EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign an Agreement Authorizing the Collier County Sheriff's Office to have Traffic Control Jurisdiction over Private Roads within the Naples Bath & Tennis Club Commons Area,Inc. OBJECTIVE: That the Board of County Commissioners approves and authorizes the Chairman to sign the attached Agreement on behalf of the Board of County Commissioners. This Agreement has been placed on the Board's Agenda at the request of the Sheriff's Office. CONSIDERATIONS: The Naples Bath & Tennis Club Commons Area, Inc., and the Collier County Sheriff's Office have negotiated the attached Agreement. The Sheriff's Office will assume traffic control jurisdiction over private roads within the Naples Bath & Tennis Club Commons Area, Inc., (hereinafter the "Subdivision"). Representatives of the Sheriff's Office have affirmed that traffic control of the Subdivision is appropriate. A project engineer hired by the Subdivision has provided a letter certifying that the Subdivision's roadway signage and pavement markings meet the State's standards and requirements of the Subdivision's rights-of-way construction plans approved by Collier County. The attached Agreement has been executed by the Subdivision by the Sheriff's Office. The Agreement can be terminated by the Board or by the Subdivision. FISCAL IMPACT: This item should have no fiscal impact upon Collier County. The Agreement specifies that the Sheriff's Office can negotiate with the Naples Bath & Tennis Club Commons Area, Inc., to recover the Sheriff Office's costs of traffic control over these private roads. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Agreement. AGREEMENT APPROVING AND PROVIDING FOR COUNTY TRAFFIC CONTROL JURISDICTION OVER ROADS WITHIN THE SUBDIVISION OF NAPLES BATH &TENNIS CLUB COMMONS AREA, INC, THIS AGREEMENT is made and entered into this day of , 20 , by and among the following three parties: Naples Bath &Tennis Club Commons Area Inc., do C. Allen Properties, 3050 N. Horseshoe Dr. #172, Naples, FL, 34104 (hereafter the "Property Owners Association"); the Collier County Sheriffs Office, 3319 East Tamiami Trail, Naples, FL 34112; and the Board of County Commissioners of Collier County, Florida, 3299 East Tamiami Trail, Suite#303, Naples, FL, 34112. WHEREAS, all roads within the subdivision Naples Bath &Tennis Club Commons Area Inc., (herein after the"Subdivision") (in unincorporated Collier County) are private roads that are not owned or maintained by Collier County; and WHEREAS, the Property Owners Association, which is responsible for maintaining and controlling the Subdivision, has tendered to the Sheriff of Collier County a letter dated February 24th, 2016, attached hereto as Exhibit"A," requesting that the Collier County Sheriffs Office patrol the private roads within the Subdivision and exercise jurisdiction over those private roads by enforcement of State and Country traffic laws; and WHEREAS, Subsection 316.006(3)(a), Florida Statutes, provides that each Florida County may exercise jurisdiction over private road(s) located within the unincorporated area in its boundaries provided the respective County and other parties owning or controlling such roads provide, by written agreement approved by the governing body of the county for county traffic control jurisdiction over the road(s) covered by the agreement; and WHEREAS, representatives of the Collier County Sheriffs Office have monitored traffic on private roads within the Subdivision and have affirmed that traffic enforcement 1 Packet Page -1598- AIL 1 5/24/2016 16.J.1 . 1 I ill by the Collier County Sheriff's Office is appropriate, and has agreed to provide traffic control enforcement in the geographic areas requested; and I 1 WHEREAS, a private engineering firm representing the Property Owners 1 Association, has provided the Sheriff of Collier County with notice that the signage for the Subdivision appears to be in completed and in substantial cordance with the approved subdivision constructions (see Exhibit"B"); and WHEREAS, the Board of County Commissioners has reviewed these written requests and has determined that it is in the interest of the public health, safety and welfare to enter into this Agreement pursuant to Subsection 316.006(3)(b), Florida 1 I Statutes. I I NOW, THEREFORE, the parties hereto agree as follows: ' 1. The recitals and Exhibits referenced herein above are restated and made a part 1 of this Agreement. 2. Collier County, by action of its Board of County Commissioners, hereby determines to exercise traffic control jurisdiction over all private roads located within the geographic area of the Subdivision as described in Exhibit"C" pursuant to this Agreement entered into pursuant to Subsection 316.006(3)(b), Florida Statutes. 