EXECUTIVE SUMMARY Recommendation to grant final acceptance of the public roadway and drainage improvements in the Tract A-1, Black Bear Ridge, Phase 2, and the rights-of-way known as Wolfe Road and a portion of Pristine Drive as conveyed and recorded in OR Book 4981, Page 133, OR Book 4869, Page 2896, and OR Book 4655, Page 1761, with the roadway and drainage improvements being maintained by Collier County. OBJECTIVE: To have the Board of County Commissioners (Board) grant final acceptance of the roadway and drainage improvements in Tract A-1, Black Bear Ridge Phase 2, and the rights-of-way known as Wolfe Road and a portion of Pristine Drive, as conveyed and recorded in OR Book 4981, Page 133 and OR Book 4869, Page 2896, with the roadway and drainage improvements being maintained by Collier County. CONSIDERATIONS: 1) A portion of the Pristine Drive right-of-way was dedicated to the County as Tract A-1 on the Black Bear Ridge, Phase 2 plat(and further conveyed via Quitclaim Deed recorded in O.R. Book 4655, Page 1761), and the Wolfe Road right-of-way and another portion of Pristine Drive right- of-way were conveyed via Warranty Deeds to the County recorded in O.R. Book 4981,Page 133, and O.R. Book 4869,Page 2896. 2) Section 5.7.M. of the Wolfe Creek PUD, Ord. 13-37, and Section F.2.F of the Palermo Cove PUD, Ord. 13-38, required the developers to convey the subject rights-of-way to the County. The roadway improvements will be maintained by Collier County. 3) On December 12, 2014, the Growth Management Department granted preliminary acceptance of the roadway and drainage improvements in the subject rights-of-way. 4) These sections includes approximately 2850 linear feet of roadway and goes from C.R. 951 (Collier Blvd.) to the entrance of the Black Bear Ridge project, as depicted on the attached location map. Approximately 950 feet of roadway from the entrance of Black Bear Ridge to Vanderbilt Beach Road will be accepted at a future date, at which point the roads will provide a connection from Collier Blvd. to Vanderbilt Beach Road. 4) The improvements have been constructed in accordance with the Land Development Code. The Growth Management Department has inspected the improvements and is recommending final acceptance of the improvements. 5) A resolution for final acceptance of the subject rights-of-way has been prepared and approved by the County Attorney's Office. A copy of the document is attached. 6) Tract A-1 is the only portion of Black Bear Ridge, Phase 2 plat that will receive final acceptance at this time. All other required subdivision improvements for the plat will brought before the Board for final acceptance at a later date, and the subdivision maintenance security will not be released until that time. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval.- SAS RECOMMENDATION: To grant final acceptance of the roadway and drainage improvements in Tract A-1, Black Bear Ridge Phase 2, and the rights-of-way known as Wolfe Road and a portion of Pristine Drive, as conveyed and recorded in OR Book 4981, Page 133 and OR Book 4869, Page 2896, with the roadway and drainage improvements being maintained by Collier County. and authorize; 1. RESOLUTION NO. 16- A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AUTHORIZING FINAL ACCEPTANCE OF CERTAIN ROADWAY AND DRAINAGE IMPROVEMENTS IN TRACT A- 1, BLACK BEAR RIDGE PHASE 2, AND THE RIGHTS-OF- WAY KNOWN AS WOLFE ROAD AND A PORTION OF PRISTINE DRIVE, AS CONVEYED AND RECORDED IN OFFICIAL RECORD BOOK 4869, PAGE 2896 AND OFFICIAL RECORD BOOK 4981, PAGE 133, AND ACCEPTANCE OF THE MAINTENANCE OBLIGATIONS. WHEREAS, the final plat of Black Bear Ridge, Phase 2, was recorded on October 5, 2006 in Plat Book 47, Page 40 of the Official Records of Collier County; and WHEREAS, a portion of the Pristine Drive right-of-way was dedicated to the County as Tract A-1 on the Black Bear Ridge, Phase 2 plat, and the Wolfe Road right-of-way and a portion of the Pristine Drive right-of-way were conveyed to the County, as recorded in Official Records Book 4981, Page 133, and Official Record Book 4869,Page 2896; and WHEREAS, the subject rights-of-way were conveyed to the County pursuant to development commitments in the Wolf Creek PUD, Ordinance No. 13-37 and Palermo Cove PUD, Ordinance No. 13- 38; and WHEREAS, the Growth Management Department on December 15, 2014, granted preliminary acceptance of the improvements within the subject rights-of-way; and WHEREAS, the Developer has constructed and maintained the roadway and drainage improvements in accordance with the approved plans and specifications as required by the Land Development Code (Collier County Ordinance No. 04-41, as amended); and WHEREAS, the Developer is requesting final acceptance of the roadway and drainage improvements; and WHEREAS, the Growth Management Department has inspected the roadway and drainage improvements, and is recommending acceptance of said facilities. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby granted for those roadway and drainage improvements in Tract A-1, Black Bear Ridge Phase 2, and Wolfe Road and a portion of Pristine Drive, as described in O.R.
