EXECUTIVE SUMMARY
Recommendation to reallocate tourist development funds in the amount of$310,000 from Category
"A" beaches to Category "D" fishing piers to replace the Ann Olesky Fishing Pier, with a
supermajority vote of the Board,and to make the finding that the project promotes tourism.
OBJECTIVE: To obtain funding for the replacement of the Ann Olesky Fishing Pier.
CONSIDERATIONS: The Ann Olesky Fishing Pier, located on Lake Trafford in Immokalee, has been
in existence since 1985. The park provides the only public fishing pier to the largest freshwater lake
south of Lake Okeechobee. Since the completion of the Lake Trafford Restoration Project in 2011
visitation to the park has increased annually by 1,000 visitors. A 2016 inspection of the pier by Bridging
Solutions recommends full replacement of the structure. In addition, an ADA compliant concrete
approach walkway will be added.
FISCAL IMPACT: TDC Category"A" funds currently in Beach Park Facilities Fund(183)reserves,in
the amount of$310,000, are proposed to be reallocated to Fishing Piers Category"D" in TDC Beach Re-
nourishment Fund(195).
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to
this action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney. Pursuant to
Section 125.0104, Fla. Stat. and County Ordinance No. 92-60, as amended, fishing piers may be funded
with tourist development tax funds. The County Ordinance provides that the fishing pier fund, Category
"D", shall be funded to a maximum of $200,000 per year, which moneys have been allocated to the
Naples Pier for the next several years. From a legal standpoint, the Board could fund the Lake Trafford
Pier by using TDC tax funds with a supermajority vote by reallocating funds either out of Category A, a
portion of Category B, or Category C. The Board has historically reallocated this type of expenditure
from Category A. The Board could also fund this project by simple majority vote using general funds, as
is typical with Park and Recreation projects.With that noted,this item is approved as to form and legality,
and requires either supermajority vote (if a reallocation of TDC funds is made) or by majority vote (if
general funds are used). -JAK
ADVISORY BOARD RECOMMENDATION: The Tourism Development Council supports the
expenditure and that it is was a project that promotes tourism on April 25, 2016 with a vote of 8-0 in
favor. The Parks and Recreation Advisory Board recommended the expenditure on April 27,2016 with a
vote of 7-0 in favor.
RECOMMENDATION: That the Board of County Commissioners reallocate tourist development
funds in the amount of $310,000 from Category "A" beaches to Category "D" fishing piers with a
supermajority vote of the Board, authorize any necessary budget amendments, and make the finding that
the project promotes tourism.
