RE: Fee Policy
Please find attached a copy of the proposed fee policy for the
1997 FY.
A committee has reviewed the existing policy and recommended
changes. The changes in the policy remove a lot of the wording,
which they feel should be in the Department's Policy and
Procedure Manual instead of the fee policy. The committee's goal
was to make the fee policy user friendly.
Please review and provide me with any recommendations you may
have.

Thank you very much for your letter of July 25, 1996.
One of the things that I would encourage you to do is to check with Mr. Brinkman and Mr. 011iff
for details of information rather rely on news media sources, as sometimes the issues can get
confused before they are made public.
Second, this may be a good time to remind you that the Parks and Recreation Advisory Board is
an advisory group and does not have final decision-making authority on Parks and Recreation
matters. While the Board of County Commissioners certainly appreciates the fine work and
research that PARAB does for the Board, ultimately the decision-making responsibilities still rest
with the County Commission.
At the same time, you do raise some very important issues in your letter and I am forwarding a
copy of this letter to Mr. 011iff so that he may respond to me on the issues that you have raised.
Once again, Mr. Zaks, thank you for writing. If I can be of service to you in the future, please let
me know.

COLLIER COUNY PARKS AND RECREATION
DEPARTMENT FACILITIES AND OUTDOOR AREAS
LICENSE AND FEE POLICY
I. PURPOSE
The purpose of this policy is to ensure maximum use of facilities, outdoor areas and programs in
Collier County and provide equitable fees and charges collected from users of such facilities,
outdoor areas or programs.
II. LIMITATIONS
The Parks and Recreation Director, or designee, may waive enforcement or application of any of _
these regulations or restrictions with respect to any facility, outdoor areas, or program provided
such waiver does not interfere with public safety or enjoyment. No fees may be waived except as
noted in section III (B) (1). No non-government entity shall charge an admission fee to any out
of doors event.
The Board of County Commissioners shall set fees and charges for all facilities and programs.
Consistent with Collier County's policy of ensuring all citizens equal opportunity to participate in
programs, any resident requesting special consideration must substantiate to the Parks and
Recreation Director proof of financial need. All information provided will be confidential and used
only for the purpose of establishing for reduced or waived program fees.
III. CLASSIFICATIONS
A. Facility License Definitions and Uses
1. Outdoor Areas: Open space or land owned or leased by Collier County. Such outdoor
areas shall include, but not limited to, sports fields, playgrounds, and/or other park and
recreation land areas, excluding Golden Gate Community Center. (As to Golden Gate
Community Center, refer to section M, herein). Outdoor areas shall be used for those
purposes designated or implicit in their character. Any deviation from normal appropriate
use shall require express prior permission from the Parks and Recreation Director or
designee.
2. Facilities: Buildings and dwellings owned or leased by Collier County. Such facilities
include, but are not restricted to, community center areas and rooms, gymnasiums,
swimming pools, pavilions, shelters, and other areas located in the Parks and Recreation
structures. (As to Golden Gate Community Center, refer to Section M, herein). Facilities
shall be used for those purposes designated or implicit in their character. Any deviation
from these intended normal uses shall require express prior permission from the Parks and
Recreation Director, or Designee.
3. Programs: Recreation activities conducted on land or in facilities owned or leased by Collier
County. Such activities include, but are not restricted to, athletic, clinics, instructional,
interpretative, seminars - preschool, youth, adult, senior and special populations. Any
deviation from these intended normal uses shall require express permission from the Parks
and Recreation Director, or designee.
4. Vehicle Parking Fees: Parking lots at Collier County beach parks and access. To
include, but not limited to, the following: Tigertail Beach, Barefoot Beach Access, Barefoot
Beach Park, Clam Pass Park, Vanderbilt Beach, Gulfshore Access, and South Marco Beach
Access.
5. Boat Vehicle Parking Fees: Parking lots at Collier County owned and operated boat launch
facilities to include, but not limited to, Bayview Park, Cocohatchee River Park, Caxambas
Park.
B. USER CATEGORIES - APPLICABLE TO ALL INDOOR AND OUTDOOR AREAS.
Each Category II individual, group, organization or entity must pay full fees at all times.
Unless totally fee exempt, Category I individual, group, organization or entity must pay a
$5.00 per hour license fee. The following private groups, organizations or entities are
exempt from all fees provided no activity is fund raising and the activities are conducted
during the facilities normal operating hours: (1) Specified sale tax exempt entities: The
group is exempt from Florida sales taxes pursuant to Subsection 212.08 (7), F.S. as a home for
the aged, nursing home, or hospice, or as an organization whose primary purpose is to provide
special educational, cultural, recreational, or social benefits to minors, or is a religious,
charitable, scientific, educational, or veteran's institution; (2) Local not - for - profit civic
associations: Irrespective of any tax exemption, each not - for - profit corporation, organization
or other not - for - profit group that is of Collier County origin, has its principal location in
Collier County, at least fifty percent (50%) of the group's membership are residents of Collier
County and the entity's primary purpose is to provide social services to others or to protect
interests outside of the group, such as the environment, endangered animals, disadvantaged
persons, or some other similar external interests. The primary focus of these groups is outward
looking and away from the personal interests of the groups members. Each private individual,
group, organization or entity involved in any fund raising activity must pay full fees.
Governmental entities are always totally fee exempt. The two categories are:
i
1. CATEGORY I - Other Federal Income Tax Exempt Entities, Registered Charities, Not -
For -Profit Groups That Are Not Totally Fee Exempt.
A. Federal Income Tax Exempt Entities.
Any individual, group, organization or entity that has a Certificate of Federal Income
Tax Exemption under any subsection of Section 501 ( c ) of the Internal Revenue
Code, including each charitable entity that is registered with the State of Florida.
B. Other Local Not - For- Profit Groups.
Irrespective of any tax exemption, each not - for - profit group that is of Collier County
origin, has its principal location in Collier County, at least fifty (50%) of the members
are residents of Collier County, but the group's primary purpose is not to provide social
services to individuals who are not bona fide members of the group or is not to
protect interests outside of the group. This category includes property owner's
associations, political groups, and all other special interest oriented clubs such as
hobbyists' clubs; chess clubs, radio clubs, hunters and fishermen
clubs; stamp, coin, and other collectors' clubs; garden clubs, car clubs, and all other
similar clubs, groups or organizations. The primary focus of these groups is inward
toward the group's members.
C. Fund raising activities include:
1. Charging in advance for an admission ticket or requiring any tangible thing of value
for admission to, or to participate in, any activity at any County parks facility, or,
2. Requiring any donation of money or any other tangible thing of monetary value, or,
3. Selling or bartering any tangible thing of monetary value.
Exceptions: Fund raising activities do not include:
1. Season sign up fees for persons to join league as a team member or team participant.
2. Sale of educational materials for use as study materials for students attending class
conducted at the park facility. Such sales must be at or below the seller's actual
costs.
2. CATEGORY II - All Others.
A. Each individual, group, organization or entity that is not within Category I.

