Each PARAB member was introduced to Mr.Ochs and gave a brief description of their background and why they were serving on the Board. VII. SPECIFIC UPDATES: Mary Ellen Rand inquired about Bluebill—whether there would be any improvements in the lane across the bridge or how people were going to get from the bridge to the south side of the road. ' Joe Delate responded saying that as part of the PUD requirements the access across the bridge has to be widen for a sidewalk as well as bike lanes all the way over to Gulf Shore Drive. At the present time the proposal is for a two-lane road with bike lanes and sidewalks on each side. This is not the final plan but is what is being proposed. VIII. OLD BUSINESS: None IX. REPORTS/UPDATES A. MONTHLY REPORT—no questions. 1 I C B. BCC RECAP: The numbering system of the Executive Summaries was explained. The number"8"indicates that it is an item on the regular agenda to be discussed by the Board of I Commissioners and if approved the recap indicates so. The number"16"is an item that was put on the consent agenda. These items are approved as a package in one vote. The commission may pull an item and have it placed on the regular agenda for discussion,if so Idesired. Ms.Rand inquired about the Growth Management Plan report—were there any amendments or changes and is it done annually. Updates are done-annually because the I facilities have a price tag attached to them which changes from year to year as well as the acreage per population and capital dollars. There has not been a policy or objective change in at least three years. IRequest to go back to specific updates by Lisa Barnett—any reports on the dog park? Evaluation sheets from the site have been positive and complimentary. A few requests have been made,such as more benches and a water fountain for people. There is a lot of action in the I evening hours—between 6:30 and 7:30—with an average of 45 to 50 dogs plus the owners. During the first two weeks 6,000 doggy bags were used. Several people have inquired about a pool for the dogs,not a shower but something the dogs could get in and cool off in the afternoons I and in the summer. Some dog owners are pro to having a water source to wet the dog down and others are anti because they don't want to take the dog home wet. These items will be discussed under new business at the next meeting. IC. SPECIAL EVENT CALENDAR June 15th will be a Teen Summer Event—carnival with music,dancing,food and beverages at I the Golden Gate Community Center. July 15— Party at the Sanctuary—East Naples Community Park IAugust 5—Beach Splash Bash @ Sugden Regional Park August 18—Teen Dance—Golden Gate Community Center I September 17—Teen Concert D. PARKS UPDATE—Joe Delate Clam Pass—Boardwalk construction staging has started. Boardwalk re-decking will begin approximately June 1. Eagle Lakes Park—Plans for lighting the second soccer field and additional lighting at the playground are 90%complete. IGolden Gate Community Park Walkway—we are calling it the Golden Gate Greenway—it will connect our community park to 951. Purchase underway with two property owners for easements as well as a 5 acre tract within for a small passive park. Phase II pathway within Ithe park should be finished by October 1. Immokalee Soccer Field Lighting—proceeding with that project. I Max Hasse Park—Preliminary architectural and site plans will be shown next month. I 2 .ism. w.. I 0 0 North Naples Regional Park—BCC approved design contract with Belnor,Herbert as the lead. I Pelican Bay Park—working with the croquet and lawn bowling group. Request for Proposals for design re-configuration of that facility are out. I Tract 179 Neighborhood Park in Golden Gate—Michael McGee,landscape architect will be designing the park. Sugden Park Phase II design is almost completed. _ I Tigertail—received City of Marco variance approval for coastal construction line variance and currently awaiting DEP approval. IExotic Removal—Pelican Bay beach access,Vanderbilt Beach parking area,and Cocohatchee Park completed. Bayview should be done by the end of June;951 Coast Guard area(near Marco bridge)—bids due on Friday. Palm Springs Park and East Naples are next, I with Sugden Park ongoing. South Marco Beach access renovation—received DEP approval permit. The adjacent developer is going to pay for the upgrade of a paver path and a small plaza all the way to the I beach. Veterans Park—soon be bidding for the roof on the hockey rink. I . Vineyards parking lot—working with the School Board and the project will be coordinated with the Transportation Department as they are going to widen Vanderbilt Beach Road. I951 Boat Ramp—site has been re-paved,a guardrail added and the curb stops installed. The project is done with the exception of a few signs and maybe a tree or two. I Clam Pass—remarks by Marla Ramsey. Clam Pass parking lot will be closed during the construction work at this site. The Department is working with WCI to obtain some overflow parking at a gravel area site which would hold approximately 10-15 vehicles. If that site is I not available,the Registry will allow us to use their 29 space parking lot between their tennis court on Seagate on the weekends. We could then use our 15 passenger van to shuttle down to the Seagate access point. I Conner Park -article in newspaper today saying that 111th Avenue will not be four—lane. If true,the only change needed to be made to Conner Park would be curbing. The article was not clear what would happen at the intersection. 