EXECUTIVE SUMMARY Recommendation to approve and authorize the Cnairman to sign a retained Program Income Agreement between the Florida Department of Economic Opportunity and the Collier County Board of County Commissioners and to authorize a budget amendment recognizing the revenue received under the Community Development Block Grant in the amount of$34,820.55. OBJECTIVE: To retain and reuse program income from the Immokalee Airport CDBG Project. CONSIDERATIONS: In 2000, Collier County had a small cities designation and received Community Development Block Grant(CDBG) funding through the State Department of Community Affairs (DCA) now known as the Florida Department of Economic Opportunity (DEO). At this time an award was made to the Immokalee Airport under Contract Number 00-DB-6B-09-21-01-E-05 for $750,000 to construct a County-owned building located at the Immokalee Airport. This building previously was known as the Global Facility which was leased to Global Manufacturing Technologies, Inc. The CDBG funds invested in the facility represented a 51% federal investment. In accordance with 24 CFR 576, any funds generated as a result of the federal investment are considered program income. From 2004 to 2013 the Immokalee Airport remitted program income to the DCA/DEO. In 2014, Community and Human Services, in conjunction with Growth Management staff and the County Attorney's Office, sent correspondence to the DEO and requested that all future program income be retained by the County and no longer be remitted to the DEO. Pursuant to 24 CFR 570.489(e)(3)(iii) when a community is no longer considered a small city, but rather has been designated as an Entitlement Community, they are permitted to request retention of all program income. As a result of this request, the DEO agreed and has requested that the County enter into a formal Program Income Agreement with the DEO for these funds. The Immokalee Airport will, upon execution of this agreement, remit all funds to CHS who will receipt the funds as program income and record them into the HUD Integrated Disbursement and Information System (IDIS). These funds will be retained in IDIS and tracked. The Immokalee Airport will remit all future program income to CHS on a routine basis. These funds less administrative expenses are to be set aside for future eligible projects and will be brought back to the board for approval once a plan for expenditure is developed. The revenue will be used in compliance with federal grant regulations and will fund eligible expenses, including administration. Revenue received and not remitted to DCA/DEO: Type of Revenue Amount 20%Admin Program Program Income $34,820.55 $ 6,964.11 $ 27,856.44 Total $34,820.55 $6,964.11 $27,856.44 CDBG guidelines allow 20% of the program income to fund administration activities. FISCAL IMPACT: Funds in the amount of 534.820.55 will he paid from Airport Authority Fund 495 in accordance with the Program Income Agreement. Future payment: le, CHS will be made annually% after the collection of rent and calculation of the federal portion of program income. A budget amendment is necessary to recognize the program income in the amount of $34,820.55 within Housing Grants, Fund 705 Project 33434 GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. Department of Economic Opportunity—Small Cities Community Development Block Grant Program Program Income Agreement 8/4/2014 PROGRAM l INCOME AGREEMENT BETWEEN THE FLORIDA DEPARTMENT OF ECONOMIC OPPORTUNITY AND THE COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS This Agreement,Number 15DB-SE-09-21-01-PII,is made and entered into by and between the State of Florida, Department of Economic Opportunity("the Department"),and the Collier County Board of County Commissioners ("the County"), to address the distribution of Program Income generated as a result of Contract Number OODB-6B-09-21-01-E 05, award dated September 29, 1999, by the former Florida Department of Community Affairs. The Small Cities Community Block Grant program is now administered by the Florida Department of Economic Development. Contract Number OODB-6B-09-21- 01-E 05, was Administratively Closed on June 23, 2005, and Final Closed on February 9,2010. WHEREAS, the Department of Community Affairs ("DCA") and the County entered into the Agreement, pursuant to which DCA provided a subgrant of$750,000.00 to the County under the Small Cities Community Development Block Grant(CDBG) Program as set forth in the Agreement; WHEREAS,the County utilized Small Cities CDBG funding to construct a County-owned building located at the Immokalee Airport(originally known as the Global Facility leased to Global Manufacturing Technologies, Inc., as designated in Attachment K of contract number OODB-6B-09-21-01-E 05) that generates rent dollars paid to the County; WHEREAS,the County currently returns rent dollars generated by lease of the Small Cities CDBG assisted County-owned building, as prescribed by Rule 73C-23.0051(10)(b), Florida Administrative Code; WHEREAS, the County currently receives Entitlement CDBG assistance directly from the U.S. Department of Housing and Urban Development(HUD); WHEREAS,the County desires to retain and utilize all income, generated by the lease of the Small Cities CDBG assisted County-owned building, to be utilized to supplement the programs and projects assisted by the County's Community Development Block Grant Entitlement allocation; WHEREAS,Federal regulation 24 CFR 570.489(e)(3)(iii) and HUD Notice CPD-04-11, dated October 27,2004, allows the Department and the County to formulate an agreement to transfer the State- grant-generated Program Income to the County's Entitlement program, the County has set up its Integrated Disbursement and Information System (IDIS) access and agrees to enter the receipt of the Program Income in IDIS and also agrees to track this new Program Income through its Entitlement program, and agrees to use the program income in accordance with the Entitlement program requirements; WHEREAS,the County is aware that this Program Income must now be used in accordance with Entitlement program rules; and Page 1 of 3 Packet Page -529- Jv 1/26/2016 16.0.2. Department and the County desire to implement changes to the disposition of Program Income generated from the Small Cities CDBG assisted project from this point forward, allowing the County to retain such Program Income to be distributed to and utilized by the County's Entitlement CDBG Program. NOW,THEREFORE, in consideration of the mutual promises of the parties contained herein, the parties agree as follows: 1. From the date of execution by both parties,the County shall retain all Program Income, as allowed by 24 CFR 570.489(e)(3)(iii)and administered in accordance with Section 104(j)of the Housing and Community Development Act of 1974, as amended, including any Program Income not previously remitted to the Department, and will submit all necessary reporting of Program Income to HUD. 2. The State-grant-generated Program Income shall be transferred to the County's Entitlement CDBG program. The County will track this new program income under its Entitlement program as required by HUD. 3. The County shall lease the facility,collect rent at a fair market value per Section(7) (H) in Attachment K of contract number OODB-6B-09-21-01-E 05, and convey such rent to the County's Entitlement program. 4. Such collections and remittances shall continue until December 31, 2023, based on twenty years as outlined in Section(6) (E)in Attachment K of contract number OODB-6B-09-21-01-E 05, with the commencement date being the Department's first receipt of Program Income from the County. 5. Prior to December 31, 2023, the County shall negotiate with HUD regarding Section(6) (C) in Attachment K of contract number OODB-6B-09-21-01-E 05, which requires that any lease extension beyond the initial 20 years be at fair market rates.
