EXECUTIVE SUMMARY
Recommendation to approve and accept the conveyance of a utility easement and right of entry
through the northeast corner of Conner Park to the Collier County Water-Sewer District on behalf
of the Public Utilities Department.
OBJECTIVE: To update and improve the wastewater collection system in the Conner-Vanderbilt area.
The public purpose is to bring outdated infrastructure into compliance with current County standards
while meeting demand, improving reliability, protecting public safety and providing environmental
protection.
CONSIDERATIONS: The Collier County Wastewater Division will be replacing existing wastewater
pipelines as a part of the Basin 101/Vanderbilt Cul-de-Sacs Infrastructure Project. This project involves
removing the gravity wastewater mains from beneath the intersection of Bluebill Avenue and Vanderbilt
Drive. The Wastewater Division proposes to accomplish this by routing the wastewater system through
the northeast corner of Conner Park. (Location map, aerial view and layout of the proposed sewer line are
attached.) In accordance with the Collier County Utility Standards, the Wastewater Division will repair
damage and restore the surface of the impacted area to the condition existing prior to commencement of
construction. Representatives from the Parks and Recreation Division met with representatives from the
Wastewater Division and approved the proposed realignment and route under Conner Park.
FISCAL IMPACT: The total cost for recording the Utility Easement and Right of Entry will not exceed
$37.00. Funds in the amount of$37.00 are available in the Wastewater Capital Improvement Fund 414
under Project No. 70043.14.1.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: The attached Utility Easement and Right of Entry have been approved
for form and legality and require a majority vote for approval.-JAB
RECOMMENDATION: That the Board of County Commissioners approves the attached Utility
Easement and Right of Entry through the northeast corner of Conner Park; authorizes the Chairman to
sign the attached Utility Easement and Right of Entry; accepts the attached Utility Easement and Right of
Entry in its capacity as the ex-officio governing board of the Collier County Water-Sewer District; and
directs the County Manager, or his designee, to record the Utility Easement and Right of Entry in the
Public Records of Collier County,Florida.

of one (1)year from the completion of the work pertaining to installation of the wastewater lines
on the lands of the Grantors described above. This Right of Entry shall have full force and effect
until the expiration of the contractor warranty for the construction relating to this project is
completed, including, but not limited to final inspections, acceptance and payment of the
contractor.
ADDITIONALLY, the rights and interest granted hereunder are conditioned upon the
reasonable exercise thereof by Grantee. Grantee agrees not to unreasonably interfere with
Grantor's use of the lands described above, and agrees to provide Grantor with advance
notice when exercising its rights hereunder. Grantee further agrees that it shall, at Grantee's
cost,repair any surface damage caused to Grantor's property as a result of Grantee's exercise
of its rights hereunder,in accordance with the Collier County Utility Standards.