3. Pursuant to Subsection 316.006(3)(b)(2), Florida Statutes, the Collier County Sheriff's Office hereby expressly waives the statutory requirement concerning the effective date of this Agreement relating to the beginning of our next County fiscal year and agrees to the effective date of this Agreement. 4. The Collier County Sheriffs Office shall, commencing on the date of final approval by the Board of County Commissioners and thereafter until this Agreement is terminated, include as part of its duties, patrol and enforcement of all County and State traffic control regulations and laws on or over private roads within the Subdivision, including such additional roads, if any, that may hereafter come into existence within the Subdivision. 5. The parties recognize that all private roads within the Subdivision (as such roads are described herein)are not public roads, not County-owned, and neither the 2 Packet Page -1599- 1 5/24/2016 16.J.1 . County nor the Sheriff's Office has any duty or responsibility for construction and/or repair of any of the same, including signage, and this Agreement does not impose any such responsibilities upon the County of the Sheriffs Office. Signage maintenance, repair and adequacy on and along the roads within the Subdivision is the responsibility of the Property Owners Association and/or other private property interests within said Subdivision. 6. For purposes of identification and geographic specificity, the Subdivision is composed of the platted area described in Exhibit"C" attached hereto. 7. The Collier County Sheriffs Office hereby reserves the authority under this contract to enter into negotiations with Property Owners Association for the purpose of allocating costs pursuant to Subsection 316.006(3)(b)(1), Florida Statutes, as condition to enforcement. 8. This Agreement may be changed, amended, or modified only by means of a written document executed with the same formality as this Agreement. This Agreement may be terminated unilaterally by the Board of County Commissioners(by adoption of a Resolution at a public meeting of the Board of County Commissioners providing that this Agreement be terminated), or by the Property Owners Association. 9. The Property Owners Association shall hold harmless and defend Collier County and the Collier County Sheriff, and their agents and employees from all suits and actions, including attorneys' fees and all costs of litigation and judgments of any name and description arising out of or incidental to performance under the terms of this Agreement. 3 Packet Page -1600- 1 n 5/24/2016 16.J.1 . JOiI \ SO \ ENGINEERING MEMORANDUM PROJECT: NAPLES BATH AND TENNIS CLUB-REGULATORY SIGN ASSESSMENT DATE: APRIL 1,2016 Mr. Allen, Per the regulatory sign assessment dated November 2015 for Naples Bath and Tennis Club in Naples, Florida it was determined that some of the regulatory signs within the development needed to be adjusted to meet the minimum mounting height requirements based on the standards set forth in the 2009 edition of the Manual on Uniform Traffic Control Devices (MUTCD). Furthermore, it was recommended that multiple signs within the development were adjusted to meet the minimum 2 foot lateral offset clearance per Section 2A.19(10) of the 2009 MUTCD as well as the addition of three stop signs. See the attachment for a full summary of the Regulatory Sign Assessment report done for Naples Bath and Tennis Club. Upon a follow-up evaluation on April 1, 2016, all regulatory signs within the Naples Bath and Tennis Club development were field verified by Johnson Engineering, Inc. staff and found to be in compliance with the recommended sign modifications. NAPLES BATH&TENNIS CLUB REGULATORY SIGN ASSESSMENT 1.0 FIELD OBSERVATIONS On October 22, 2015, a site visit was performed by Johnson Engineering staff to document the existing signing characteristics. Sign location, size, type, and offsets were visually observed and documented. The documented sign inventory is provided in Table 1. The location of each sign is provided on the location map in Figure 2 and a photo of each sign can be found in Appendix B. NAPLES BATH&TENNIS CLUB REGULATORY SIGN ASSESSMENT 2.0 RETROREFLECTIVITY AND ILLUMINATION Per section 2A.07(02-03)of the 2009 MUTCD, "Regulatory, warning, and guide signs and object markers shall be retroreflective (see Section 2A.08) or illuminated to show the same shape and similar color by both day and night, unless otherwise provided in the text discussion in this Manual for a particular sign or group of signs. The requirements for sign illumination shall not be considered to be satisfied by street or highway lighting." Of the twelve signs observed along Bald Eagle Drive,none appeared to be retroreflective or have an external light source to provide illumination at night.To maintain compliance with the MUTCD on the inventoried signs within Naples Bath and Tennis Club, it is recommended that these signs be replaced with an appropriate retroreflective material; or each regulatory sign be