I September 25th, 2016 Members: Rural Neighborhoods, Incorporated, is a charitable organization providing neighborhood revitalization and affordable housing to low-, very-low and extremely low-income households in rural communities throughout Florida including Immokalee. In Immokalee, Rural Neighborhoods(RN) communities include Main Street Village, Reserve at Eden Gardens and Esperanza Apartments. Two projects are in development: Hatchers Preserve and Timber Ridge at Sanders Pines. On completion RN's local holdings total 316 units at a total investment of$40M. One of our chief objectives is the revitalization of the Eden Park-Esperanza Place residential neighborhood that generally falls between Immokalee Drive on the South and northernmost residential homes to the north and runs from Main on the east to Little League on the west. Data indicates that 4 of 10 households in this neighborhood go home to sleep at night in mobile homes. I believe it safe to say that mobile home conditions — both the dwelling units themselves and the parks that accommodate them — are unacceptable. Fire dangers abound. Dust control and good drainage are absent. The control of rodents and mosquitos poor— especially as concerns over mosquito-borne viruses grow. I applaud the efforts undertaken by Growth Management and park owners to improve these unacceptable conditions though more transparency and public input is needed before reaching agreement. Rural Neighborhoods as a change agent for housing and community developer understands the problems of nonconforming use. Having interviewed more than 150 households in the Eden Park-Esperanza Place neighborhood in the past 12 months, we understand the sentiments of area households who reside in mobile homes. I submit the following comments regarding the proposed Specific Design Standards for the Immokalee Mobile Home Park Overlay Subdistrict. 1. We support the 1:1 replacement of dilapidated mobile homes. Growth Management states the proposed amendment is designed to help mobile home owners (and operators as well) upgrade their units. Rural Neighborhoods supports replacement of individual mobile homes in exchange for site improvements that meet Fire Separation requirements. If a life can be saved due to the improved fire safety or residing in an FBC-compliant mobile home results in its residents surviving a named-storm than the so-called "swap-out" of older units is worthwhile. Momentarily,that is where the proposed ordinance should stop. MIAMI-DADE COLLIER HENDRY OKEECHOBEE POLK SAINT LUCIE HILLSBOROUGH 2. Let's have straightforward talk about the real beneficiaries. Staff comments indicate this amendment is to help mobile home owners -- and park operators, as well. Let's be clear: this ordinance helps park operators—not, park operators as well. Chiefly park operators. In the case of a poor farmworker that seeks to replace his older trailer with an FBC-compliant unit, it is the park owner who must upgrade the park. Nothing in the proposed ordinance precludes lot rent from rising. Indeed,given the cost to relocate a mobile home,the trailer owner is hostage to rent increases now and in the future. Rents,too,are unrestricted—a replacement mobile home likely draws increased rent. So let's not call trailer rents a bargain and, especially, let's not label it an affordable housing strategy. Current mobile home park rents in the Eden Park-Esperanza Place neighborhood range from$600-$1000 each month, and in season can be leased to unaccompanied workers from $35 -$50 per week. Newer, code-compliant, concrete-block construction, Income-restricted housing built by both the private and nonprofit sectors lease for less or comparable rents. 3. Economic benefits go to Park Owners. I would argue the economic benefits to park operators are substantial and Growth Management extracts a poor bargain. Donald Trump would lambast local government's negotiation results. Language in the materials that accompany the proposed change tell the economic story: a. Sample Statement: Numerous Collier County Code Enforcement issues will be resolved. (Page 5). Our translation: If local government lower the standards to near conditions that exist in the mobile parks,then there will be no violations to cite and local government can avoid the messiness involved in enforcement. Not having to invest in upgrades is a benefit to a park owner. b. Sample Statement: Past LDC requirements have required property owners to hire engineers, landscape architects, lawyers and other professionals...." Every land owner and real estate developer in Collier County feels this pain. Each person seeking to improve property must hire professionals to meet a multitude of requirements in this Land Development Code and would cherish the opportunity to plead its woes. Mobile home park owners are no different nor should be treated in any special manner. These reduced standards are a substantial economic benefit. c. Sample Statement. Selling...becomes very difficult. Selling has been delayed. The numerous references throughout the proposal about how hard it is to sell, sell, sell make it apparent that reaping value from the sale of a nonconforming asset is the objective. Let me offer a counterpoint—selling really isn't hard, everything sells. Getting the price you want—now that's hard part. MIAMI-DADE COLLIER HENDRY OKEECHOBEE POLK SAINT LUCIE HILLSBOROUGH If a new owner has significant upgrades to make in order to be compliant, selling price falls. Businesses sell based on a cap rate: $1 worth of cash flow is worth X. But the cash flow from a nonconforming use is far higher than cash flow from a park that must capitalize new improvements to be compliant. Under the best interpretation of the LDC language,these amendments are more giveaway than a fair exchange. Not a single mobile home need be replaced to become a conforming use based on our reading of the proposal. Not a single dumpster installed for vector control; nor a single internal street improved to control dust, nor improvements to provide minimal drainage. It's a fire plan. 4. The proposed changes go too far outstripping the objective. Proposed amendments allowing mobile home parks to increase in size are just not needed. The initial stated objective of the LDC amendments was to solve a problem --the poor conditions of dwelling units and the fire safety risks that have resulted in the precious loss of life. The end product — especially provisions to allow increased density -- enriches current park owners with little promise of improved housing conditions The sole argument that could be sounded in its defense is if there were a rental housing crisis or dire need for more affordable housing in the area. In truth,the rental market is balanced at present. For example, several hundred units at the Collier County Housing Authority are now being readied and are not limited to farmworkers(nor even legal residents) as they may have been in the past. More importantly,the LDC amendments is an example of how government alters market economics and chooses winners and losers. Existing parks in unacceptable condition (and with only modest upgrades) are favored over other business people who seek to establish a new mobile home park at much higher standards. Why? If mobile home parks expand, Rural Neighborhoods believes it must be in accordance with county- wide standards—not a special overlay for Immokalee. I see no need for an Immokalee double- standard —especially one that sets lower criteria for Immokalee mobile homes because the folks are poor. That impedes economic growth; it does not encourage it. It hinders alternative housing products all the while perpetuating mobile home parks with lower standards than their competitors. In conclusion, Rural Neighborhoods strongly supports the upgrading of owner-occupied and renter- occupied mobile homes. In the broad spirit of the proposal, replacement of mobile homes should not require bringing a nonconforming use into a conforming one. This "swap-out" should require, some additional considerations in addition to the unit being FBC- compliant. Perhaps,the mobile home to be swept in should be no more five(5)years old,that it be skirted or that steps into and out of the mobile home be manufactured rather than hand-built except in the instance of handicap accessible ramps. MIAMI-DADE COLLIER HENDRY OKEECHOBEE POLK SAINT LUCIE HILLSBOROUGH Rural Neighborhoods is prepared to support making existing park uses conforming if, in addition to the proposed fire safety requirements, owners make additional improvements in accordance with the design standards set out in 4.02.33. In granting conformance, Growth Management should also consider requirements that some percentage of mobile homes be upgraded. If not, economic benefits will befall park owners with no more requirement than minimum fire separation be achieved. Rural Neighborhoods opposes any increase in mobile home park densities based on standards less than the current codes as presently adopted. If mobile home parks are to be part of an affordable housing strategy, standards need to be commensurate with those faced by standard dwellings. Indeed, existing mobile home parks should have no economic advantage over a newly constructed mobile home park or one located in other Commission Districts throughout the county.
