EXECUTIVE SUMMARY Recommendation to approve the conveyance of lands on Immokalee Road and waive the automatic reservation of phosphate, minerals, metals, and petroleum rights required under Sec. 270.11(1), F.S. (Fiscal Impact: $0) OBJECTIVE: To obtain the Board of County Commissioners' approval to convey a fee simple interest in a parcel of land (hereinafter "Parcel 806") along Immokalee Road on which a stormwater retention and treatment pond is located, reserving to the County a perpetual, non- exclusive drainage, utility and maintenance easement over the entire property, waiving the reservation of rights to any and all phosphate, minerals, metals and petroleum required pursuant to the provisions of Section 270.11(1),F.S. CONSIDERATIONS: On September 13, 2005, a Stipulated Final Judgment (hereinafter "Judgment") between property owner, Mary Wagner, and Collier County was entered with the Circuit Court settling the lawsuit styled Collier County, Florida, vs. Tree Plateau Co., Inc, et al., as to Parcels 106 and 806. The Judgment reserved to Mary Wagner the right to request, within ten (10) years from the date thereof, that the County convey to Mary Wagner, or her successors and assigns, a fee simple interest in Parcel 806; and upon such request the County would convey a statutory deed to Parcel 806, reserving unto the County a drainage, utility and maintenance easement over Parcel 806. The Judgment further provided that Mary Wagner, or her successors or assigns may amend the drainage pond thereon to add, move, alter or modify same subject to the permitting requirements of the South Florida Water Management District. A request for said conveyance by statutory deed has recently been received from an assignee of Mary Wagner and also by Mary Wagner. A Statutory Deed has been prepared conveying Parcel 806 to Mary Wagner, reserving to the County a perpetual, non-exclusive easement for drainage, utilities and maintenance over the entire parcel and containing a condition at the request of the County Attorney's Office stating that the retention pond may not be moved or relocated; but that the pond may be resculpted subject to County approval. The Developer of the parent tract of Parcel 806 is currently processing a petition to rezone the property to a residential planned unit development. Pursuant to the requirements of Section 270.11(3), F.S., the County has also received a petition from counsel for Rock Development Group, LLC requesting a release by the County of its lawful reservation of any and all phosphate, minerals, metals and petroleum in Parcel 806 in accordance with the provisions of Section 270.11(1), F.S., which provides: Unless the applicable agency chooses not to reserve such interest and except as otherwise provided by law, in all contracts and deeds for the sale of land executed by the Board of Trustees of the Internal Improvement Trust Fund or by any local government, water management district, or other agency of the state, there shall be reserved for such local government, water management district, other agency of the state, or the board of trustees and its successors an undivided three fourths interest in, and title in and to an undivided three fourths interest in, all the phosphate, minerals, and metals that Packet Page -385- 2/23/2016 16.A.10. are or may be in, on, or under the said land and an undivided one-half interest in all the petroleum that is or may be in, on, or under said land with the privilege to mine and develop the same. The County Manager's designee and the County Attorney recommend to the Board that it approve said conveyance, and authorize its Chairman to execute the statutory deed on behalf of the Board. FISCAL IMPACT: There is no fiscal impact associated with this recommendation. The property owner will be responsible for recording the statutory deed in the Official Records of the Clerk of Court. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - HFAC GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. RECOMMENDATION: 1. Approve this recommendation and authorize its Chairman to execute the attached statutory deed on behalf of the Board; and 2. Authorize the County Manager or his designee to deliver said statutory deed to representatives of Mary Wagner.