D. Vehicle Parking Facilities
Beach and boat parking facilities, including but not limited to, Barefoot Beach Park,
Barefoot Beach Access, Vanderbilt Beach Park, Clam Pass Park, Gulf Shore Access,
Tigertail Beach, South Marco Beach Access, Cocohatchee, Bayview Park, and Caxambas
Park have a fee, inclusive of sales tax, at a rate of$3.00 per day. Collier County Residents
with beach parking permits will be exempt from the $3.00 per day fee.
Collier County residents may obtain a beach parking permit at no charge. Vehicles with
permits will not be charged a fee. Boat vehicle parking permits may be purchased by all
residents or visitors for an annual fee of$60.00. Permits are available at all Collier county
Parks and Recreation community centers.
E. Concession Fees
1. Concession Booth/Location in conjunction with Rental
A $25.00 fee or 20% of gross revenues per day, whichever is greater, for each
concession booth or location.
2. Concessionaires contracted by the County to serve the general public will pay a
negotiated fee in lieu of the general facility use fee schedule.
F. Marketing Fees
1. Marketing fee of$5.00 included in, but not limited to, the following; instructional
• classes meeting more than once, one-time special instructional programs, Summer
Camps, After School Camps, County Athletic Leagues.

G. Instructional Fees
1. Programs Fee Assessment: per hour or per participant basis.
2. Marketing Fee: Instructional classes meeting more than once or one-time special
instructional programs include a $5.00 marketing fee.
3. Non-Staff Instructor: marketing fees and any costs for supplies and equipment will be
subtracted from the class fee and the balance of the funds will be split between the non-
staff instructor and the count on a 70% (non-staff instructor) - 30% (County) basis.

