7/12/2016 16.D.16. EXECUTIVE SUMMARY Recommendation to approve the Disadvantaged Business Enterprise(DBE) Goal for FY 17, 18, and 19 to ensure that DBE's have an equal opportunity to receive and participate in Federal Transit Administration assisted contracts by ensuring nondiscrimination in their award and administration. OBJECTIVE: To ensure that DBE's have an equal opportunity to receive and participate in Federal Transit Administration assisted contracts by ensuring nondiscrimination in their award and administration. CONSIDERATIONS: The Department of Transportation Disadvantaged Business Enterprise (DBE) program applies to projects funded from traditional Department of Transportation (DOT) sources. It was established to ensure non-discrimination in the award of state and federally funded contracts. The goal of the DBE program is established to remedy past and current discrimination against disadvantaged and small business enterprises, ensuring a "level playing field" in which DBE's can compete fairly for DOT and Federal Transit Administration(FTA) contracts. Collier Area Transit(CAT), as a grantee of both the Department of Transportation and the Federal Transit Administration, is in the triennial process of establishing its goal for its DBE program. The final goal will be in effect for the next three years(Fiscal years 2016/17,2017/18, 2018/19). Collier Area Transit is proposing the following Disadvantaged Business Enterprise (DBE) goal for applicable professional, consulting, construction, and procurement contracts during Fiscal Years 17, 18, and 19 beginning October 1, 2016 and ending September 30, 2019. The overall total DBE goal being proposed will be 1.60%of the DOT and FTA contracts each fiscal year. The proposed Goal is currently available for public comment until August 9th; and will be submitted to Federal Transit Administration (FTA) Civil Rights Office for their review and approval at the conclusion of the public comment period. The proposed DBE Goal is being provided to the BCC prior to the conclusion of the public comment period in order to meet FTA deadlines and provide them sufficient time for their review. The proposed goal will be considered the final DBE Goal unless substantive public comments are received. If necessary a revised Goal will be brought back to the board for approval of revisions. FISCAL IMPACT: No fiscal impact is associated with this item. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. —JAK GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary RECOMMENDATION: That the Board of County Commissioners approves the proposed DBE Goal for FY 17, 18, and 19. Collier Area Transit's Disadvantaged Business Enterprises Goal FY 2017-2018-2019 DISADVANTAGED BUSINESS ENTERPRISE (DBE)PROGRAM GOAL SETTING PROCESS FY 2017-2018-2019 The Collier County Board of County Commissioners (BCC) has established a Disadvantaged Business Enterprise (DBE) program in accordance with regulations of the U.S. Department of Transportation (DOT), 49 CFR Part 26. The BCC has received Federal financial assistance from the Federal Transit Administration (FTA), and as a condition of receiving this assistance, the BCC agrees to comply with 49 CFR Part 26. It is the policy of the BCC to ensure that DBE's as defined in part 26, have an equal opportunity to receive and participate in FTA-assisted contracts. The BCC will not exclude any person from participation in, deny any person the benefits of, or otherwise discriminate against anyone in connection with the award and performance of any contract covered by 49 CFR part 26 on the basis of race, color, sex, or national origin. In administering its DBE program, the BCC will not, directly or through contractual or other arrangements, use criteria or methods of administration that have the effect of defeating or substantially impairing accomplishment of the objectives of the DBE program with respect to individuals of a particular race, color, sex, or national origin. The Goal setting process contained in this Attachment to Collier County's Disadvantaged Business Enterprise Program outlines the adopted process to determine the relative availability of DBE's to perform the types of contracts anticipated in FY 2017; 2018 and 2019. The purpose of this process is to determine the percentage of all ready, willing and able "Establishments"that are DBE'S and to establish a DBE Goal. U.S. Department of Transportation (DOT), 49 CFR Part 26 establishes a Three Step Process. Each step used by Collier County is outlined below. Packet Page -1208- 7/12/2016 16.D.16. Step 1 Collier County / Collier Area Transit has executed the Florida Unified Certification Program Agreement. 