EXECUTIVE SUMMARY
Recommendation to accept the "2016 Indexing Calculations" report, prepared by Tindale-Oliver
and Associates, in accordance with the adopted indexing methodology, and to adopt an Ordinance
amending Chapter 74 of the Collier County Code of Laws and Ordinances, which is the Collier
County Consolidated Impact Fee Ordinance,amending the Road Impact Fee rate schedule,which is
Schedule One of Appendix A, and the Correctional Facilities Impact Fee rate schedule, which is
Schedule Four of Appendix A, and providing for an effective date of September 12, 2016, in
accordance with the 90-day notice requirements set forth in Section 163.31801(3)(d), Florida
Statutes and to allow for impact fee deferral requests to be filed after the building permit was
received for those permits issued between June 23,2015 and June 23,2016.
OBJECTIVE: That the Board of County Commissioners (Board) adopts an ordinance amending Chapter
74 of the Collier County Code of Laws and Ordinances (Code) to provide for the incorporation of the
2016 Indexing Calculation and associated impact fee rates for Transportation (Road) Impact Fee and the
Correctional Impact Fee rates, and to allow for requests for impact fee deferrals to be filed after the
building permit was received for permits issued between June 23, 2015, when the Board reinstated the
Impact Fee Deferral Program, and June 23,2016.
CONSIDERATIONS: Sections 74-302 (Road) and 74-308 (Correctional Facilities)of the Code of Laws
and Ordinances (Code) require that in each of the two mid-cycle years between the formal three-year
updates,the County shall implement adjustments to the impact fee rates based on the percentages set forth
in the Impact Fee Indexing Study, as updated annually,and in accordance with the indexing methodology
specified in the current and adopted impact fee study.
On April 28,2009,the Board adopted Ordinance 2009-17,which amended the Code to reflect a change to
the use of a two-year average model from the 10-year regression analysis model to calculate the various
indices,as this method is intended to be more responsive to cost fluctuations.
On February 10,2015,the Board adopted Ordinance 2015-17 which amended the Code to incorporate the
Collier County Transportation Impact Fee Study Update and the Correctional Impact Fee Update Study
and amended the Road and Correctional Impact Fee rate schedules. The adopted rate schedules were
effective February 17,2015 (decreases)and May 11,2015 (increases).
The attached Indexing Calculation Report (Attachment A) was prepared by Tindale-Oliver and
Associates, Inc. for the 2016 annual indexing of Road and Correctional Facilities Impact Fees. Four
measures are used, alone or in combination, to calculate the indexing percentages for the various impact
fees.These measures include land costs,building costs,building equipment costs and transportation costs.
Based on this information, the total indexing percentage is then calculated for each of the individual
impact fees. The indexing percentage calculated in the attached report for Road Impact Fees is a 3.7%
increase, and the percentage calculated for Correctional Facilities Impact Fee is a 3% increase. The
proposed Road and Correctional Facilities Impact Fee Rate Schedules incorporating the increases are
shown in Appendix A of the attached Ordinance Amendment (Attachment B). The overall percentage
increase of the total impact fees on a single-family home with less than 4,000 square feet is approximately
1% as shown in Attachment C.
Recent bid activity has shown that roadway construction costs are increasing significantly. Staff will
continue to monitor these increases over the next several months and, in the event costs continue to
escalate, will move forward with a Road Impact Fee Cost and Credit Update to ensure that the impact fee
remains current with costs.

Emergency Medical Services (EMS), Government Buildings, Law Enforcement and Library Impact Fee
Update Studies are currently proceeding through their required full updates, are expected to be complete
within the next few months,and therefore,are not being indexed at this time.
On April 6, 2016, the Development Services Advisory Committee voted to accept the Indexing
Calculation report;however,they voted unanimously,with one abstention,to recommend that the fees not
be increased at this time.
On May 10, 2016, (Item 16.A.21) the Board directed the County Attorney to advertise for future
consideration an ordinance amending Chapter 74 of the Code in order to adopt the indexing
study and associated changes to the impact fee rates.
Additionally, the Impact Fee Deferral Program for owner-occupied units, which was suspended in
December 2009, was reinstated by the Board on June 23, 2015. The Code currently requires that any
person seeking a deferral shall file an application prior to receiving a building permit for the proposed
development. Subsequently, on April 26, 2016, due to some developers being unaware that the program
had been reinstated, the Board directed staff to amend the Code to allow applicants to file an application
for deferral after receiving a building permit for permits that were issued after the program was reinstated.
The proposed amendment is applicable to building permits issued between June 23, 2015 and June 23,
2016.
FISCAL IMPACT: Based upon current activity and historical collections, the projected increase in
revenue associated to the indexing in the first year after implementation, assuming that development
activity remains constant, is approximately $400,000 for Road Impact Fees and approximately $44,000
for Correctional Impact Fees. In addition, the aggregate amount of owner-occupied impact fee deferrals
per fiscal year will remain within the allowable limitation of 3% of the prior years' total impact fee
collections.
GROWTH MANAGEMENT IMPACT: The concepts of annual indexing and impact fee updates are
consistent with Objective 2 of the Capital Improvement Element (CIE) of the Collier County Growth
Management Plan (GMP) states: "Future development will bear a proportionate cost of facility
improvements necessitated by growth."
Additionally, this approach is consistent with Section 163.31801, Florida Statutes, which is the Florida
Impact Fee Act 2006,requiring the most recent and localized data be used in impact fee calculations.
LEGAL CONSIDERATIONS: This item is has been reviewed by the County Attorney, is approved as
to form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board accepts the"2016 Indexing Calculations"report and adopts an
Ordinance amending Chapter 74 of the Collier County Code of Laws and Ordinances amending the Road
Impact Fee and the Correctional Facilities Impact Fee rate schedules, providing for an effective date of
September 12, 2016 in accordance with the 90-day notice requirements set forth in Section
163.31801(3)(d), Florida Statutes and allowing for impact fee deferral requests to be filed for any
building permits that have been issued between June 23,2015 and June 23,2016.

