EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20160000324, to disclaim, renounce and vacate the County and the public interest
in a portion of the 18-foot drainage and maintenance easement located along the rear border of Lot
125, Villages of Monterey at Woodbridge, Unit Four as recorded in Plat Book 17, Page 77 of the
public records of Collier County, Florida, located in Section 2, Township 49 South, Range 25 East,
Collier County,Florida.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion
of the 18-foot drainage and maintenance easement located along the rear border of Lot 125,
Villages of Monterey at Woodbridge, Unit Four as recorded in Plat Book 17, Page 77 of the
public records of Collier County, Florida, located in Section 2, Township 49 South, Range 25
East, Collier County, Florida.
CONSIDERATIONS: Petition VAC-PL20160000324 has been received by the Development
Review Division, from Robert C. Matthews, Esq., of Burr Foreman, LLP, as agent for the
property owner, to vacate a portion of the 18-foot drainage and maintenance easement located
along the rear border of Lot 125, Villages of Monterey at Woodbridge, Unit Four as recorded in
Plat Book 17, Page 77 of the public records of Collier County, Florida, located in Section 2,
Township 49 South, Range 25 East, Collier County, Florida.
The screened pool deck encroaches less than one foot into the 18-foot drainage and maintenance
easement located on the rear of the property. It was installed by a previous owner in 1996 and
received a Certificate of Completion (Permit 960007340). However, the current owner has
learned that the screen was installed closer to the rear property line than it was shown on the
permitted plans, and now wishes to remedy the encroachment into the easement. Moving the
deck, plumbing and screening would cause a substantial hardship to the owners. There is no
public detriment with respect to the vacation of the portion of the drainage and maintenance
easement because it does not contain any drainage facilities, and the vacation will not have an
adverse impact on drainage or adjacent property owners.
Staff has reviewed this petition and found no reason for objection.
Letters of no objection from abutting property owners have been received from all who
responded and a letter of no objection was received from the Monterey Master Owners
Association, Inc. The easement was also dedicated to the Association on the plat, so their Letter
of No Objection serves as consent to this vacation.
FISCAL IMPACT: Staff has collected a $2,000 "Petition to Vacate" fee from the petitioner
which covers the County's cost of recording and processing.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact
associated with this Executive Summary.

RECOMMENDATION:
1) To approve the attached Resolution, relating to Petition VAC-PL20160000324, which will

easement located along the rear border of Lot 125, Villages of Monterey at Woodbridge, Unit
Four as recorded in Plat Book 17, Page 77 of the public records of Collier County, Florida,
located in Section 2, Township 49 South, Range 25 East, Collier County, Florida, being more
specifically shown in Exhibit A, and;
2) To direct the Clerk of Courts to record a certified copy of the Resolution in the public records
and to make proper notation of this Resolution on the plat of Villages of Monterey at
Woodbridge, Unit Four as recorded in Plat Book 17, Page 77, of the public records of Collier
County, Florida.

WHEREAS, pursuant to Resolution 2013-166, Petitioner, Robert C. Matthews,
Esq., of Burr Foreman, LLP, on behalf of the property owner, has requested the vacation
of the County and the Public interest in a portion of the 18-foot drainage and maintenance
easement located along the rear border Lot 125 of Villages of Monterey at Woodbridge,
Unit Four as recorded in Plat Book 17, Page 77 of the public records of Collier County,
Florida, located in Section 2, Township 49 South, Range 25 East, Collier County, Florida,

WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY,FLORIDA, that the County and public
interest in a portion of the 18-foot drainage and maintenance easement located along the
rear border Lot 125 of Villages of Monterey at Woodbridge, Unit Four as recorded in Plat
Book 17, Page 77 of the public records of Collier County, Florida, located in Section 2,
Township 49 South, Range 25 East, Collier County, Florida, being more specifically
shown in Exhibit A, is hereby vacated, extinguished, renounced and disclaimed, and this
action is declared to be in the public interest and for the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public Records and to
make proper notation of this Resolution on the plat of Villages of Monterey at
Woodbridge, Unit Four as recorded in Plat Book 17, Page 77, of the public records of
Collier County, Florida.

We have the pleasure of representing Dr. and Mrs. James Spain, the owners of 1983 Mission Dr.
We have petitioned Collier County in connection with the vacation of a sliver of a drainage and
maintenance easement due to an encroachment. The purpose of the vacation is only to resolve a
title issue and will not result in any physical change to any property. The drainage and
maintenance easement is depicted on the attached survey.
As part of the formal procedure to vacate the portion of the easement, Collier County requests
that certain parties provide a "Letter of No Objection." Therefore, we would appreciate it if you
would execute the enclosed consent so that we can continue to resolve this matter for the Spains.
We have enclosed a postage-paid envelope for your convenience.

We have petitioned Collier County in connection with the vacation of a sliver of a drainage e and
maintenance easement due to an encroachment. The purpose of the vacation is only to resolve a
title issue and will not result in any physical change to any property. The drainage and
maintenance easement is depicted on the attached survey.
As part of the formal procedure to vacate the portion of the easement, Collier County requests
that certain parties provide a "Letter of No Objection." Therefore,we would appreciate it if you
would execute the enclosed consent so that we can continue to resolve this matter for the Spains.
