EXECUTIVE SUMMARY
Recommendation to appoint four members to the Affordable Housing Advisory Committee
OBJECTIVE: To declare one seat vacant and appoint four new members to the Affordable
Housing Advisory Committee.
CONSIDERATIONS: This committee was created by Ordinance No. 91-65, as amended,
which was repealed and replaced by Ordinance No. 2013-27. The purpose of this 11 member
committee as required and described by 420.9076 Fla. Stat. is to review policies, procedures,
ordinances, land development regulations, and the adopted local government comprehensive
plan, and to recommend specific actions or initiatives to encourage or facilitate affordable
housing. The committee is required to submit a triennial report to the Board of County
Commissioners that includes recommendations on, and evaluates the implementation of,
affordable housing incentives as required by 420.9076(4) Fla. Stat. A list of the current
membership is included in the backup. Terms are three years, and membership must consist of
the following:
(a) One citizen who is actively engaged in the residential home building industry in connection
with affordable housing.
(b) One citizen who is actively engaged in the banking or mortgage banking industry in
connection with affordable housing.
(c) One citizen who is a representative of those areas of labor actively engaged in home
building in connection with affordable housing.
(d) One citizen who is actively engaged as an advocate for low-income persons in connection
with affordable housing.
(e) One citizen who is actively engaged as a for-profit provider of affordable housing.
(f) One citizen who is actively engaged as a not-for-profit provider of affordable housing.
(g) One citizen who is actively engaged as a real estate professional in connection with
affordable housing.
(h) One citizen who actively serves on the local planning agency pursuant to s. 163.3174.
(i) One citizen who resides within the jurisdiction of the local governing body making the
appointments.
(j) One citizen who represents employers within the jurisdiction.
(k) One citizen who represents essential services personnel.
There are currently four vacancies on this committee. In addition, member Irma R. Miller has
attended only one meeting since she was appointed on October 28, 2014. Pursuant to the Board's
attendance requirements for committee members as stated in Code of Laws Sec.2-833 (attached),
the committee recommends that the Board of County Commissioners declare this seat to be
vacant, and fill this vacancy from the available applicants.

STAFF RECOMMENDATIONS: When the above applications were considered by the
committee in December 2015 and February 2016, there was not a quorum present to vote on a
recommendation. Based on the consensus of the members who were present, staff is
recommending that the current vacancies be filled as follows:
• Denise Murphy/category: (e) for-profit provider/term expiration: October 1, 2018
• Joseph Schmitt/ category: (i)resident in jurisdiction/term expiration: October 1, 2018
• Christina Apostolidis / category: (j) employers within jurisdiction / term expiration :
October 1, 2017
On October 15, 2015, the committee met and considered the matter of Irma Miller's poor
attendance record, and the members who were present voted to request that the Board of County
Commissioners remove her from the committee and declare her seat to be vacant. Staff
recommends the following applicant be appointed to fill Ms. Miller's vacated seat:
• Dr. Carlos Portu / category: (k) essential services personnel/term expiration: October 1,
2017
The remaining applicants were found to not meet the qualifications for the one remaining
vacancy, which is in category (c), labor engaged in home building. Recommendation memos are
included in the backup to this item.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners adopts the Staff
Recommendations, and directs the County Attorney to prepare a resolution confirming the
appointments.

Department. Previously managed and controlled the county's tourism program and all

divested to separate organizations with the county staff.

A regular meeting of the Affordable Housing Advisory Committee (AHAC) was
held on Monday, December 7, 2015. Although there was not a quorum to vote on
the recommendation to appoint Dr. Portu to the committee, there was a general
consensus of those members present to send a recommendation to the Board of
County Commissioners to appoint Dr. Portu to the committee to replace Irma Miller.
Dr. Portu would represent the position as "essential services" as outlined in the
Ordinance 2008-17. Dr. Portu's application indicated that he has been employed at
Naples Community Hospital for over five years. He is extremely interested in
affordable housing as he is a year-round resident who deals with people of all
incomes who need affordable housing.
The applications of Dr. Portu and Christina Apostolidis were reviewed for
membership, however the committee asked for additional information about Ms.
Apostolidis.

A regular meeting of the Affordable Housing Advisory Committee (AHAC) was
held on Tuesday, February 16, 2016. Although there was not a quorum to vote on
the recommendation for non-appointment of Mr. Jose Nunez to the committee, there
was a general consensus of those members present to send a recommendation to the
Board of County Commissioners not to appoint Mr.Nunez to the committee.
Although Mr. Nunez could qualifiy for another position on the committee, after the
appointment of three other candidates, there was only one position left to be filled
and that was the one for"labor engaged in home building". Mr. Nunez has a law
background and does not fit into this category.
Ms. Christina Apostolidis, Mr. Joseph Schmitt, Mr. Jose Nunez and Ms. Denise
Murphy were the four applicants submitted for the four open positions at this time—
none of whom fit the category of"labor engaged in home building".

Sec. 2-833. -Attendance requirement.
It is the intent and strong desire of the commission that there be full attendance of advisory board
members at all meetings of the boards, recognizing, however, that it may be necessary for board
members to be absent from a meeting due to unusual or emergency circumstances. Nevertheless,full
attendance at board meetings is encouraged and necessary for the proper operation of the boards
and in furtherance thereof the following requirements are established:
(1) Any board member who is absent for more than one-half of the board's meetings in a given
fiscal year shall be deemed to have tendered his or her resignation from such board. The
commission shall, as soon as practicable after such resignation, declare the position to be
vacant and shall promptly fill same pursuant to the provisions of section 2-51 herein. The
board members shall not serve at any meetings after his or her position is declared vacant by
the commission.
(2) In the event that any board member is absent from two consecutive meetings without a
satisfactory excuse acceptable to the board chairperson, the board chairperson shall state
such fact at the next regularly scheduled board meeting and shall thereafter notify, in writing,
the executive manager to the commission of the board member's failure to attend without a
satisfactory excuse.The commission shall review the board chairperson's notification at the
commission meeting and shall declare the board member's position to be vacant if the
commission concurs that the board member was absent from two consecutive board
meetings without a satisfactory excuse, and shall promptly fill same pursuant to the provisions
of section 2-51 herein.The board member shall not serve at any meetings after his or her
position is declared vacant.
(3) A member of a board shall be deemed absent from a meeting when he or she is not present
during at least 75 percent of the meeting.