11 Pelican Bay Park—The Department is obtaining a price on the design and the"group"will provide the funds. They do have that much funding available right now and we are ready to proceed. I 951 Coast Guard Site—the building has been demolished and the site is now being used by I jet skiers as a launch site. The Department has had conversations with the Florida Department of Transportation regarding the Jolly Bridge. We hope when the bridge is designed that they will help do something under the bridge—a walkway to connect the two areas to make that into a small park area. It may be a jet ski only,boat launch facility or a Ifishing pier—nothing is definite,but the Department would like to be involved in the process. Ms.Rand requested a tour of the parks in the Marco area. This will planned for July. 3 gismarionummemir C Ilir 0 E. ADOPT A PARK REPORT: Mr. Olesky Immokalee Community Park—parking light and some walking lights out, playground lights out I for the second month in a row. There is a net out in the center court on the basketball court. All the parks are improving in looks. ISports complex—some lights out in parking lot. South Park—three security lights have been out since the park opened. The light on the playground is out as well as the one that shines off part of the playground and the basketball court I Dreamland Park—security light out. X. PARAB MEETING SCHEDULE Next meeting will be at Cocohatchee River Park on Vanderbilt Drive. Chairman Grice will be on vacation and Ms.Barnett will chair the meeting. I XI. NEW BUSINESS A. Caxambas Dog Park Speaker: Sandy Lee from Marco Island I Ms.Lee is the owner of two small dogs and has traveled to Veterans Park a number of times to use Rover Run. She would like to see a similar facility in the front area,of Caxambas Park, which is grassed and has some shade trees. I Regarding doggy showers at Rover Run—it sounds like a great concept but the area is mostly sand. When the dogs get into the water and sand they will be filthy,and in turn so will their owners. I Speaker: Robert Lee Mr.Lee thanked everyone for Rover Run and remarked that everyone there is dog friendly. I The park does get warm because there is not a great deal of shade. Caxambas already has the trees,a fence and grass,so it should not be a huge expense to developed. ' There are not too many parks on Marco. Frank Mackie Park has a large lake with a trail around it. It would be nice to walk your dog there,but there are also ducks and birds,as well as play areas for children. Sometimes the smaller dogs are an attraction for the children and they wish to pet the animal. We want a place for our own and our dogs enjoyment. In place of dog showers you could build a small agility course. That is fun for the dogs. Dogs are important—they are used at airports to keep birds off the runway. IChairman Grice: When Rover Run was established it was to be a trial park—the results were to be examined at ' the end of the year. I think we will keep the site in mind but table this matter until the time comes when we will be considering expanding the dog parks. Mr. Olesky: I was down there today and I think that you might have a problem with parking I as this is a boat launching facility. I 4 Annurouimirmor I IP t 44. 4111 IMs.Ramsey: We have approximately 60 acres right next to Manatee Elementary School and were originally talking about putting the dog park there. However,there is a lot more expense involved because a road would have to be constructed to get across the canal,but it does have I trees. If Caxambas doesn't work out to be the ideal space this would still be fairly close for Marco Island residents. I MOTION BY Mr.McMahon: To table this about the doggy park for a six-month period and then re-look at it. Seconded: Ms.Barnett. Motion passed. B. EVERGLADES CITY -�- ISpeaker: Fran Tiff—representing Everglades Community Fireworks Fund I $18,000 is being requested for the year 2001. Everglades City does not hold its firework display on the 4th because they get more fireworks for their money on another day. This year it will be July 2nd and the event is for an entire day—parade,boat races,river races,games, etc. and the fireworks in the evening. This year$8,000 provides twelve minutes of I fireworks,but the committee would like to increase the amount of time next year. It is becoming more difficult every year to raise money for this event. (The County pays$25,000 for 20 minutes of fireworks on the eat Sugden.) I Speaker: Judy Brown Ms.Brown works for the City and is also on the committee. The display at Everglades is ' attended by approximately 600 people and because you are so close to it people say it is the best. We are asking for help because we have a lot of people come who live outside of Everglades City,which probably has about 350 people living there. We do appreciate all you have done for our community and if you don't give us any