illuminated using an independently mounted light source. If it is the desire of the community to maintain the current style of signage within the community one possibility is to mount a retroreflective aluminum sign face to a wooden backing and post. NAPLES BATH&TENNIS CLUB REGULATORY SIGN ASSESSMENT 3.0 R01-02 SPEED LIMIT Sign Per section 2B.13(01) of the 2009 MUTCD, "The SPEED LIMIT R02-0I sign shall display the limit established by law, ordinance, regulation or as adopted by the authorized agency based on the engineering study. The speed limits displayed shall be in increments of 5 MPH."Table 2B-1, located within section 2B.03 of the 2009 MUTCD, outlines the minimum sizes for regulatory signs.The minimum size of an R01-02 SPEED LIMIT sign is 18"x24". Florida Statute 316.189(1)states that"The maximum speed within any municipality is 30 miles per hour. With respect to residence districts, a municipality may set a maximum speed limit of 20 or 25 miles per hour on local streets and highways after an investigation determines that such a limit is reasonable. It shall not be necessary to conduct a separate investigation for each residence district." The low volume characteristics of residential neighborhoods warrant the use of the minimum size sign.All five speed limit signs along Bald Eagle Drive are currently 11"x 17"signs,which do not comply with the minimum size requirements specified in the 2009 MUTCD.The speed limit signs it are in compliance with Florida Statute 316.189(1) regarding the speed limit in a municipality. NAPLES BATH&TENNIS CLUB REGULATORY SIGN ASSESSMENT 4.0 R01-01 STOP Sign Per Section 2B.05(02) of the 2009 MUTCD, "The STOP sign shall be an octagon with a white legend and border on a red background."All Stop signs within the development conformed to the standard shape and color set forth in the 2009 MUTCD. Table 2B-1, located within section 213.03 of the MUTCD, outlines the minimum sizes for regulatory signs.The minimum size of an RO1-01 "STOP"sign for a conventional single lane road is 30"x30". While several "STOP" signs within the development did not meet the minimum 1/ 30"x30"size requirement set forth in the most current edition of the MUTCD,they were compliant with the MUTCD at the time of construction(the minimum size of an R01-01 "STOP" sign in the 2003 MUTCD was 24"x24"). It is recommended by the Federal Highway Association (FHWA) that non-compliant signs be replaced with compliant signs at the end of their service life.Figure 4 depicts the stop sign located at the intersection of Bald Eagle Drive and Jacana Circle. There are currently three intersections that do not have a stop sign: the intersection of Bald Eagle Dr. and Goldfinch Way, the intersection of Bald Eagle Dr. and Oriole Circle,and the intersection of Bald Eagle Dr. and Swallow Point. NAPLES BATH&TENNIS CLUB REGULATORY SIGN ASSESSMENT 5.0 Mounting Requirements Per Section 2A.18(4) and (5) of the 2009 MUTCD, "The minimum height, measured vertically from the bottom of the sign to the elevation of the near edge the pavement, of signs installed at the side of the road in rural areas shall be 5 feet. The minimum height, measured vertically from the bottom of the sign to the top of the curb, or in the absence of curb, measured vertically from the bottom of the sign to the elevation of the near edge of the traveled way, of signs installed at the side of the road in business, commercial, or residential areas where parking or pedestrian movements are likely to occur, or where the view of the sign might be obstructedd, shall be 7 feet."(see Figure 5). Due to the lack of pedestrian facilities it is assumed pedestrian movements are not likely to occur within close proximity to the sign structure. Taking this into consideration along with the absence of on-street parking,the recommended minimum sign clearance within the development is 5 feet. Five of the twelve regulatory signs along Bald Eagle Drive were found to have a vertical clearance of less than five feet, therefore vertical adjustments are recommended to meet the minimum specifications as outlined in the 2009 MUTCD. Per Section 2A19(10) of the MUTCD, "On conventional roads in areas where it is impractical to locate a sign with the lateral offset prescribed by this Section, a lateral offset of at least 2 feet may be used" Six of the seven stop signs along Bald Eagle Drive have an offset of less than 2 feet, therefore horizontal adjustments are recommended to meet the minimum specifications as outlined in the 2009 MUTCD. It is recommended that all inventoried stop signs within Naples Bath x✓ and Tennis Club be replaced with 30"x30" stop signs made from a retroreflective material. In addition to replacing existing stop signs,it is also recommended that 30"x30"stop signs be added to three intersections (see Figure 2). It is recommended that Goldfinch Way, Oriole Circle, and Swallow Point have stop signs