V. NEW BUSINESS/PRESENTATIONS
a. Award Presentation - Ms. Anne Pappalardo was presented with the
attitude award.
b. Fitness Center Grand Opening March 1, 1999 - Ms. Ruby
stated that the Fitness Grand Opening will be held on March 1, 1999.
Commissioner Constantine will be the Master of Ceremonies and the
Parks and Recreation Advisory Board is welcome to attend.
c. Recreation Supervisor - Steve Peffers - Collier County Parks and
Recreation schedule for the Summer Camp Program Countywide: There
are 10 sites planned in the Naples area to include 4 Community Parks and
' 6 satellite school sites; 2 of these camps are Middle School age camp. The
Summer Program starts June 14 through August 13, 1999 (9 weeks).
Activities include sports, arts & crafts, games, movies, drama, and 2 field
trips per week. Each camp location will have themes for every week.
These themes include Nature Week, Wild Wild West, Back to the Future,
International Week, etc.. Field trips include bowling, swimming, skating
(ice & roller), fun parks, etc.
' The cost for camp is $400 per child for all 9 weeks. A reduced rate of
$350 is charged for each additional child of the same family. Scholarships
will be awarded this spring to families needing financial assistance.
Also, a special needs camp program will be offered for handicapped
children this summer. A one day special event was offered last summer,
but a 3 week camp will be offered in June this year. We are working with
the City of Naples and the School system to organize our efforts. More
' details are still to be developed.
' d. Immokalee Summer Program - Ms. Pappalardo stated that the
summer camp will be held at the Immokalee Community Park and also in
Everglades City. There is a possibility of a drop -in program at South
Immokalee Park for the summer.
e. Upcoming Special Events - Ms. Ruby updated the Parks and
' Recreation Advisory Board on upcoming events. The events for Spring
and Summer are as follows:
' • Friday, March 26, 1999, X-Treme Games For Teens; to be held at the
Golden Gate Community Center

• May 8, 1999, 2nd Annual, Royal Palm Jazz & Arts Festival, at Sugden
Regional Park.
• June 17, 1999, Teen Carnival, at the Golden Gate Community Center
• June 18-19, 1999, Summer Fest, at the Golden Gate Community Center ect.
4th of July Celebration, at the Sugden Regional Park
A schedule was handed out showing all dates, locations, and times of the
events.
f. Summer Camp Food Program - Mr. Thomas served 47,627 breakfast,
76,266 lunches, and 3,785 afternoon snacks during summer camp last year. Mr.
Thomas is proposing to serve 50,000 breakfast, 80,000 lunches, and 4,000
snacks this summer. An estimated cost of $214,025.00 was reimbursed for the
summer camp food grant.
This year there will be a mandator
y ry meeting which Mr. Jim Thomas will be
attending in Ft. Lauderdale on March 23rd, 1999 for the Summer Camp Food
Grant.

VI. Request for Discussion
a. Copeland Land Purchase - Advisory Board member Ski Olesky,
Annie Pappalardo, and Murdo Smith will take a trip to Copeland to visit
the sites in questions.
'
b. Clam Pass Parking Expansion - Mr. Mueller inquired about the
Clam Pass Parking Expansion project. Mr. Dunnuck stated that at the last
'
meeting a report on Clam Pass Parking Expansion was given.
c. Parks and Recreation Budget - Vice Chairman Grice inquired
'
whether staff will provide the Parks and Recreation Advisory Board with
the Parks and Recreation budget report information.
'
Ms. Ramsey stated that the budget report is an operational issue which
does not involved the Parks and Recreation Board.
VII.Old
Business
'
a. Impact Fee Study - Staff presented the Impact Fee Study in February
with 4 possible options. The Board of County Commissioners narrowed
the decision to two alternatives. The 1st option excluded beach related
levels
of service in impact fees. The Tourist Development fund would
encumber these expenses. The 2nd option is an impact fee that includes
beach parking and park access, but excludes beach park land. Staff is
recalculating costs and will submit a new report in April.
b. Regional Park Update - North _ � Naples Regional nark awaiting
environmental review and will go before the Board of County
Commission in March for final approval.
c. Park Projects Update - Sugden Regional Park - the gazebo is under
construction and will be completed by the end of March. Also the paving
in front of the park around bollards should be completed next week.
Golden Gate Fitness Center iscomplete. The contractors are working on
the final punch list. The final walk through is February 25, 1999.
The South Naples Community Park name has changed to Eagle Lakes
Community Park. Eagle Lakes Community Park project is four (4) weeks
behind schedule. There has been a problem with rocks on the site and
obtaining permits which have caused the delays. We have now obtained

the building permits and this project should progress.