money,thank you anyway for what Iyou have done in the past. MOTION by Mr.Olesky: That we give Everglades City up to$8,000 in matching money for their fireworks display. (If they raise$5,000,we give 5,000; if they raise 8,000 we give 8,000.) This is for the year 2001 and it is not an ongoing commitment. o• Motion passed 6 to 1,Mr.Welborn opposing. This item now has to go to the Board of County Commissioners for final approval. ,4 1 MEETING ADJOURNED FOR FIVE MINUTES AND SET-UP TIME FOR PRESENTATION C. BEACH AND BOAT RAMP REPORT—Ms.Ramsey IThis is a five year plan that staff has put together to deal with the access and boat ramp issue in Collier County. The Growth Management Plan for Recreation and Open Space talks about I a goal we have to provide sufficient parks and recreation facilities and open space areas to meet the needs of the residents and visitors of Collier County. We have six objectives that we deal with but tonight we are going to discuss Objection 1.3,which is to continue to ensure that the public developed facilities and open spaces and beaches and public water bodies are Iaccessible to the general public. I am going to do the presentation and then open for questions from the Parks and Recreation Advisory Board. Then when they have fmished the public may speak. You should have Iregistered as you came in if you wished to speak. You will be allowed five minutes at the podium for comments. 5 I 0 Beach Parking Boat Ramp Expansions: We have proposed boat ramp and expansions, proposed canoe launches,parking garages,beach parking expansions,a proposed boardwalk, ferry services and then some future services. I 1. There is a parcel of land approximately 350 linear feet by about 75 linear feet,owned by DEP,and used by FDOT as a staging area,at SR951 and Isle of Capri.. We think this I site could accommodate 25 to 30 parking spaces,there would be a crosswalk at the corner to cross 951 and then one could continue to walk to the existing boat ramp. Projection date of 2001 and 2002. I 2. 951 boat ramp—currently has 19 spaces recently resurfaced and redone. Expansion could take place to the north and possibly south of the existing ramp area,which would add 45 parking spaces. FDOT is willing to provide an easement. A permit from the DEP I is necessary for filling that location. If all this is possible,the time line would be approximately 2002,2003 fiscal year. The expansion to the north would provide better access into the boat ramp area because of the traffic light. There would defmitely be a left turn coming from the north on to 951. 3. Goodland—There is a 4.5 parcel that we think could accommodate 50 parking spaces and two boat ramps with deep water access. There are marinas on either side that could I accommodate the fueling and bait needs. This area would be similar to our Bayview boat ramp area—a small playground area,restrooms,and picnic shelters. This would be a nice addition for Goodland as there are no parks there. This would accommodate their park needs and expand our property for boat launch facilities. I4. Rte 92 towards Goodland—at the old bridge location there is a little pull off area which appears to be a nice place to canoe/kayak. There could be picnic tables installed as Ipeople pull off there for lunch now. Time line on this would be 2003,2004 Beach Parking I Items to be discussed are a 275 space Vanderbilt parking garage in the year 2001,2002;Barefoot Boardwalk Ferry Service,2004(yesterday BCC reviewed this project as a petition from the public to try and move that up on the five year plan);Conner Park has 80 spaces which is currently being built;and Seagate parking expansion at the Seagate Boulevard area. Each access is an intricate I chain of things that the Department wants to do over a period of years to enhance access to the beaches themselves. I1, Vanderbilt Beach. This access is 51,000 square feet. Using the National Parks and Recreation guideline of ' 50 sq ft/user, we came up with 1,020 users right at the end of our cul-de-sac. This location provides access to 3.7 miles of beach,from Clam Pass to,but not including,the State Park. An actual body count on Easter weekend indicated that when the current lot of 125 parking spaces is full,it is accommodating 255-300 people. A typical beach parking lot will turn over three times I during the day,showing that somewhere around 900-1,000 people use that location. The proposed garage would add 275 spaces at that location. People know if they wait that area turns over quite often so they drive around and around. I We think by adding the spaces it will take people off the roads,get them into a parking spot,and will reduce the amount of traffic at the cul-de-sac area. The proposed time line is 2001,2002. I This garage would be very similar to the Ritz Carlton garage that is currently there and although it is called three story that includes the ground floor. The estimate for this exact design is 3.8 million,and the funding source being looked at is the Tourist Development tax. I 6 111 Agmbiermoiraumr IIP tr 0 I 2. Barefoot Beach Boardwalk Ferry Service. This is a thousand linear foot boardwalk into the Back Bay. There would be access to our I existing restroom