5. Service and Sale of Alcoholic Beverages
A. Serving of Alcoholic Beverages
These provisions apply for any event where alcoholic beverages will be available.
No alcohol may be made available without a valid Certificate of Insurance on file at
the Golden Gate Community Center.
1. User categories Class I and Class II, as previously defined in M(2), the user
must present a General Liability Policy or a Special Events Policy for the date of
use, which policy specifically includes contractual liability and host liquor
liability in an amount of not less than three hundred thousand dollars
($300,000) at least four (4) weeks prior to the event.
2. User Categories Class IV and Class V, as previously defined in M(2), the user
must present a General Liability Policy for the date of use which specifically
includes contractual liability and host liquor liability in an amount not less than
five hundred thousand dollars ($500,000) at least four (4) weeks prior to the
event. As determined by the County Risk Management Director, in the event of
above average exposure five hundred thousand ($500,000) liability coverage
shall be required. In the event of unusual or high exposure one million dollar
($1,000,000) liability shall be required.
B. Sale of Alcoholic Beverages
In the event any user intends to sell alcoholic beverages, they will be required to
meet all State requirements regarding the sale of alcohol and obtain all required
permits. Copies of said permits shall be filed with the Center Supervisor. The
Center Supervisor shall contact Collier County Department of Risk Management for
insurance requirements.
C., Rules and Regulations For Users Serving Alcoholic Beverages
1. It is the responsibility of the user that no alcoholic beverage shall be allowed
outside assigned meeting room(s)/auditorium.
2. The user is responsible to ascertain that no alcoholic beverage shall be served to
any person under the age of 21.
3. The user shall be responsible for the behavior of any parties with the user's
group.
4. The user shall be responsible to assure that no alcoholic beverages are served
during the last thirty (30) minutes of user's scheduled event.
5. The user will be responsible for supplying a Certificate of Insurance at least four
(4) weeks prior to scheduled event (see insurance provisions).
6. The user will be responsible to comply with Florida Statute, Chapter 562.
7. The user must abide by all other operational policies and procedures of the
Golden Gate Community Center. Any violation can result in termination of the
event.

Dear Commissioner Norris:
Last month, there were two articles in the Naples Daily News which drew my attention.
4 I brought these articles to the attention of the Parks and Recreation Advisory Board during our
June meeting. The Board requested that I write this letter to you to express our concern
regarding these two items.
It was reported in the June 23 edition of the Naples Daily News that the construction of
the South Naples Community Park would be delayed due to funding commitments which had

been made for the development of Sugden Regional Park.
First, the budgeting for the construction of a community park should not be impacted by
the budgeting for regional parks. As you know, the impact fees for community parks and
regional parks are separate and distinct. Therefore, the development of Sugden Regional Park
should have no effect on the budgeting process for the South Naples Community Park, which.
has been in the planning stages for many years now.
Additionally, this spring the Parks and Recreation Advisory Board was presented with
alternative funding plans which the County had spent substantial time developing with respect
to the South Naples Community Park. At that time, we were asked to consider whether it would
be in the best interest of the County to develop the South Naples Community Park in phases with
the currently available money being used for the initial phase. Subsequent phases would be
funded as additional funds became available. The alternative was to borrow the additional cash
required to develop the entire park in the next fiscal year. After considering the additional costs
for developing the park in phases, it seemed clear to the Parks and Recreation Advisory Board

that the best alternative was to use the currently available cash and additional funds generated
through borrowing to develop the park as a whole in the next fiscal year.
It was with great disappointment that I read the article in the Naples Daily News that said
that the South Naples Community Park would be delayed until the 1998-99 fiscal year. I would
question what transpired between the Parks and Recreation Advisory Board meeting and the
announcement in the June 23 edition of the Naples Daily News to completely change the funding
picture for this park.
On Tuesday, June 25, 1996, the Collier County Commission approved a cost sharing
agreement with the Naples Roller Hockey, Inc. group for the development of two roller hockey
rinks at the Veteran's Community Park in North Naples. This was reported in the June 26,
1996 edition of the Naples Daily News.
In late 1995, the Naples Roller Hockey group presented a proposal to the Parks and
Recreation Advisory Board requesting that land be set aside at the Veteran's Community Park
for the purpose of constructing two roller hockey rinks. One was to be an open rink and the
other was to be a covered rink. The Naples Roller Hockey group indicated that if the County
contributed the land, the Roller Hockey group would be responsible for raising all the funds
needed for the construction of the rinks.
At this meeting, the Parks and Recreation Advisory Board indicated that we would be
happy to recommend setting aside the land necessary to develop the rinks if the County was not
responsible for any construction costs. The hockey group indicated to us that in fact they would
be raising all of the funds and would not be looking to the County for any funding. On that
basis, the Parks and Recreation Advisory Board unanimously endorsed the concept of
constructing the roller hockey rinks at Veteran's Community Park.
The Parks and Recreation Department had budgeted $177,000 for the construction of a
covered basketball court at Veteran's Community Park. This was separate and distinct from the
construction of the roller hockey rinks.

