ACCESS AND MAINTENANCE EASEMENT ,
THIS EASEMENT, made and entered into this If day of �.ake P,l , 2016,
by NAPLES RETIREMENT, INC., a Florida not-for-profit corporation, whose mailing address
is 1000 Lely Palms Drive, F-147, Naples, Fl 34113, (hereinafter referred to as "Grantor"), to
the BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE
GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD
OF THE COLLIER COUNTY WATER-SEWER DISTRICT, whose mailing address is 3335 Tamiami
Trail East, Ste. 101, Naples, Florida 34112, (hereinafter referred to as "Grantee").
(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to
this instrument and their respective heirs, legal representatives, successors and assigns.
Grantor and Grantee are used for singular or plural, as the context requires.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee a
perpetual, non-exclusive access and maintenance easement over, under, upon and
across the following described lands located in Collier County, Florida, to wit:
See attached Exhibit "A"which is incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY
TO HAVE AND TO HOLD the same unto the Grantee, its successors and assigns,
together with the right to enter upon said land for the purpose of operating and
maintaining structures and facilities, including but not limited to utility above and below
ground infrastructure and various types of wastewater control structures within existing
utility easement areas (water and wastewater). This Access and Maintenance
Easement includes the right to remove and use any and all excavated material and to
construct and maintain the utility facilities thereon. Grantee shall have the right to
place landscaping as delineated by Public Utilities Department staff within the median
area around above ground infrastructure in said land, and shall have the right to
access landscaping for maintenance of the utility facilities at all times. Grantor and
Grantee agree that maintenance of the surface area in and around the pump station
is limited to maintaining the utilities and restoring any damage caused as a result of
maintaining the utilities. Normal landscape maintenance lies with the Grantor. The
easement granted herein shall constitute easements running with the land and shall
burden the lands described above.

GRANTEE, by acceptance of this easement agrees for itself, its successors and
assigns, to maintain said easement and minimize disruption with ingress or egress of
GRANTOR, its successors and assigns, or any other party requiring access to any of the
property over which said easement is granted. GRANTEE further agrees that it will at all
times use extreme care to restore all grounds to as good or better condition than found
prior to construction, maintenance and repair.
IN WITNESS WHEREOF, the Grantor has caused these presents to be executed the