facilities and ferry service could be provided by a concessionaire. Educational interpretive programs into the Back Bay and along the mangrove area could be given. Time frame 2004,but could be moved up to 2001. Funding source is the I impact fees. We have had the public come forward and commit approximately$100,000 toward this project. The concessionaire we have at Cocohatchee can make that trip in about thirty minutes. This is being viewed as a tourist type of thing,geared toward interpretive programs on the way up and back. --- I We are also trying to secure some additional land across the road from the Cocohatchee River Park to ensure enough parking for cars. I 3. Barefoot Beach Parking Lot Expansion. The green space between the parking lots could provide 75 additional parking spaces and would join the two lots together. The restroom facilities may need some improvements to accommodate the additional people. Proposed time line is 2003. I 4. Conner Park—a five acre linear park off of Bluebill Avenue. There are 80 planned spaces with walking access to Wiggins State Park. The developer adjacent to the park is responsible for improvements on the bridge area. Completion date is approximately December of this year. Funding is TDC. I5. Seagate Parking Lot—WCI has asked to take over our existing parking lot so they may expand an existing building. They are going to build the County a new parking I lot in exchange. When they are fmished with their enhancements at the end,they will turn their staging area into twelve additional parking spaces for us. Completion 2002. The new parking lot will be completed before they take the old one away. IFUTURE 1. Parking garage probably at Clam Pass. 2005 or 2007. Outside of five year time- frame. ' 2. Access Points on Gulf Shore Boulevard North—we have three public access points that are only accessible by bikers or walkers. We are looking at using the parking I areas that we have at both ends,the parking garage with 400 spaces,and the 80 spaces at Bluebill—and having a shuttle drop people off at these locations. First we would have to enhance the accesses—maybe a bench area with little covered bus stops. Once we were comfortable with the quality that was being done there,shuttle I service could be offered to off-site locations such as Barefoot. This is all a long way out. IPARAB QUESTIONS: Q. Ms.Rand: Concessionaire that is going to do the ferry—can you limit the charge? i A. It will go out for bid,they would give their best price and we would work with them. IQ. I mean the fare. 1 7 1 I 0 ( IA. The fellow with the Cocohatchee Nature Center has been talking about a possible $6.50 fare,do the interpretive along the way,and bring them back. IQ. So you have two different people using the same facility to do two different things. A. Yes. Some other locations are already ferrying their people to the tip of the pass I at Barefoot. Although there are no facilities at that location we know there is ferry service happening. Our goal is to concentrate people in certain locations rather than all the way through the end of the preserve area itself. The preserve area is owned by the State and managed by the County This area is very natural I and we are trying to enhance and preserve the integrity of that location as part of our management plan. IQ,. Mr.Olesky—are you going to try and use electric engines rather than gas? A. We have not gone into that much detail yet but we can look into it. IQ. Chairman Grice: What is the purpose of the dock and ferry service into Barefoot? A. Part of the concern is that we hear it is a long way to drive to Barefoot. This I would shorten that trek and maybe pull some people that maybe would normally go to Vanderbilt to Barefoot. Q. Mrs.Rand: All the parking right now would be at Cocohatchee unless you can Iarrange additional parking? A. Right. I MEETING OPEN TO PUBLIC SPEAKERS (9 REGISTERED SPEAKERS) First Speaker Lou Newman followed by Al Newman. Questions were answered so declined to Ispeak. Speaker: Pat Lucci: Questioned the number of parking spaces—presentation was 275 and paper said 430. P. r. A. There are currently 125 parking spaces. 275 will be added. I Q. At approximately 900 people utilizing the beach it would be crowded. It is now during season. NRPA's formula shows that from the access point down to the Ritz would accommodate IA. 1,020 people. That does not take into account anything going to the north. Statistics show that people will walk about a quarter of a mile,which is 1,300 linear feet. There is about 600 linear feet from the access to the Ritz. If you take the center of the access and go 1,300 linear I feet in either direction,there is a lot more space on the beach. This is raw data,not taking into account the quality of experience once the patron is there. Then if the shuttle dropped people off at the access points the Vanderbilt access would have a better experience. I Q. 80 cars will be able to park at Conner park? It is a long walk from there to the beach, particularly carrying something. It will be a while before there is shuttle service? ' A. Yes,there will be 80 spaces, and it will be awhile for shuttle service. If the shuttle were to work both ends,then