16.F.1 09/27/2016 EXECUTIVE SUMMARY Recommendation to approve a Release of Lien for Lucy Zuniga/Lucy Salon, Inc. due to the impact fees being paid in full in accordance with the Agreement for Fee Payment Assistance Program and the Amendment to Agreement for Fee Payment Assistance Program. OBJECTIVE: To approve a Release of Lien for Lucy Zuniga, Lucy Salon, Inc. CONSIDERATIONS: On November 29, 2005, the Board of County Commissioners (Board) approved an application by Lucy Zuniga/DBA Lucy Hair Design to participate in the Fee Payment Assistance Program in order to offset impact fees related to the construction of a new hair salon in Immokalee, Florida. The applicant proposed to create five new, full-time jobs at or above 50% of the private sector average wage($16,367). On December 22, 2006, a Fee Payment Assistance Agreement was executed between the Board and Lucy Zuniga in the amount of $18,527.78, which was secured by a lien on the property. Two extensions moving the target date for creation of the five jobs to December 31, 2000, were subsequently approved by the Board, due to permitting and construction delays. Five jobs were created; however, due to ongoing economic difficulties and staffing issues, Ms. Zuniga was unable to meet the wage requirements of the Program and Agreement. Therefore, the balance of the Fee Payment Assistance Funds was due to the County in the amount of$17,292.52, which includes credit for one year of Program compliance. Because of ongoing economic difficulties, Ms. Zuniga requested that the repayment of these funds may be made in 10 equal payments. On October 25, 2011, the Board executed an Amendment to Agreement for Fee Payment Assistance Program between Lucy Salon, Inc., formerly known as Lucy Hair Design, for repayment of the funds to be made in ten equal bi-annual payments of$1,729.25, commencing January 15, 2012. The Amendment provided for a mechanism for the County to recoup the outstanding portion of its investment while providing Ms. Zuniga the opportunity to operate her business. On June 30, 2016, the final payment was made and the funds have been repaid in full. Staff and the County Attorney have prepared a Release of Lien for approval by the Board and signature by the Chairman. The document will be recorded in the public records of Collier County. FISCAL IMPACT: Impact fees were paid on behalf of the applicant from funds specifically budgeted in the Economic Development budget of Fund 001 and all payments have been returned to Fund 001. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. The payment of impact fees via the Fee Payment Assistance Program will constitute a lien on the Property which lien may be foreclosed upon in the event of non-compliance with the requirements of this Agreement, or should any of the representations set forth in the Application be untrue or unfulfilled. The amount specified in this Agreement will serve as the amount of a lien against the Property. Neither the payment of impact fees nor this Agreement may be transferred, assigned, credited or otherwise conveyed without the prior written approval d from the County,which approval may be freely withheld. o 6. On Owner's request, and at the County's sole option, the County's interest may be a). subordinated to all first mortgages or other co-equal security interests. The County's interest will automatically be subordinate to the Owner's previously recorded first mortgage and/or any cn government funded affordable business loan such as the U.S. Small Business Administration (SBA) or the U.S. Department of Agriculture(USDA)loan. 7. This Agreement will expire 15 years after the first certificate of occupancy has been issued for the Property. Should the entire balance not be then paid, the County will be entitled to recover all fees and costs, including attorney's fees, incurred in enforcing this debt. 5. This Amendment and its provisions merge any prior agreements, if any, between the parties with respect to the matters set forth in this Amendment. 6.
