EXECUTIVE SUMMARY
Recommendation to approve the conveyance of a Grant of Utility Easement to Comcast Cable
Communications Management, LLC, to provide cable connections for use of the Locution System,
Inc. (a fire and EMS station alerting system) within Collier EMS Station No. 76 at
Vanderbilt/Logan.
OBJECTIVE: To provide Locution services (fire and EMS station alert system) to EMS Station 76
currently under construction at Vanderbilt Beach Road and Logan Blvd.
CONSIDERATIONS: In order for Comcast to provide communications equipment to Collier EMS
Station No. 76, it will be necessary to execute and record the attached conveyance of a Grant of Utility
Easement to Comcast Cable Communications Management, LLC (hereinafter referred to as"Comcast").
The Utility Easement measures 10 feet in width, and comprises a total of 735 square feet, more or less, as
shown and described on Exhibit"A"of the Grant of Utility Easement.
The Grant of Utility Easement has been reviewed and approved by EMS and Facilities Management staff.
FISCAL IMPACT: Recording costs shall not exceed twenty ($20.00) dollars and will be paid from
Fund 490.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires majority vote
for approval. -JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management
Plan.
RECOMMENDATION: That the Board of County Commissioners approves the attached Grant of
Utility Easement, authorizes the Chairman to execute the Grant of Utility Easement, and directs the
County Manager or his designee to proceed to follow all appropriate closing procedures and to record the
Grant of Utility Easement in the Public Records of Collier County,Florida.

GRANT OF UTILITY EASEMENT
This indenture made and executed this day of , 2016, by and between
COLLIER COUNTY, a political subdivision of the State of Florida, hereinafter referred to as GRANTOR
and COMCAST CABLE COMMUNICATIONS MANAGEMENT, LLC, hereinafter referred to as
GRANTEE.

That for and in consideration of the sum of Ten Dollars ($10,00) and other good and valuable
conmidenahon, receipt of which is hereby acknowledged, the GRANTOR hereby grants to GF&4NTEE, its
successors or assigns, a non exclusive easement for the purpose of providing communications services
by allowing Cornoost's cable equipment to be placed inha, ovar, under, acroms, and along the property as
more particularly described on Exhibit "A"attached hereto and made a part hereof.
TO HAVE AND TO HOLD the easement hereby granted unto said BRANTEE, its successors and
assigns.
GRANTEE, by acceptance of this easement agrees for i1eo|f, its successors and assigns, to
maintain said easement and in no way interfere at any time with the right of ingress or egress of
GFANTDR, its successors and aeaigns, or any other party requiring access to any of the property over
which said easement is granted. GRANTEE further agrees that it will at all times use extreme care to
restore all grounds to as good or better condition than found prior to construction, maintenance and
repair.
In the event GRANTEE, its successors or meaiQns, shall fail to use this easement for the purpose
intended, then GRANTEE, its successors or assigns, shall vacate, cancel and annul said easement or
relevant part thereof.
GRANTDR, its successors or ooaignu, shall upon said voco\)on, have the right lo require
GRANTEE, its successors or assigns, to remove any structure or improvements which may affect the
use of the property.
GRANTEE hereby covenants and agrees to indemnifv, save, protect and hold harmless
GRANTOR against any loss, darnage, injury, debt or expense (including attorney's fees) claimed or
asserted by any person or entity, which claim relates to in any woy, no matter how remote, or arises out
of GRANTEE'S installation or use of GRANTEE'S facilities described above.
IN WITNESS WHEREOF the GRANTOR has caused these presents to be executed in its name
by its Board of County Commissioners acting by the Chairman of said Board, the day and year first
above written.