it would be more cost efficient. Every shuttle trip increases the ad Valorem tax;we have to ensure a quality experience or people will not use the shuttle. There 8 1C 0 Iare some things to be considered—can they get off the beach in a timely manner during a thunderstorm,etc. I Q. Will there be any particular parking areas for county residents. A. That is one of the concerns. There are fewer people in each car,so families are driving two I cars to the same location. Maybe only one beach parking sticker per residence could be issued,then if two cars came from the same family the second would pay the fee. I don't understand why we could not designate resident parking only. ' SPEAKER: Carol Timbers Q. Which parking lots are you speaking about joining? Number 1 and 2 is a good choice if it has I to be. We are concerned about the trail in the Preserve. The exotics were cut down but all the debris is along the trail. The second thing is the gamma derma which is affecting the palm trees that has been started but not fmished. And the third is protecting the gopher tortoises. There are fewer at that location than at the further end. Are you going to increase the I restroom facilities and bring in a oncession? Because of the previous concession,people expect one to be there. A. That has to be looked at. When the usage gets high enough to warrant concessions,we will I bring them back. ISPEAKER: Erica Synne Q. The statistic 50 sq feet per person is 7 feet by 7 feet—not much space. Who set that standard? I A. National Recreation and Park Association—it is from the open space and green way guidelines nationally. IQ. Can the density be lowered if we wish? A. Yes. Remember the garage is for the future when we want to move shuttles down into other access areas,which is what the public seems to desire. IQ. Can a decision be made for some beach areas to have a higher quality/space per person? I A. Yes in the preserve areas we are doing that now. Q. Can it be done at Vanderbilt—please consider it when making your plans. The recent survey was Easter showing 2.03 people per vehicle—has a count been done during the high season? I Are there any traffic studies to show that traffic will be decreased in the area? Some people think that the garage will increase the number of cars causing more traffic congestion. A. We have no transportation data or statistics at the moment. The garage may allow people to get off the street quicker. A survey can be done on a full weekend—asking people how long they waited to get a space,how many times and where they drove around. I Q. I would also like local resident parking. Has Dovin Cole(phonetic)been consulted about the garage? A. Yes,in depth discussions have been held and it is being put into their study to be looked at. SPEAKER: Hank Fay 1 9 , 1 I C 0 I Q. Let's not use the Jones Beach standard here,we would not enjoy it. I am pleased to hear about the beach access points of Gulf Shore—where are they located and do they belong to the County? A. They are opposite of the roadway,and I can show it to you on the plans. They are 10 foot wide and we wish to enhance them so they can be used by walkers and bikers as well. j I Q. I do not think you can plan a parking garage without the transportation department and community development folks. Is this what is happening? I A. I am trying to secure funds for the garage;once the funds are secured we will talk about the spaces,looks,etc. I Q. I think it will make the traffic a lot worse. Maybe there should be two big parking lots over near the trail with a shuttle. Another thing to consider is these access points—should County take another ten feet and make more access points open? I agree the garage has to be part of a total package but not the first step. I think it should be the result of an entire study with other Idepartments all working together. SPEAKER: Bobbi Hickman IQ. Is there a difference between the space allowed per person at the Preserve or a County Park? A. Yes,it is a lower density,but even more so on the Preserve area section. I Q. There is a lower parking lot in the Preserve that has never been filled. Is there really a need for this new parking lot? I A. Again,it is down the road but is an option in the Management Plan that it can be done as needed. I Q. It seems as if another lot is not necessary—naturally the lot near the restrooms fill up first. We keep taking away the natural part and losing the purpose of the whole thing. SPEAKER: Dick Lydon IQ. The people in the area are not trying to keep people off the beach as it has been mentioned in the newspaper. What about the people that walk to the beach. Where do they go? I think it is I a great idea to put that boardwalk across but you may have trouble getting$6.50. The other question is Barefoot Beach. Nobody can get on the beach because of the Lee County people and they come onto our beach. The people want to come to Vanderbilt and don't want to drive to Barefoot. If there is no space at Vanderbilt,then maybe they will consider going to Barefoot. Now the LaPlaya is going private and trying to sell a thousand memberships. Look at all the traffic that will create.Before you start using those beach accesses you