SECTION TWO: FINDINGS OF FACT
The Board of Count)' Commissioners of Collier County. Florida. hereby makes the follox~'ing
findings of fact:
I. Collier Count)'. pursuant to Sec. 163.3161. et .sea.. Fla. Stat.. the Florida I.ocal Government
Comprehensive Planning and Land Development Regulations Act (hereinafter the "Acf'). is required to
prepare and adopt a Comprehensive Plan.
2. After adoption of the Comprehensive Plan. the Act and in particular Sec. 163-3202( I ). Fla.
Stat.. mandates that Collier Count)' adopt land development regulations thal art.' consistent with and
implement the adopted comprebensive plan.
3. Sec. 163.3201. Fla. Stat.. provides that il is the intent of thc Act that the adoption and
enforcement by Collier Count)' of land development regulations tbr the total unincorporated area shall be
based on: be related to. and be a means of implementation for. the adopted Comprehensive Plan as
required by the Act.
4. Sec 163.3194~1)(b). Fla. Stat.. requires that all land development regulations enacted or
amended by Collier Count)' be consistent with lhe adopted Comprehensive Plan. or element or portion
thereof, and an)' land development regulations existing at thc time of adoption which arc not consistent
with the adopted Comprehensive Plan. or element or portion thereol: shall be amcnded so as to be
consistent.
5. Sec. 163.3202~3). Fla. Sial.. slates that the Act shall be construed to encourage thc use of
innovative land de,'elopment regulations.
6. On Januar)' 10. 1989. Collier County adopted the Collier County Growlh Management Plan
(hereinafter the "Growth Management Plan" or "GMP"I as its Comprehensive Plan pursuant to thc
requirements of Sec. 1634.3161 et seq. Fla. Stat.. and Rule 9J-5. F.A.C.
7. Sec. 163.3194(!)(a). Fla. Stat.. mandates that after a Comprehensive Plan. or clement or
portion thereof, has been adopted in conformity v;ith the Act. all development undertaken by. and all
actions taken in regard to development orders by. governmental agencies in regard to land covered by such
Comprehensive Plan or element or portion thereof shall be consistent with such Comprehensive Plan or
element or portion thereof.
8. Pursuant to Sec. 163.319413ffa). Fla. Stat.. a development order or land development
regulation shall be consistent with the Comprehensive Plan il' the land uses. densities or intensities, in the
Comprehensive Plan and if it meets all other criteria enumerated by the local government.
9. Section 163.3194(3}(b). Fla. Stat.. requires that a development approved or undertaken by
a local government shall be consistent with thc Comprehensive Plan il' thc land uses. densities or
intensities, capacity or size. timing, and other aspects of development are compatible with. and furtber
objectives, policies, land uses. densities or intensities in thc Comprehensive Plan and il' it meets all other
criteria enumerated by the local government.
10. On October 30. 1991. Collier County adopted thc ('oilier County l.and Development Code.

retention filtration and flows areas.
Transportation facility construction sites shall provide Ibr siltation and
runoffcontrol through lhe use of seltling ponds, soil fixing or performance
equix alent strtl¢lures or systems.
Structure installation
Placement of struclurcs shall be accomplished in a manner that will not
adversely affect surface water flow or tidal action.
Minimum Ioxv floor elevation permitted for structures shall be al or above
thc 100-year flood level, as established by thc administrator of thc li:&ral
Flood Insurance Administration. Thc construction of any structure shall
meet additional lbdcral llood insurance land management and usc criteria.