installed where they intersect Bald Eagle Drive. Section 2A.08 Maintaining Minimum Retroreflectivity Support: 01 Retroreflectivity is one of several factors associated with maintaining nighttime sign visibility (see Section 2A.22). Standard: 02 Public agencies or officials having jurisdiction shall use an assessment or management method that is designed to maintain sign retroreflectivity at or above the minimum levels in Table 2A-3. Support: 03 Compliance with the Standard in Paragraph 2 is achieved by having a method in place and using the method to maintain the minimum levels established in Table 2A-3. Provided that an assessment or management method is being used,an agency or official having jurisdiction would be in compliance with the Standard in Paragraph 2 even if there are some individual signs that do not meet the minimum retroreflectivity levels at a particular point in time. Guidance: 04 Except for those signs specifically identified in Paragraph 6,one or more of the following assessment or management methods should be used to maintain sign retroreflectivity: A. Visual Nighttime Inspection—The retroreflectivity of an existing sign is assessed by a trained sign inspector conducting a visual inspection from a moving vehicle during nighttime conditions. Signs that are visually identified by the inspector to have retroreflectivity below the minimum levels should be replaced. B. Measured Sign Retroreflectivity—Sign retroreflectivity is measured using a retroreflectometer. Signs with retroreflectivity below the minimum levels should be replaced. C. Expected Sign Life—When signs are installed, the installation date is labeled or recorded so that the age of a sign is known. The age of the sign is compared to the expected sign life. The expected sign life is based on the experience of sign retroreflectivity degradation in a geographic area compared to the minimum levels. Signs older than the expected life should be replaced. D. Blanket Replacement—All signs in an area/corridor, or of a given type,should be replaced at specified intervals. This eliminates the need to assess retroreflectivity or track the life of individual signs. The replacement interval is based on the expected sign life, compared to the minimum levels,for the shortest-life material used on the affected signs. Standard: 04 The minimum height,measured vertically from the bottom of the sign to the elevation of the near edge of the pavement,of signs installed at the side of the road in rural areas shall be 5 feet(see Figure 2A-2). 05 The minimum height,measured vertically from the bottom of the sign to the top of the curb,or in the absence of curb,measured vertically from the bottom of the sign to the elevation of the near edge of the traveled way,of signs installed at the side of the road in business,commercial,or residential areas where parking or pedestrian movements are likely to occur,or where the view of the sign might be obstructed, shall be 7 feet(see Figure 2A-2). Option: os The height to the bottom of a secondary sign mounted below another sign may be 1 foot less than the height specified in Paragraphs 4 and 5. Standard: I io Directional signs on freeways and expressways shall be installed with a minimum height of 7 feet, measured vertically from the bottom of the sign to the elevation of the near edge of the pavement. If a secondary sign is mounted below another sign on a freeway or expressway,the major sign shall be installed with a minimum height of 8 feet and the secondary sign shall be installed with a minimum height of 5 feet,measured vertically from the bottom of the sign to the elevation of the near edge of the pavement. 11 Where large signs having an area exceeding 50 square feet are installed on multiple breakaway posts, the clearance from the ground to the bottom of the sign shall be at least 7 feet. Option: 12 A route sign assembly consisting of a route sign and auxiliary signs(see Section 2D.31)may be treated as a single sign for the purposes of this Section. 13 The mounting height may be adjusted when supports are located near the edge of the right-of-way on a steep backslope in order to avoid the sometimes less desirable alternative of placing the sign closer to the roadway. Standard: 14 Overhead signs shall provide a vertical clearance of not less than 17 feet to the sign,light fixture,or sign bridge over the entire width of the pavement and shoulders except where the structure on which the overhead signs are to be mounted or other structures along the roadway near the sign structure have a lesser vertical clearance. Option: 5 If the vertical clearance of other structures along the roadway near the sign structure is less than 16 feet, the vertical clearance to an overhead sign structure or support may be as low as 1 foot higher than the vertical clearance of the other structures in order to improve the visibility of the overhead signs.