had better talk to the folks that live across the street because those three belong to those people in those I places. All we ask at Vanderbilt is to sit down,talk to us,let us take a look and we might have an honest and reasonable idea. SPEAKER: Vera Fitzgerald IQ. I think the garage will increase traffic at the turnaround—father will drop the family off there with all their belongings and then drive the car to the garage. We are going to build this garage for three months a year usage? By your calculations there will be 400 spots rolling over 3 times per day,so that's 1,200 vehicles going down and then coming back,which is 2,400 vehicle I 10 I trips per day. Why can't shuttles be paid for by tourist tax instead of ad Valorem? Why can't we look more closely at remote parking areas and use the shuttle service. Sam's is empty is half the time. During season is the only time there is a parking problem. Naple Park home ' owners did a search and there were six accesses but the BCC gave one away. Mary Ellen Rand: We need to look at the entire beach front in the County,long range,in terms ' of developing more opportunities for access and to create a system to do that. Instead of building a garage now I would like to see a small scale shuttle service start to at least serve Conner Park. Maybe the shuttle that is going to shuttle Seagate might be able to go around and pick up at another location with no more than a 15 minute wait. I think people would rather take a shuttle and have a pleasant experience at the beach than to be able to park and go to a very crowded area. Ski Olesky: You would probably have to have at least four shuttles if you wish them 15 minutes apart. Then you would have to pay Sam's. With a garage the expense is mostly up front. Marla Ramsey: May I suggest staff look into contacting Sam's,determine cost of shuttles, number of drivers,benefits, etc.,look at the quality of the experience and bring it back to you at ' your next meeting? In early 1994, Kevin Hendricks researched for the Parks and Recreation Department (Gary Franco) the four (4) 10' wide "Easement for Public Walkways" that were platted and dedicated by the Conners Vanderbilt Beach Estates. Kevin requested a legal opinion from the Office of the County Attorney as to the wording and/or phrasing of the dedications. I have enclosed copies of both Kevin's Request For Legal Services and Heidi Ashton's response. She opined that these "walkways" were indeed public access points and were accepted by the County. The map I have enclosed labels these four access points in yellow highlighter with the adjacent properties that abut the easements hand written to the left of each access point. In addition, the County also has two other access easements that provide access from Gulf Shore Boulevard to Vanderbilt Beach. A Declaration of Easement was recorded in OR Book 832, Page 207 (copy attached) and is an access easement that is located just north of the Mansions at Vanderbilt Beach Condos. Another access easement is situated to the south and was conveyed by the Sea Chase Condominiums. It is recorded in OR Book 2011, Page 2253 (copy attached). These two easement locations are highlighted in orange on the map enclosed. If we can be of any further assistance, please do not hesitate to call. The plat recorded in Plat Book 3, Pages 8-9, which depicts the four "easements for public walkways" was recorded by the Clerk on February 2, 1953. The deed of restriction which contains the restrictive covenants against operating and maintaining a public beach in the identified area was filed on February 19, 1953. Therefore, the use of an access easement was in place prior to the deed restriction and there does not appear to be a conflict between the plat and the deed of restriction. 2. Even if the deed was recorded first, the deed restricts the operating and maintaining of a public beach. The proposed use of the easement is for beach access and not for operating or maintaining a beach within the walkway area. 3. The installation of a reasonable sized ramp at the end of the walkway does not appear to expand the use of the easement beyond what was contemplated at the time of conveyance of the easement. The installation of this ramp will make the beach more easily accessible by both the handicapped and the non-handicap- ped, which is consistent with the intent of the American Disabilities Act. 4. In this case, the label "easement for public walkway" on the platted map constitutes an offer to dedicate the easements to the County and the County accepted the easements by placing beach access signs within the easements. This legal opinion is intended to supplement and follow-up on the informal opinion rendered by Assistant County Attorney Melissa A. Vasquez on June 5, 2000 (memorandum attached).' The specific question is whether TDC funds may be used for a Tiger Tail Beach concession facility and for a parking garage to be constructed at Vanderbilt Beach. It is my opinion, consistent with that of Melissa, that Section 125.0104(5)(a)4, Fla. Stat., authorizes said TDC funding. Section 125.0104(5)(a)4 Fla. Stat., provides as follows: To finance beach park facilities or beach