Vice Chairman
Grice stated that he visited the Sugden Regional Park but
he got there near closing time and did not get a chance to inspect the park.
Vice Chairman Grice also visited the East Naples Community Park but the
Sanctuary Park was not open as scheduled. Vice Chairman Grice inquired
if there were a reason why the Sanctuary Park closed early.

Ms. Ramsey stated that she will check with Ms. Rice.
' Ms. Ramsey also stated that Ms. Rice request for the non -compete clause
was a dead issue because she did not show up for the Commission
meeting.

SUBJECT: Beach Parking Ordinance
' PURPOSE:
Currently our beach parking permits are issued based on Resolution No. 95-
543. Putting our policy in ordinance format solidifies our policy.
SUMMARY OF PRESENTATION
ORDINANCE NO. 99-
AN ORDINANCE OF COLLIER COUNTY, FLORIDA, TO REVISE AND
CODIFY THE COUNTY'S POLICY REGARDING EXEMPTION FROM
BEACH FACILITIES PARKING FEES; FINDINGS AND PURPOSE;
APPLICABLE BEACH FACILITY LOCATIONS; BEACH FACILITY
PARKING FEE RATES. EXEMPTION FOR COLLIER COUNTY RESIDENTS
AND PROOF OF COLLIER COUNTY RESIDENCY; COLLIER COUNTY
PARKING CITATIONS; PROHIBITED PARKING AT METERED PARKING
SPACES; PROVIDING FOR INCLUSION INTO THE CODE OF LAWS AND
ORDINANCES; PROVIDING FOR CONFLICT AND SEVERABILITY,
PROVIDING AN EFFECTIVE DATE.
WHEREAS, by adoption of Resolution No. 95-543 on September 26, 1995 , the
Board of County Commissioners of Collier County formally affirmed the County's
policies regarding fees for parking vehicles at the County's beach parking facilities as
specified in that Resolution; and
WHEREAS, The Staff of the County's Parks and Recreation Department has
requested that the Board of County Commissioners revise and codify the policies
regarding exemption from beach facility parking fees for residents of Collier County; and
WHEREAS, the Board of County Commissioners, having reviewed the policies
contained in Resolution No. 95-543, and having considered Staffs recommendations,
agrees with Staff's recommendations and hereby revises and codifies those policies.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. FINDINGS AND PURPOSE.
The Board of County Commissioners makes the following findings of fact:
1. The majority of persons who park vehicles at the County's beach parking
facilities are occupied by persons who are not residents of Collier County.
2. The costs of providing beach parking facilities and of policing,
maintaining and repairing beaches, plus costs to expand parking facilities or construct
new parking facilities are increased as resulting from increasing numbers of vehicles
being parked at those beach parking facilities.
3. The County's beach facilities parking fee is $3.00 per vehicle per day, or
$0.75 per hour at each parking space that is controlled by an individual parking meter.
Over the past three (3) fiscal years these parking fees produced revenues which

