KNOW ALL MEN BY THESE PRESENTS that C. David and H. Patricia
Tester, Husband and wife, whose mailing address is 216 Pickens Bridge Road, Piney
Flats, Tennessee 37686, hereinafter known as GRANTOR, for and in consideration of
Ten Dollars ($10.00) and other valuable consideration to it in hand paid, does hereby
grant unto COLLIER COUNTY, a political subdivision of the State of Florida, its agents,
contractors or assigns, whose mailing address is 3301 Tamiami Trail East, Naples,
Florida 34112, hereinafter known as GRANTEE, the temporary license and right to
enter upon the lands of the GRANTOR, for the sole purpose of installing a sewer
system connection and abandonment of septic tank system as described as follows:
Lot 33 of an unrecorded plat of PORT-AU-PRINCE MOBILE HOME: The West Y2 of the
East ~ of the Northwest % of the Southwest ~,4 of the Southeast N, less the North 450
feet and the South 150 feet thereof, in Section 15, Township 51 South, Range 26 East;
less the West 60 feet reserved for public easement, said lands situate, lying and being
in Collier County, Florida.
ALL RIGHT AND PRIVILEGE herein granted shall remain in full force and effect
for one (1) year from date accepted by the Board of Collier County Commissioners.
This Right of Entry shall automatically be renewed for a further period of one (1) year at
the end of each demised term and shall continue in full force and effect unless either
party has notified the other by registered or certified mail, return receipt requested, at
least ninety (90) days prior to the expiration of the demised term of its intention not to
renew.
ADDITIONALLY, the rights and interest granted hereunder are conditioned
upon the reasonable exercise thereof by Grantee. Grantee agrees not to unreasonably
interfere with Grantor's use of the lands described above, and agrees to provide
Grantor with advance notice when exercising its rights hereunder. Grantee further
agrees that it shall, at the Grantee's cost, repair any damage caused to Grantor's
property as a result of Grantee's exercise of its rights hereunder.