I. Introduction
Collier County retained Tindale Oliver to calculate the updated indices for the following
program areas:
• Correctional Facilities
• Transportation
Updated school and parks impact fees were adopted in 2015, and the County is currently
updating the technical studies for government buildings, emergency medical services
facilities, law enforcement facilities, and library facilities. As such, indices for these
program areas are not included in this document. In addition, per recommendation of
the County's Consultant, water and wastewater impact fees are not indexed.
This technical report provides a summary of the updated indices and the calculations of
combined indices for the program areas listed above.

II. Calculation of Indices
As part of the calculations, the following indices were updated:
• Collier County Property Values;
• Consumer Price Index (CPI);
• Producer Price Index (PPI) (for equipment and highway construction separately);
• Engineering Building News (ENR) Record Building Cost Index;
• Turner Building Cost Index; and
• RS Means Building Cost Index
• Florida Department of Transportation (FDOT) Average Roadway Construction
Cost, based on data from District 7
Table 1 presents the updated individual indices that will be used in the calculation of the
overall indices for each program area. The table also provides a comparison to 2012
indices. It should be noted that the indices were calculated based on the most recent two
years of data available, 2014 and 2015 (through the latest month/quarter available).
Consistent with the adopted indexing methodology, for building cost index, ENR, RS
Means, and Turner Building Cost indices were used. In the case of equipment/vehicle
cost index, CPI and PPI for equipment were used. The land index is based on data from
the Collier County Property Appraiser. The roadway construction index utilizes a
combination of PPI Highways and FDOT District 7 data for 2014 and 2015.

THE COLLIER COUNTY CODE OF LAWS AND ORDINANCES

SCHEDULES ONE AND FOUR, OF APPENDIX A, WHICH ARE THE
TRANSPORTATON (ROAD) AND CORRECTIONAL FACILITIES

WHEREAS. Collier County uses impact fees to supplement the funding of necessary
capital improvements required to provide public facilities to serve new population and related
development that is necessitated by growth in Collier County; and
WHEREAS, on March 13. 2001, the Board of County Commissioners adopted
Ordinance No. 2001-13, the Collier County Consolidated Impact Fee Ordinance, repealing and
superseding all of the County's then existing impact fee regulations, and consolidating all of the
County's impact fee regulations into that one Ordinance, codified in Chapter 74 of the Collier
County Code of Laws and Ordinances (the "Code"); and
WHEREAS, in October of 2002 the Board of County Commissioners directed that
during the upcoming required three-year updates of the individual impact fees that methodology
also be developed to provide for the annual indexing of the fees in the years between the formal
updates; and
WHEREAS, on February 28, 2006, the Board of County Commissioners directed that
the indexing methodology for each of the impact fees be reviewed and revised, as appropriate, to
reflect localized information; and
WHEREAS, Collier County retained Tindale-Oliver & Associates, Inc. to complete the
study to localize the indexing methodologies; and

WHEREAS, on June 26, 2007 the Board of County Commissioners adopted Ordinance
2007-57, thereby adopting the "Collier County Impact Fee Indexing Study," and amending the
Code to reflect the new indexing provisions and amended rates; and
WHEREAS, Tindale-Oliver and Associates, Inc. completed the report titled the "Collier
County Indexing Methodology Study, " which amended portions of the adopted "Collier County
Impact. Fee Indexing Study" and recommended that a two-year average be utilized to calculate
the various indices; and
WHEREAS, on April 28, 2009, the Board of County Commissioners adopted Ordinance
No. 2009-17, amending the Code by implementing the revised indexing methodology; and
WHEREAS, on February 10, 2015, the Board adopted Ordinance No. 2015-17, thereby
amending Schedule One and Schedule Four of Appendix A of Chapter 74 of the Code, and
establishing the County's then current Transportation (Road) and Correctional Facilities (Jail)
Impact Fee rates; and
WHEREAS, in 2016, Road and Correctional Facilities, are scheduled to be indexed,
using the adopted methodology; and
WHEREAS, Tindale-Oliver and Associates, inc. completed the report titled "2016
Indexing Calculations"resulting in an increase in rates of 3.7% for Road. and an increase in rates
of 3% for Jail; and
WHEREAS, staff has thoroughly reviewed the calculations and findings and concurs
with the results of the calculations and the study; and
WHEREAS, staff recommends that the Board of County Commissioners adopt this
Ordinance to implement the recommended changes; and
WHEREAS, Section 163.31801, Florida Statutes, which is the Florida Impact Fee Act,
requires the most recent and localized data be used in impact fee calculations and this annual
index complies with that requirement.
WHEREAS, the Impact Fee Deferral Program for owner-occupied affordable housing
deferrals was suspended in 2009 and was reinstated on June 23, 2015.
WHEREAS, Section 74-401 of Chapter 74 of the Code of Laws and Ordinances requires
that any person seeking a deferral shall file an application prior to receiving a building permit for
the proposed development.