reimburse Collier County for much less than eighty percent (80%) of the above -listed
beach facilities expenses.
4. Adoption of this Ordinance is intended to facilitate enforcement of
collection of these beach facilities parking fees.
SECTION TWO. APPLICABLE BEACH FACILITY LOCATIONS.
The beach parking fees apply to the following beach parking facilities within
Collier County. Additional beach parking facilities may be added to this list from time -
to -time by Resolution(s) adopted by the Board of County Commissioners.
a. Barefoot Beach Access.
b. Barefoot Beach Park.
C. Vanderbilt Beach Access.
d. Calm Pass Park.
e. North Gulfshore Beach Access.
f. Tigertail Beach.
g. South Marco Beach Park.
SECTION THREE. BEACH FACILITY PARKING FEE RATES.
The beach parking fees are hereby affirmed to be $3.00 per vehicle per day for parking
spaces that are not metered; and are seventy-five cents ($0.75) per hour per vehicle for
parking spaces that are individually metered. The fees are collected through parking
meters or by direct collection by authorized county personnel.
SECTION FOUR. VEHICLE EXEMPTION FROM BEACH FACILITY
PARKING FEES FOR PERMANENT COLLIER
COUNTY RESIDENTS; PROOF OF COLLIER
COUNTY RESIDENCY.
1. No vehicle shall be exempt from the subject beach facility parking fees at
the specified beach facilities unless the vehicle displays a valid beach parking sticker
issued by the County or by the City of Naples.
2. Each individual who applies for one (1) or more vehicle parking
sticker(s) must be a permanent resident of incorporated or unincorporated Collier
County. Ad valorem taxes assessed against residential units, and other taxes paid by
permanent residents, contribute to partially pay for the County's expenses and the City of
Naples' expenses related to the subject public beach facilities, which taxes are not paid
by persons who are not permanent residents of Collier County. The documentation
required to be issued any such parking sticker(s) by the County shall be Rules of the
Collier County Parks and Recreation Department as approved by Resolution adopted by
the Board of County Commissioners.
SECTION FIVE. RESTRICTED PARKING AREAS
Pursuant to Section FOUR of Collier County Ordinance No. 80-47, as amended, each of
the above -listed "Applicable Locations" is designated as an area where vehicle parking is
restricted to vehicles that display a valid vehicle parking sticker or for which the
applicable beach parking fee has been paid.
SECTION SIX. PROHIBITED PARKING AT METERED PARKING
SPACES.
Pursuant to Section FOUR of Collier County Ordinance No. 80-47, as amended, at each
of the above -listed "Applicable Locations" each vehicle parking space controlled by a
parking meter is an area where parking is prohibited at all times when the parking meter
is "expired."
SECTION SEVEN. COLLIER COUNTY PARKING CITATIONS.
Pursuant to Chapter 89-449, Laws of Florida, as amended, and Resolution(s) that may be
adopted in conjunction with that Special Act, Collier County Park Rangers are
authorized to issue parking citations for each beach facility in accordance with
Ordinance No. 80-47, as may be amended or superseded by subsequent ordinance(s).
SECTION EIGHT. INCLUSION INTO THE CODE OF LAWS AND
ORDINANCES.
The provision of this Ordinance shall become and be made a part of the Code of Laws
and Ordinances of Collier County, Florida. The sections of the Ordinance may be

renumbered or relettered to accomplish such, and the word "ordinance" may be changed
to "Section," "Article," or any other appropriate word.
SECTION NINE. CONFLICT AND SEVERABILITY.
In the event this Ordinance conflicts with any other ordinance of Collier County
or other applicable law, the more restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion.
SECTION TEN. EFFECTIVE DATE.
This Ordinance shall become effective upon filing with the Florida Department of State.

This memorandum is in response to your Request for Legal Services
wherein you have asked essentially the following: Can the County prohibit
persons from handing out pamphlets at a County Park on Marco Island?
' REPLY: The County cannot absolutely prohibit people from handing out
pamphlets at a public park on Marco Island. A public park owned or operated by
the County is a "traditional public forum." Handing out pamphlets is called
"leafletting." Leafletting is not "solicitation." Solicitation is asking the recipient
of the handout to then and there hand something back to pamphleteer, often
' money. If the County wants to restrict leafletting at public parks, it must enact an
ordinance to do so. Each such restriction is subject to the highest scrutiny and
1 each restriction must be based upon evidence presented to the Board of County
Commissioners whereby the BCC can reasonably conclude that each such
restriction is necessary to serve one or another of the County's compelling
interest(s). Such restrictions can apply to the times, the places, and the manner of
leafletting, must be content -neutral, and must be the least restrictive restrictions
' possible regarding the County's objective to eliminate specifically articulated
problems at public parks caused by such leafletting. E.g.: Foti v. City of Menlo
Park, 146 F.3d 629 C.A.9 (Cal.) 1998; Families Achieving Independence and
Respect v. Nebraska Dept. of Social Services, C.A.8 (Neb.) 1997; ISKCONMiami,
Inc. v. Metropolitan Dade County, C.A.11(Fla.) 1998; Chicago Acorn v.
' Metropolitan Pier and Exposition Authority, C.A.7 (Ill.) 1998; S. O. C. v. County
of Clark, 152 F.3d 1136, C.A.9 (Nev.) 1998.

On behalf of the Board of County Commissioners and the Parks and Recreation
Department I would like to extend a welcome to you as a member of the Parks and
Recreation Advisory Board. The Department would also like to thank you for your
willingness to serve on this board and review the recreational needs of the residents and
visitors to Collier County.
As you know the Parks and Recreation Advisory Board meets on the 4' Wednesday of
the Month at 2:00 p.m. and the locations are generally at various park locations. The
schedule is set in advance and it is also listed in the agenda that is mailed to members
prior to the meeting.
The department has supplied you with a package that should familiarize you with the
board policies and past minutes of the meetings. Also included in the package is the
County Parks and Recreation Leisure Line which illustrates programs and events that the
department currently runs and ones that are planned for the near future. The package also
contains a location map of the park locations as well as various brochures the department
offers the public.
During your tenure on the board if I or my staff can be of assistance to regarding Park and
Recreation issues please contact me at your convenience.
