1/12/2016 16.D.1. EXECUTIVE SUMMARY Recommendation to approve a Fourth Amendment to the Subrecipient Agreement with Habitat for Humanity of Collier County, Inc., to shift remaining project funds between line items in order to fully expend remaining awarded funds for Infrastructure Improvements. There is no net fiscal impact. OBJECTIVE: To provide affordable housing to low to moderate income persons in Immokalee. CONSIDERATIONS: The U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) program funds locally defined needs for programming and infrastructure. Collier County's CDBG FY2013-2014 Action Plan was approved at the August 13, 2013 In Absentia meeting (Agenda item 11A) and ratified at the regular Board meeting of September 10, 2013, (Agenda item 16F1). On January 28, 2014, the Board approved the Subrecipient Agreement with Habitat for Humanity of Collier County to engage in performing the environmental review, and construction of infrastructure for Phase 2C of the Faith Landing Development, an affordable single family housing development in Immokalee(Agenda item 16D11). On April 22, 2014, the Board approved the First Amendment to the Subrecipient Agreement, (Agenda item 16D7), to remove Davis Bacon provisions and clarify project requirements, and on December 9, 2014 the Board approved the Second Amendment, (Agenda item 16D17), to provide an extension for the installation of the road infrastructure for the project. On June 9, 2015, the Board approved the Third Amendment to the Subrecipient Agreement, (Agenda item 16D4), to include required milestones in the Exhibit D, clarifying beneficiary requirements and deadlines; include a repayment clause if a National Objective is not met; shift line items in the budget; and extend the project completion date from June 30, 2015 to December 31, 2017, to provide sufficient time to achieve a National Objective in accordance with 24 CFR 570.208. A Fourth Amendment is needed in order to shift funds from the Drainage/Landscaping and Project Delivery line items, where costs came less than expected into the Mobilization/Roadway line item, where costs came in higher than expected. The following table itemizes the changes. The grant award for this program is $500,000.It is budgeted in the Housing Grants Fund(705)for Project No. 33289. LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote for Board approval. -JAB GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this Amendment will further the Goals, Objectives, and Policies with the Housing Element of the Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners approves and authorizes the Chairman to sign the Fourth A mendment to the Subrecipient Agreement with Habitat for Humanity of Collier County, Inc. to shift remaining project funds between line items in order to fully expend awarded funds.
