SUMMARY OF PRESENTATION Staff proposes two options to lessen the impact that issuing beach parking permits has on county staff. The first option is to allow anyone who has a Collier County license plate to park for free. The second option is to have the tax collector give a sticker when issuing a license plate. The sticker will be provided by the Parks and Recreation budget. If additional space is needed please use blank sheet. LAWS AND ORDINANCES; 20 PROVIDING AN EFFECTIVE DATE. 21 22 WHEREAS, Collier County has adopted Ordinance No. 89-11, as amended, known and 23 cited as the "Collier County Water Safety and Vessel Control Ordinance"; and 24 WHEREAS, Section Seven of Ordinance No. 89-11, as amended, (codified as Section 25 146-39 of the County's Code of Laws and Ordinances) specifies certain beach vendor permit 26 requirements; and 27 WHEREAS, because further clarification is needed in this Ordinance, the County Parks 28 and Recreation Department and the County's Park Rangers Administration have requested that 29 Section Seven of the Beach and Water Safety Ordinance be amended (a) to clarify the long- 30 standing policy that all Collier County beach vendors who are permitted/licensed by the County 31 must conduct their land operations only on beach front land that is situated within the north and 32 south geographic boundaries of the immediately adjacent upland property, and (b) such activities 33 must be conducted only for such time as the respective beach vendor has active and currently 34 valid permission from the upland owner to occupy the respective uplands and from there conduct 35 all of the activities then authorized by the Collier County beach vendor's permit/license; and 36 WHEREAS, the Collier County Parks and Recreation Department and the County's 3 7 Park Rangers Administration have requested that Section Seven of the Beach and Water Safety 38 Ordinance be amended to authorize the Director of Parks and Recreation to impose special 39 conditions as deemed necessary by the Director to be applied to a renewal of a beach vendor 40 permit/license if that beach vendor did not fulfill each and every condition of the prior year's Words underlined are added; words COMMISSIONERS OF COLLIER COUNTY, FLORIDA,that: 7 8 SECTION ONE: AMENDMENTS TO SECTION SEVEN OF COLLIER COUNTY 9 ORDINANCE NO.89-11,AS AMENDED. 10 Subsection (1) of Section Seven'of Collier County Ordinance No. 89-11, as amended, is 11 hereby amended to read as follows: 12 SECTION SEVEN: CONCESSION OPERATIONS, EQUIPMENT RENTALS AND 13 VENDORS ON THE BEACH AND ADJOINING WATERS. 14 The safety and welfare of the persons that reside nearby the county's beach areas and of 15 the public that recreate on the beach and adjoining waters makes necessary and appropriate the 16 following regulations: 17 (1) Beach Vendor Permit Requirement. Any person or entity to be engaged in the 18 rental, leasing, bailment for consideration, or otherwise providing transportation for 19 remuneration, ef—any motorized or wind-driven vessel for use by the public on the beach or 20 adjoining waters of the county, including any personal watercraft jet skis and/or sailcraft, shall 21 be required to obtain a beach vendor permit/license from the county. A beach vendor 22 permit/license shall issue and be maintained upon the applicant paying such application fee 23 therefor as established from time-to-time by the county by Resolution. The applicant must meet 24 arid-meeting the following requirements: 25 a. The applicant must have an operations office or headquarters located at a land- 26 based location in an •he--immediate area immediately adjacent to where the vessels 27 permitted/licensed activities are beg to be provided for public use. The 28 office/headquarters must be located only on land that is seaward of the main building that 29 is immediately adjacent to that adjoining beach. The land based operations/activities Words underlined are added; words Neagh are deleted. -2- (E) 15 A.rir, 1 must be conducted wholly within the two (2) seaward projections of the north/south 2 property lines of the respective upland parcel, and the office/headquarters must have-with 3 direct and immediate physical access to en the beach and salt water. In the event that the 4 permittee/licensee has its authorization to occupy the land where the office/headquarters 5 terminated, withdrawn or cancelled by the upland landowner, or from whatever other 6 person or entity authorized that permittee/licensee to occupy said upland, that loss of right 7 of occupancy of that land shall automatically and concurrently cancel and render void the 8 then existing Collier County beach vendor's permit/license. 9 b. The applicant must have and maintain a telephone and marine radio at its land- 10 and-1o based operations office. 11 c. The applicant must have a motorized chase boat with operational marine radio in 12 good running condition that meets all U.S. Coast Guard safety requirements. That boat 13 must he kept at the vessel rental site during all hours of applicant's rental operations. 14 d. The applicant must have and maintain comprehensive general liability insurance 15 with coverage not less than the amount of$500,000.00 combined single limits. 16 e. The applicant shall provide a list describing and indicating the state vessel 17 registration number of each motorized vessel applicant shall places in service. Each 18 motorized vessel placed in service for public use after under a Collier County beach 19 vendor's permit/license has—issued shall have a state vessel registration number affixed 20 thereon at all times. 21 f. The applicant shall provide proof of-Having at least fairtimally one (1)operational 22 life vest for each occupant space on each of the vessels to be offered for public use under 23 this section. 