The cost sharing agreement entered into between the County and Naples Roller Hockey,
Inc. was a substantial change from the concept which the Parks and Recreation Advisory Board
initially endorsed. What was originally going to be three recreation facilities, that is, two roller
hockey rinks and a covered basketball court, has now been reduced to two facilities. Instead of
the roller hockey group paying for the construction of the two roller hockey rinks and the
County paying for the construction of the covered basketball court, the County is subsidizing the
construction of the roller hockey rinks. What did we get in trade for this subsidy? Instead of
having a covered basketball court available for the citizens 100% of the time, we will offer our
citizens the shared use of the covered roller hockey rink. When the Naples Roller Hockey, Inc.

group is not using the facility for roller hockey, it can also be used for basketball. I believe the
County came out a loser in this agreement. I think it would behoove the Commissioners to
determine why the original proposal was modified in this fashion.

SECUTIVE SUMMARY
RECOMMENDATION TO APPROVE A RESOLUTION RECOGNIZING SUGDEN
REGIONAL PARK CONTRIBUTION FOR SITE IMPROVEMENTS.
OBJECTIVE: To obtain Parks and Recreation Advisory Board
approval of a Resolution which recognizes a contribution to
future site improvements for Sugden Regional Park.
CONSIDERATIONS: Representatives of the Estate of Daniel P.
O'Brien, Jr. , deceased, have requested the right to participate
in future improvements to the Sugden Regional Park consistent
with approved master plans in return for the right to place a
plaque in tribute to Mr. Daniel P. O'Brien. The plaque and
placement shall be in accordance with existing Parks and
Recreation Policy. To confirm the above, the attached Resolution
has been prepared with the intent that the participation in site
improvements would involve one or more of the following needed
improvements: (a) Development of the Park Lake Trail;
(b) Development of the Park Picnicking Area; and/or (c) Develop-
ment of the Fishing Pier.
FISCAL IMPACT: Not applicable to Resolution approval. Funding
toward public facility improvements would be from the private
sector.
GROWTH MANAGEMENT IMPACT: Not applicable to Resolution approval.
RECOMMENDATION: That the Parks and Recreation Advisory Board
approve the attached Resolution for private party participation
in Sugden Park improvements, and placement of tribute in
accordance with County Policy and subject to controls as may be
established by the Parks and Recreation Director.

RESOLUTION OF PARKS AND RECREATION
ADVISORY BOARD
A RESOLUTION RECOGNIZING PARTICIPATION IN SITE IMPROVEMENTS
FOR SUGDEN REGIONAL PARK.
WHEREAS, the Board of County Commissioners has purchased the property
designated as the Sugden Regional Park; and
WHEREAS, a Regional Park Master Plan is being developed for the Sugden
Regional Park; and
WHEREAS, private participation has resulted in the purchase of the Regional
Park and will continue to be important in future development of the Regional
Park; and
WHEREAS, future development of the Regional Park will include site
improvements such as a Park Lake Trail, Park Picnic Areas, Fishing Piers and

being a tribute to Daniel P. O'Brien, Jr. for years of public service.
NOW, THEREFORE, BE IT RESOLVED BY THE COLLIER COUNTY PARKS AND RECREATION
ADVISORY BOARD that the following are hereby approved for Sugden Regional Park
Facilities:
1. Participation in site improvements to the Sugden Regional Park by the
representatives of the Estate of Daniel P. O'Brien, Jr.; such improvements shall
be in accordance with the Park Master Plan and subject of approval by the Parks
and Recreation Director.
2. Placement of an appropriate tribute to Daniel P. O'Brien Jr. at the
Regional Park by the representatives of the Estate of Daniel P. O'Brien, Jr.
subject to review and approval of the Parks and Recreation Director in
accordance with established County Parks and Recreation Policy.
BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the
representatives of the Estate of Daniel P. O'Brien, Jr.
This Resolution adopted after motion, second and majority vote favoring
same.