improvement, maintenance, ance, renourishment, restoration, and erosion control, including shoreline protection, enhancement, cleanup, or restoration of inland lakes and rivers to which there is public access as those uses relate to the physical preservation of the beach, shoreline, or inland lake or river. In counties of less than 100,000 population, no more than 10 percent of the revenues from the tourist development tax may be used for beach park facilities. The statute does not define "beach park facilities". In the absence of a statutory definition, the plain and ordinary meaning should be used. AGO 94-12 at p. 1342. I have been informed by you that the concession facilities and the parking garage will primarily serve the users of the beach. Obviously, a large percentage of the users of the beach are tourists. Recent Attorney General Opinions emphasize that it is the local governing body that must make the factual determination of whether a particular facility or project is related to tourism and primarily promotes such a purpose. This determination should be based on appropriate legislative findings and due consideration of the specific needs and ■ conditions of the particular locality. AGO 98-74 at p. 249. RECEIVED Jai o J PARKS&RECRII—rs='','V� 0 Two other points should be mentioned in order to complete the analysis of the question submitted. First, AGO 91-62 opined that Section 125.0104(5)(a)4 Fla. Stat., (1990 Supp.), did not authorize the use of tourist development tax revenues for the repair, construction or improvement of boat ramps and parking facilities. However, this opinion is distinguishable because it was based on the statute as it appeared in 1990 which did not have the language authorizing the use of tourist tax revenues for "beach park facilities". The second point is that Heidi Ashton, Assistant County Attorney, has informed me that contact with Representative Livingston's office has indicated that part of the reason for the statutory amendments was to allow for the funding of beach park-facilities related to areas such as Lover's Key in Lee County. In summary, tourist tax funds from the appropriate category under the ordinance may be used to finance "beach park facilities" such as a concession facility at Tiger Tail Beach and the construction of a parking garage at Vanderbilt Beach. From a study of weather and playing conditions in our country it has been determined that, in general, courts built south of the 38th degree parallel,a line which runs approximately through Louisville, Kentucky,are playable on a twelve month year-around basis. Courts north of the 38th degree parallel are considered non- playable for approximately four to five winter months of the year due to cold weather.Therefore, because of the summer sun angle during standard time, at approximately 3 p.m.to 4 p.m.,outdoor courts north of the 38th degree parallel can be oriented directly true north-south.This will allow good playing conditions during the summer months from mid to late afternoon. Outdoor courts built south of the 38th degree parallel, however, are considered generally good for play all year around. By a careful analysis of sun angles at both equinox times in mid-March and mid-September, between 3 p.m. and 4 p.m.,when it is assumed that most tennis is played, and taking into account the fact that about 85%of the players are right-handed, it has been determined that the most comfortable angle for court setting is 22°south-east and north-west for the length of the court off true north-south.This can even be increased to 30°off north-south for courts built in the extreme southern areas of the United States. The first courts known to be oriented 22°south-east and north-west were constructed in Houston about 35 years ago. Observation of these and other courts south of the 38th parallel at both equinox times show no shadow of the net on either side of the court between 3 p.m. and 4 p.m.,which indicates that each side of the court has equal sun angles,which is assumed to be the ideal outdoor playing condition with respect to sun glare affecting either side of the court more than the other. As the sun moves lower(south) in the winter months and higher(north)in the mid-summer months,the sun glare angle will be slightly more on the respective sides of the courts, but not enough to materially produce excessive glare. On the other hand, if an outdoor court were laid out exactly north-south in the southern part of the United States,the intense glare from the sun in the mid-winter months between 3 p.m. and 4 p.m.would seriously affect right-handed players on the north court by their having to look directly into the suns rays as they face the south court, and would make playing conditions extremely uncomfortable. The final orientation of the tennis court is also affected by the cost of construction relative to the substantial slope of the land,zoning requirements and/or the owner's wishes.The need to orient a tennis court in a predominant east-west direction may exist in order to fulfill the construction criteria for the tennis facility, but it should be recognized that a predominant east-west orientation may substantially impair the usability of the facility.