24 g. The applicant must provide a site plan for the beach operation that includes the 25 operation's boundaries on the beach and the ingress and egress points to that operation. 26 No operation boundary shall extend into any pedestrian pathway. 27 h. If a permit/license holder violates any condition of the beach vendor 28 permit/license during any permit/license year and has been notified by the County in 29 writing of the violation, the Director of Parks and Recreation is authorized to impose • Words underlined are added; words 43-6.wwwk—t-4+r-awg4 are deleted. -3- (E) 16 • 1 conditions on the subsequent annual beach vendor's permit/license (a probationary 2 permit/license), including issuing a month-to-month permit/license that shall be 3 summarily voidable for any similar or dissimilar violation of any of the permit/license 4 condition(s). 5 i. The applicant is required to obtain a county occupational license for its operations 6 office required under this section. To obtain an occupational license, the applicant must 7 provide proof of having a current, valid beach vendor's permit. Revocation of the 8 occupational license shall thereby automatically void the respective beach vendor 9 permit/license. 10 11 SECTION TWO: CONFLICT AND SEVERABILITY. 12 In the event this Ordinance conflicts with any other ordinance of Collier County or other 13 applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held 14 invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a 15 separate, distinct and independent provision and such holding shall not affect the validity of the 16 remaining portion. 17 18 SECTION THREE: INCLUSION IN THE CODE OF LAWS AND ORDINANCES. 19 The provisions of this Ordinance shall become and be made a part of the Code of Laws 20 and Ordinances of Collier County, Florida. Objective: That the Board of County Commissioners consider alternative methods for distributing beach-parking permits. Consideration: The current method of issuing beach parking permits has impacted County staffs ability to fulfill their other customer service-related functions such as programming and scheduling. Over the last eleven months, Veterans Community Park utilized over 1067 staff hours logging 16,000 permits, and East Naples Community Park utilized 467 staff hours1 logging 7,000 permits. In terms of staff positions, these hours are worth approximately .5 FTE's at each park site. Moreover, this figure will rise in 1999,as all of the permits issued over the last two years will expire. The Board tentatively addressed this issue through a proposal initiated during the FY99 budget process. This proposal recommended a new five-dollar($5)handling fee for each beach sticker issued by the County. The$125,000 revenue from this fee would then subsidize 2 FTE's that would have been shared between Veterans Park, East Naples Park, and Vineyards Park. These positions would be utilized to issue beach parking stickers and replace the staff time that could then be used for programming in the parks and enhanced park safety that has been supplanted by the time necessary to issue stickers. Although this option has been tentatively approved as part of the FY 99 budget, there was concern that the charge for a "free" beach parking sticker, although nominal,would be very negatively received and that other alternatives should at least be presented for the Board's consideration. The first alternative option is to distribute a beach-parking permit to ALL registered County vehicles as a standard procedure of the Counfy Tax Collector's Office. This option encompasses all specialty plates registered in Collier County in addition to the standard issue County plates (156,000 combined total)2 and it will almost entirely eliminate the impact on staff with the exception of issuing permits to seasonal property owners. With this, it is also proposed that two part-time Program Leader I positions (one FTE), would be eliminated. However projected revenues from the new sticker handling charge would be decreased by$125,000 and the expected programming revenue generated by the two positions($8,000)would also be lost. The second alternative option is to allow residents with the standard issue Collier County license plate to park at the beaches without a sticker. Staff estimates that this option will reduce the impact on staff by approximately 2/3 of the total permits issued3. As with the first option,two part-time Program Leader I positions(one FTE)will be eliminated,partially offsetting the $133,000 lost revenue. This option is viable as it will substantially reduce the impact on staff and it does not involve the Tax Collector's Office. Again, the revenues associated with the beach sticker handling charge would be eliminated as would the revenues associated with the programming of the two Program Leader I positions. In both of these alternative options one of the two expanded positions has been retained, as the position had also been targeted to be responsible for the after school and summer camp programs which have grown to the point where safety concerns, warrant having one additional staff person administratively involved. The third option is to leave the budget as currently proposed to the Board for FY99. Growth Management: There is no growth management impact associated with this item. Dept. It was an arbitrary decision made by the Park & Rec. Dept. and their immediate superior , it was unfair to the City of Marco, and the City of Marco was not properly informed prior to the removals . Furthermore, some removals took place in a devious and crafty manner . ( I refer to the $3000 . ice machine at the Racquet Center ) . It would seem to me that in the interest of mutual responsibility that there should have been some preliminary negotiations take place. This activity has created further tension between the City and County, and has very much alarmed a number of County Commissioners. It is unfortunate. . . .
