Minutes 02/18/2014 (unsigned) CLAM BAY COMMITTEE MEETING MINUTES PELICAN BAY SERVICES DIVISION TUESDAY,FEBRUARY 18,2014 The Clam Bay Committee of the Pelican Bay Services Division met on February 18,2014 at 1:00 PM at the Community Center at Pelican Bay located at 8960 Hammock Oak Drive,Naples, Fl. APPROVAL OF THE JANUARY 21 MEETING MINUTES Mr. Cravens motioned,Mr. Domenie seconded to approve the January 21 meeting minutes as presented. The motion carried unanimously. DISCUSSION OF THE LATEST DRAFT OF MANAGEMENT PLAN The latest draft of the management plan was reviewed page by page and changes were suggested that would be incorporated in the next draft of the document. Mr. Dorrill was concerned with including work that was not mandatory to the plan because this obligated the Services Division to do the work and also has budget implications. UPDATE ON CANOE TRAIL SIGNS AND POSTS Mr. Hall reported that the coastal zone management department is working with the supplier and the contractor of the canoe trail posts the supplier did not admit to any wrong doing however they are giving them 15 new posts and the contractor is coming to install them over the next few months at cost which the county is paying for the county is also paying for the contractor to wrap all 32 posts with PVC to protect them from future damage from boring beetles. UPDATE ON NO WAKE/SLOW SPEED ZONE SIGNS IN CLAM BAY Mr. Hall reported an update on the no wake/slow speed zone signs in Clam Bay. As far FWC is concerned,the County's ordinance is not legally enforceable. Therefore,the Services Division cannot replace these signs without being subject to fines. Mr. Hall provided the Florida statute pertaining to no wake/slow speeds that provided the criteria for a local municipality to enact a new ordinance for the different types of speed control or exclusions and the conditions required to do so. Mr. Hall also provided an exhibit to show where the Services Division could petition the County to do a new ordinance allowing for the idle speed/no wake or slow speed minimum speed designation in those portions of the waterways that basically controls the Pass and the channels between the bays;however,there are no vessels that require idle speed or slow speed within the bays. On the exhibit, yellow indicated idle speed within the waterways and near the boat ramp. The blue is the slow speed area. 56 Clam Bay Committee February 18,2014 Mr.Dorrill asked Mr. Hall about vessel exclusion zones and whether the Pass meets the designation as a public beach swimming area. Mr. Hall said the problem is if vessels are excluded from the Pass the Seagate homeowners would have to be paid for their losses. Mr. Dorrill said it was worth evaluating.
