EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20150002694,to vacate the access easement located at the southwest corner of Lot
16, of the Residences at Mercato, as recorded in Plat Book 58, Page 6, of the public records of
Collier County, Florida, located in Section 34, Township 48 South, Range 25 East, Collier County,
Florida.
OBJECTIVE: To adopt a Resolution to vacate the access easement located at the southwest
corner of Lot 16, of the Residences at Mercato, as recorded in Plat Book 58, Page 6 of the public
records of Collier County, Florida, located in Section 34, Township 48 South, Range 25 East,
Collier County, Florida, being more specifically shown in Exhibit A.
CONSIDERATIONS: Petition VAC-PL20150002694 has been received by the Development
Review Division, Growth Management Department from James A. Carr, P.E., of Agnoli, Barber
& Brundage, Inc., as agent for the property owner, to vacate the access easement located at the
southwest corner of Lot 16, of the Residences at Mercato, as recorded in Plat Book 58, Page 6 of
the public records of Collier County, Florida, located in Section 34, Township 48 South, Range
25 East, Collier County, Florida.
Residences at Mercato is a 52 unit single-family zero lot line subdivision. The development was
platted as 52 lots with a private right-of-way (Tract A), in Plat Book 58, Pages 6 through 10 of
the public records of Collier County. The Residences at Mercato is a gated community with all
roadways, parking, common areas, utilities and drainage being privately owned. The developer
provided guest parking (not required) in addition to the required driveway and garage parking at
each residence. The guest parking spaces are all located within the privately owned (HOA) tracts
with exception of one parking space that is located on Lot 16. This parking space is on the
single-family lot and an Access Easement (A.E.) is provided over this space as shown on the
Plat. The contract purchaser of Lot 16 does not want the parking space so close to the residence
and has asked the developer to remove it and to relinquish or vacate interest in the A.E.
The Access Easement is a private access easement only dedicated to the Residences at Mercato
Homeowners Association and not dedicated to any other public or private entities. Collier
County, its franchisees, and the Fire District only have a dedicated interest in the Access
Easement that is over and across Tract A for permitting emergency and other vehicles, not for
any other Access Easement's indicated on the Plat. There is no public detriment to the vacation
of this Access Easement because it only affects a private interest and does not impact any County
or public interest. The Mercato Homeowners Association has submitted a Letter of No Objection
to vacate their interest in the easement, a copy of which is attached hereto. The Vacation of
Easement procedure is not required but is being done to ensure that there is no real or implied
future public interest in this easement.
The Development Review Division has reviewed this petition and found no reason for objection.

FISCAL IMPACT: Staff has collected a $2,000 "Petition to Vacate" fee from the petitioner
which covers the County's cost of recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
LEGAL CONSIDERATIONS: There is no public interest in the subject access easement
because the access easement was only dedicated to a private entity on the plat. Therefore, the
vacation of the access easement will only act to remove the physical depiction of the access
easement on the Residences at Mercato plat, and any additional private rights created or affected
by third parties over the access easement area must be separately terminated. This item has been
approved as to form and legality, and requires a majority vote for Board approval ---SAS
RECOMMENDATION: 1) To approve the attached Resolution, relating to Petition VAC-
PL20150002694, which will vacate the access easement located at the southwest corner of Lot
16, of the Residences at Mercato, as recorded in Plat Book 58, Page 6, of the public records of
Collier County, Florida, located in Section 34, Township 48 South, Range 25 East, Collier
County, Florida, being more specifically shown in Exhibit A, and 2) directs the Clerk of Courts
to record a certified copy of the Resolution in the public records and to make proper notation of
this Resolution on the plat of the Residences at Mercato, as recorded in Plat Book 58, Page 6, of
the public records of Collier County, Florida.

COLLIER COUNTY, FLORIDA, LOCATED IN SECTION 34,
TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY,

WHEREAS, pursuant to Resolution 2013-166, Petitioner, James A. Carr, P.E., of
Agnoli, Barber & Brundage, Inc., on behalf of the property owner, has requested the
vacation of the access easement located at the southwest corner of Lot 16, of the
Residences at Mercato, as recorded in Plat Book 58, Page 6 of the public records of
Collier County, Florida, located in Section 34, Township 48 South, Range 25 East,
Collier County, Florida, being more specifically shown in Exhibit A, attached hereto; and
WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the access easement
located at the southwest corner of Lot 16, of the Residences at Mercato, as recorded in
Plat Book 58, Page 6 of the public records of Collier County, Florida, located in Section
34, Township 48 South, Range 25 East, Collier County, Florida, being more specifically
shown in Exhibit A, is hereby vacated, and this action is declared to be in the public
interest and for the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is
hereby directed to record a certified copy of the Resolution in the Public Records and to
make proper notation of this Resolution on the plat of the Residences of Mercato, as
recorded in Plat Book 58, Page 6, of the public records of Collier County, Florida.
