EXECUTIVE SUMMARY Recommendation to approve a Second Amendment to Radio Tower Lease Agreement with Crown Castle GT Company LLC to add equipment required for the approved upgrade of the County's public safety radio system. OBJECTIVE: To capture additional equipment and a rent increase to a Radio Tower Lease Agreement related to the public safety radio system for emergency communications on behalf of Information Technology Division. CONSIDERATION: Since 1995, Collier County has utilized space on a communications tower owned by Crown Castle GT Company LLC (Landlord), located at 1800 Trade Center Way, for the public safety radio system for emergency communications. The attached Second Amendment to Radio Tower Lease Agreement authorizes the County to install its additional tower-mounted and ground-based equipment at the site. With the additional equipment the monthly rent has been increased by $450, which results in a new monthly rental payment of$975 as of October 1, 2015. This date is based on the owner reserving tower space pending approval of this lease amendment. With Board approval the County will proceed with installation of equipment. The additional equipment placed on the Trade Center Way tower will provide connectivity between the radio system and a new tower site at the Lee County line approved by the Board on June 14, 2014, agenda item 16 E 10. The hardware installed is also compatible with the P25 technology the County is implementing. FISCAL IMPACT: The monthly rent of $975 will be paid from the 800MHz Inter-Governmental Communications Program account number 188-140480-644600. These costs were factored into the FY 16 budget for fund 188. GROWTH MANAGEMENT: There is no Growth Management Impacts associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board action. -JAB RECOMMENDATION: That the Board of County Commissioners approves the Second Amendment to Radio Tower Lease Agreement with Crown Castle GT Company LLC and authorizes the Chairman to execute same. Interference: Lessee covenants and agrees that Lessee's Communication Equipment, its installations, operation and maintenance will: A. Not interfere with the maintenance of LESSOR'S tower and tower lighting system. After installation no alterations hereafter shall be made without prior written approval and acceptance by Lessor, such approval not to be unreasonably withheld. In the event this Lease is extended beyond the primary term, as hereinafter provided, the yearly rental shall be the same as the primary term of the Lease due upon the anniversary date of this Lease. • 5. Use: LESSEE will use the Demised Premises for the sole purpose of construction and operating a Communications center. LESSEE shall use the Demised Premises for no other purpose, without the prior written consent of the LESSOR. 6. Access: LESSOR agrees that during the term of this Lease or its extensions as hereinafter provided LESSEE, shall have reasonable ingress and egress on a twenty-four (24) hours basis to the Demised Premises for the purposes of maintenance, installation, repair and removal of. said Communications Equipment. It is agreed however, that only authorized engineer or employees of LESSEE, or persons under LESSEE'S direct supervision, will be permitted to enter the said Demised Premises to install, remove and/or repair LESSEE' S Communication Equipment. LESSEE is responsible for the cost of such activities and will notify LESSOR in advance of its need to install or repair its Communications Equipment located on the Demised Premises, EXEMPT HOWEVER, in the case of an emergency whereupon notification shall be given as soon as reasonably possible. 7 . If Tenant is unable to eliminate such interference caused by it within a reasonable period of time, Tenant agrees to remove its antennas from LESSOR'S property and this agreement shall terminate. C. Not interfere with the maintenance of LESSOR'S tower and tower lighting system. D. comply with all applicable rules and regulations of the Federal Communications Commission and electrical codes of the City and/or State concerned. 16. Fixtures: LESSOR covenants and agrees that no part of the improvements constructed, erected or placed by LESSEE on the Demised Premises or other real property owned by LESSOR shall be or become or be considered as being, affixed to or a part of LESSOR'S real property and any an all provisions and principles of law to the contrary notwithstanding, it being* the specific intention of the LESSOR to covenant and agree that all improvements of every kind and nature constructed, erected or placed by LESSEE on the Demised Premises or other real property owed by LESSOR shall be and remaining the property of the LESSEE. • 17.
