RIGHT OF ENTRY
KNOW ALL MEN BY THESE PRESENTS that SOMERSET AT WINDSTAR
HOMEOWNERS ASSOCIATION, INC., a Florida not-for-profit corporation, whose
mailing address is 1016 Collier Center Way, Ste. 102, Naples FL 34110, hereinafter
known as Grantor, for and in consideration of Ten Dollars ($10.00) and other valuable
consideration to it in hand paid, does hereby grant unto the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY
OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE
COLLIER COUNTY WATER-SEWER DISTRICT, whose post office address is 3335
Tamiami Trail East, Suite 101, Naples, Florida 34112, as Grantee, the temporary
license and right to enter upon the lands of the Grantor, for the express purpose of:
Facilitating construction of wastewater facilities, such as modification of existing
pumping station and associated gravity sewer mains and force mains.
ALL RIGHT AND PRIVILEGE herein granted shall terminate one year beyond
the official acceptance of the public improvements by the Board of County
Commissioners of Collier County, Florida, or on completion of the project, whichever
occurs first for the property described in Exhibit "A."
THIS PROPERTY IS NOT GRANTOR'S HOMESTEAD
ADDITIONALLY, the rights and interest conveyed hereunder are conditioned
upon the reasonable exercise thereof by Grantee. Grantee agrees not to unreasonably
interfere with Grantor's use of the lands described in Exhibit "A". Grantee further agrees
that it shall, at Grantee's cost, repair any damage caused to Grantor's property as a
result of Grantee's negligence.
IN WITNESS WHEREOF, Grantor has caused these presents to be executed in
