier County, which were reviewed and approved by the County Attorney's office as to form and legality. The County acquired its record interest by Utility Facilities Warranty Deed and Bill of Sale recorded in Official Records Book 5243, at Page 3707, as affected by Utility Facilities Quit Claim Deed and Bill of Sale recorded at Official Records Book 5269, at page 3612, all of the Public Records of Collier County,Florida. 4) The water and sewer utility facilities have been operated and maintained during the required one (1) year warranty period, following preliminary acceptance. 5) A final inspection to discover defects in materials and workmanship has been conducted by the Development Review staff on April 20, 2016, in coordination with Public Utilities and these facilities have been found to be satisfactory and acceptable. 6) Staff recommends final acceptance of the subject utility facilities and to release the Final Obligation Bond in the total amount of$4,000. 7) This final acceptance is in accordance with Collier County Ordinance No. 2004-31,as amended. 8) Staff is unaware of any issues that would serve to negate the recommendation to release the applicable security. FISCAL IMPACT: Approval of this Executive Summary will have no specific financial impact. However, approval of this Executive Summary will result in the Collier County Water-Sewer District receiving unconditional title to the utility facilities, which at the time of preliminary acceptance, had a total gross value of$103,157.21 (no depreciation applied).