WHEREAS, on April 26. 2016, the Board of County Commissioners, due to some
developers being unaware that the deferral program had been reinstated, directed staff to amend
Section 74-401 to allow applicants to file an application for owner-occupied deferrals after
receiving a building permit for permits that were issued after the program was reinstated.
WHEREAS, staff recommends the Board of County Commissioners amend the Code to
allow applicants to file for an owner-occupied deferral after receiving a building permit for
permits that were issued between June 23, 2015 and June 23, 2016.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE. Appendix A of Chapter 74 of the Collier County Code of Laws and
Ordinances is hereby amended as set forth in the attachment to this Ordinance.
SECTION TWO. Article IV. Affordable Housing Impact Fee Deferral, Section 74-401, Impact
fee deferral, of the Collier County Code of Laws and Ordinances is hereby amended to read as
follows:
Section 74-401. Impact fee deferral
(a) Applicability
(2) Any person seeking an affordable housing deferral for proposed development shall
file with the county manager an application for deferral, prior to receiving a building
permit for the proposed development, or after receiving a building permit for those
permits issued between June 23. 2015 and June 23. 2016. The application for deferral
shall contain the following:

SECTION THREE. CONFLICT AND SEVERABILITY.
In the event this Ordinance conflicts with any other Ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a
separate, distinct, and independent provision and such holding shall not affect the validity of the
remaining portions.
SECTION FOUR. INCLUSION IN THE CODE OF LAWS AND ORDINANCES.
The provisions of this Ordinance shall be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-
lettered and internal cross-references amended throughout to accomplish such, and the word
"ordinance" may be changed to "section,""article,"or any other appropriate word.
SECTION FIVE. EFFECTIVE DATE.
This Ordinance shall be considered adopted upon the date written below; however, the
effective date of the fee schedules shall be delayed to September 12, 2016.

Board of County Commissioners will consider the enactment of
County Ordinance, The meeting will commence at 9:00 A.M. The
title of the proposed Ordinance is as follows:

OF COLLIER COUNTY,FLORIDA,AMENDING CHAPTER 74 OF
THE COLLIER COUNTY CODE OF LAWS AND ORDINANCES
(BEING THE COLLIER COUNTY CONSOLIDATED IMPACT
FEE ORDINANCE, NO. 2001-13, AS AMENDED) AMENDING
SCHEDULES ONEAND FOUR,OFAPPENDIXA,WHICH ARE THE
TRANSPORTATON(ROAD)AND CORRECTIONAL FACIUTIES
(JAIL) IMPACT FEE RATE SCHEDULES, IN ACCORDANCE
WITH THE ADOPTED INDEXING METHODOLOGY,UTILIZING
A TWO-YEAR AVERAGE, PROVIDING FOR CONFLICT AND
SEVERABILITY;PROVIDING FOR INCLUSION IN THE COLLIER
COUNTY CODE OF LAWS AND ORDINANCES;PROVIDING FOR
A DELAYED EFFECTIVE DATE OF SEPTEMBER 12,2016;AND
AMENDING SECTION 74.401(a)(2)TO ALLOW ANY PERSON
SEEKING AN OWNER-OCCUPIED AFFORDABLE HOUSING
DEFERRAL TO FILE AN APPLICATION AFTER RECEIVING A
BUILDING PERMIT FOR THOSE PERMITS ISSUED BETWEEN
JUNE 23,2015 AND JUNE 23,2016.
Copies of the proposed Ordinance are on file with the Clerk
to the Board, and are available for inspection. All interested
parties are invited to attend and be heard.
NOTE: All persons wishing to speak on any agenda item must
register with the County administrator prior to presentation of
the agenda item to be addressed. Individual speakers will be
C limited to 3 minutes on any item. The selection of an individual
M to speak on behalf of an organization or group is encouraged.
If recognized by the Chairman, a spokesperson for a group or
v organization may be allotted 10 minutes to speak on an item.
cPersons wishing to have written or graphic materials included in
the Board agenda packets must submit said material a minimum
of 3 weeks prior to the respective public hearing. In any case
written materials intended to be considered bythe Board shall
be submitted to the appropriate County staff a minimum of
seven days prior to the public hearing. All material used in
presentations before the Board will become a permanent part
>:; of the record.
Any person who decides to appeal a decision of the Board
y will need a record of the proceedings pertaining thereto and
c therefore, may need to ensure that a verbatim record of the
proceedings is made,which record includes the testimony and