49 CFR Part 26 Subpart E- Certification Procedures Section 26.81, requires that all United States Department of Transportation (USDOT) Recipients participate in a statewide Unified Certification Program. Collier County / Collier Area Transit is committed to operate in full compliance with 49 CFR Part 26, Subpart E. Collier County / Collier Area Transit will utilize certified D.B.E. vendors through the Florida Unified Certification Program Agreement. Collier County / Collier Area Transit expects to have contracting or subcontracting possibilities in the following areas, transit and paratransit services, motor vehicle parts, building contractors, and computer software services. Collier Area Transit staff has reviewed past bidders and contracts to establish a region that includes Collier, Lee, Hillsborough, Miami-Dade, Broward, Palm Beach, Martin, Polk and Orange County. This region was used to indentify DBE and Non-DBE firms willing and able to work in Collier County. Collier Area Transit staff utilized the Florida Department of Transportation Disadvantaged Business Enterprise Online Directory (http://www3b.dot.state.fl.us/Equal Opportunity Offi ceB usinessDirectory/CustomSearch.aspx) for certified DBE vendors in the identified region willing to work in Collier County. Staff identified 2647 ready, willing and able certified DBE's (certified by the FDOT, Equal Opportunity Office, in the Disadvantaged Business Enterprise Directory) in the identified region as of June 15, 2016. Collier Area Transit staff utilized the 2014 US Census Bureau County Business Patterns (http://censtats.census.gov/cgi-bin/cbpnaic/cbpsel.p1) for ready, willing and able TOTAL establishments that currently provide service in our service area. Staff identified 46,089 ready, willing and able TOTAL establishments that currently provide service in our service area. The process used to obtain the percent of DBE's to TOTAL establishments for the potential contract percent is illustrated below. Certified by FDOT UCP Program DBE 2647 = 5.74% Total Potential Bidders 46,089 The percent of DBE establishments by NAICS codes available in the Collier County area is 5.74%. Packet Page -1209- 7/12/2016 16.D.16. To ensure that Step One Base Figure is as accurate as possible, weighting was used to make CAT's goal calculation more accurate. Weighting takes into consideration the type of work and what percent of the total anticipated expenses it will consume. After calculating a base figure of the relative availability of DBEs, evidence was examined to determine what adjustment was needed to the base figure in order to arrive at the overall goal. Historical Collier County DBE participation data for FY 14, 15 and 16 was shown to have a median of 0%DBE participation. An adjusted figure was established utilizing median past participation figure and the base figure of Step 1. The adjusted figure resulted in 1.5765% In order to reflect as accurately as possible the DBE participation that would be expected in the absence of discrimination, the adjusted figure of 1.6% will be used for Fiscal Years 2017, 2018, and 2019. Step 3 Race/Gender-Neutral and Race/Gender-Conscious Split methodology. Staff reviewed the "U.S. Department of Transportation Office of Small and Disadvantaged Business Utilization" guidelines prior to preparing the DBE Goal. The guidelines for step 3 provide assistance in determining what factors to consider in projecting the overall portion of the goal that will be met through race/gender-neutral means. With one exception, the examples are Packet Page -1210- 7/12/2016 16.D.16. based on past participation or experience. As in step 2, this is our ninth plan. Therefore, in determining the race/gender-neutral and race/gender-conscious split, staff used the available data below. In the past we have not received any participation from DBE in the region and consequently was not successful in obtaining our DBE goal " Typically when RFPs are responded to by Prime consultants they automatically consider their favorite DBE and only inform them that they are doing this late in the package submission if forms are to be completed— For SBEs that are never used by these Primes the name of the game is to call the Prime at the "right"time, otherwise Out-of-sight out-of- mind, unfortunately. Since the percentage of the RFP going to DBEs is small it's not a primary concern to Primes. I think you need to give incentive to Primes that reach out early to small professional firms that are not normally used. Share your source of SBEs/DBEs with your Primes. With Primes reaching out to SBEs it builds a more foundational relation verses the other way around. These Primes should submit the names and contact person within these DBE firms that they called or contacted along with the selected DBE within their RFP response package. We at Russell &Associates Engineering are Licensed and Registered Professional Engineers and are primarily Electrical Engineers providing Design and Consulting Services. We do not do installations or put up buildings/construction. We provide design plans for construction. We do not find the DBE program helpful or useful because the implementation and awards are always given to the same Prime and Sub-Consulting firms for professional services. i.e. No effort is made to develop other small businesses by providing the opportunity to show-case their talent and experiences. I formed her it was a notice; she went on to explain that she didn't find being a DBE was beneficial, she is willing to work in Collier but has not won a bid as DBE. She wants to be informed of any bids for Design work. 6/21/2016 DBE Firm: Naples Paving Inc Contact Person: William Lawrence County: Collier Spoke to William regarding the letter sent to him via email about the DBE Goal being proposed for CAT William was calling to inform CAT that his company is available for work in Collier County. I let him know it was a notice that CAT was setting a goal; I also gave him information on the type of work CAT proposes to conduct in the future. He said he hasn't been successful on his bids as a DBE and finds being a DBE is very unproductive. I let him know we would work with the Purchasing Department to make sure the DBE's are aware of any work being placed out for bid. Packet Page-1234-
